On February 8, 2019, the Division of Water Resources (Division) received your application dated January 29, 2019,
requesting a 401 Water Quality Certification from the Division for the above referenced project. The Division received
the permit fee on February 28, 2019. The Division has reviewed the information and has determined the application is
incomplete and cannot be processed. The application will be placed on hold until the following items are addressed:
1. The figures provided in the permit application do not allow the Division to adequately assess avoidance and
minimization of the stream and wetland areas. For Exhibits B and C, please adjust the scale to show all of UT -2
and the adjacent wetland areas within the proposed development. Please include the proposed contours, lot
lines, roads, driveways, sewer lines and laterals, stormwater measures, and house footprints. You must
demonstrate that the development of each proposed lot will not result in additional impacts to streams or
wetlands (e.g. sewer lateral installations, site grading, erosion control measures, house footprints, etc.) [15A
NCAC 02H .0506(f) and (g)]
2. This Office believes that the proposed lots and stormtech system associated with the cul -del -sac shown in
Exhibit B can be moved or reconfigured to the south to avoid or minimize the impacts to the wetlands. Please
revise the plans to minimize the impacts or provide a detailed explanation of why this plan for the activity
cannot be practically accomplished, reduced or reconfigured to better minimize the wetland impacts. [15A NCAC

3. PCN Exhibit A shows an existing 18 -inch CMP culvert that will be removed and replaced by three 24 -inch HDPE
pipes. It appears the downgradient portion of the existing pipe will be converted to an open channel. Please
provide the proposed cross-section of the new channel based on a stable reference condition. At a minimum,
please provide the channel side slopes, depth, and bottom width. Update the PCN impact table to separate out
impact lengths associated with open channel creation and pipe installation.
4. Per Condition 11 of WQC 4139, please provide additional details on how you will maintain the physical integrity
of the stream above and below the proposed culverts in Exhibit A. If multiple pipes or barrels are required, they
shall be designed to mimic natural stream cross section as closely as possible including pipes or barrels at flood
plain elevation and/or sills where appropriate. Widening the stream channel should be avoided. Stream
channel widening at the inlet or outlet end of structures typically decreases water velocity causing sediment
deposition that requires increased maintenance and disrupts aquatic life passage. A construction sequence and
detail should be provided to ensure the contractor is clear on construction of these benches. [15A NCAC 02H
.0506(b)(2)]
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the
proper consideration of the application. If all of the requested information is not received within 30 days, the Division
will be unable to approve the application and it will be returned.
