Hamilton Assistant Director DATE: February 8, 1993 SUBJECT: Division of Environmental Management Section 401 Water Quality Certification for Mr. David Evans, Fork Swamp Canal, Pitt County, North Carolina Professional biologists from our staff have reviewed the subject permit application and conducted a site investigation on January 22, 1993 to assess project impacts on wildlife and fisheries resources. This correspondence is provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and North Carolina General Statutes (G.S. 113-131 et seq.). The applicant is requesting authorization to fill 3.9 acres of forested wetland for residential development. The site is currently forested with a mature mixed pine and hardwood stand, part of a larger forest complex, providing habitat for a wide range of wildlife species. Based upon information provided in the permit application and results of our field investigation, it is our recommendation that certification not be issued for the project. We would be willing to discuss the project further if modifications were made to minimize the amount of wetland affected and if a mitigation plan for unavoidable impacts is developed. Specifically, the property is located within the city limits near the intersection of Red Banks Drive and Arlington Blvd. at the southern end of the tract. The purpose of the filling impact is to enable the completion of a road and multi-family development on the 18.31 acre parcel. About 1.8 acres of the delineated 404 wetland will remain undisturbed. BOX 1890 WILMINGTON, NORTH CAROLINA 28402-1890 IN REPLY REFER TO March 15, 1993 Regulatory Branch Action ID. 199203340 and Nationwide Permit No. 26 (Headwaters and Isolated Waters) Mr. David Evans Post Office Box 2548 Greenville, North Carolina 27834 Dear Mr. Evans: This letter confirms that on July 28, 1992, Mrs. Laura Fogo of my staff met with Mr. Larry Baldwin of Land Management Group, on your property known as Tucker Estates, Section 6, located off Red Banks Road and Tucker Drive, adjacent to Meeting House Branch, Greenville, in Pitt County, North Carolina. The purpose of this meeting was to inspect the approximate 57-acre section for waters and wetlands subject to Department of the Army permitting authority, and to confirm the wetlands delineation and survey you have undertaken on the site. Based upon the aforementioned onsite inspection, and review of the survey, we recognize this surveyed alignment to be the limits of our regulatory jurisdiction on the property. Unless there is a change in the law or our published regulations, this determination of the limits of wetlands may be relied upon for a period not to exceed three (3) years from July 28, 1992. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits (NWP). Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters provided: a. The discharge does not cause the loss of more than 10 acres of waters of the United States; b. The permittee notifies the District Engineer if the discharge would cause the loss of waters of the United States greater than one acre in accordance with the "Notification" general condition. For discharges in special aquatic sites, including wetlands, the notification must also include a delineation of affected specific aquatic sites, including wetlands; and c. The discharge, including all attendant features, both temporary and permanent, is part of a single and complete project. W?? l -2- You propose to place fill material on approximately 26,136 square feet (0.60 acre) of 404 wetlands for the purpose of constructing Tucker Drive and Interlude Drive, and expanding Lots Nos. 4, 7, 8, 11, 12, 46, 47, and 48. Your work is authorized by this NWP provided it is accomplished in strict accordance with the enclosed conditions. This NWP does not relieve you of the responsibility to obtain any required State or local approval. You should contact Mr. John Dorney, North Carolina Division of Environmental Management, (919) 733-5083, to obtain the necessary Section 401, Water Quality Certification prior to starting work. This verification will be valid for two years from the date of this letter unless the nationwide authorization is modified, reissued or revoked. Also, this verification will remain valid for the two years if, during that period, the NWP authorization is reissued without modification or the activity complies with any subsequent modification of the NWP authorization. If during the two years, the NWP authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the NWP, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the NWP will remain authorized provided the activity is completed within twelve months of the date of the NWP's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend or revoke the authorization.
