Although no boat slips an proposed, the project includes 8 sound front lots with riparian
access on the SA ORW water of a tributary to Alligator Bay. Property owners can request pier
exemptions for individual lot with up to four slips per pier. This subdivision could therefor
have a total of 32 slips. The are currently four subdivisions along this tributary of Alligator
Bay requesting CAMA Majo Development Pen-nits. The total number of sound front lots for
all four subdivisions is 62, reating the possibility of 248 slips along the 4000 feet of this
tributary's shoreline. The ombined effects of these boat slips could possibly create the
necessity for a shellfish close a at some future time. Per T15A: 18A .0911 (6), the cumulative
impacts of multiple marinas, entrance canals, or other mooring areas, in close proximity to
each other are expected to ad ersely affect public trust waters. When these situations occur the
Division of Environmental ealth will recommend closures. Because of these possible
cumulative impacts it is reco mended that the CAMA Permit include specific conditions which
would prohibit pier densities from reaching the point that closure may occur.

9. PROJECT R I
The project is located between Mason Creek off Alligator Bay and the Atlantic Ocean
on both sides of the r ently relocated portion of SR 1568 in the Town of North Topsail
Beach, Onslow Coun y. The tract has an area of approximately 8.8 acres of area
landward of the mean high water contour. The largest portion of the project is situated
to the north of the a sting road on the sound side. The waters of Mason Creek and
Alligator Bay have b n classified as SA ORW (Outstanding Resource Waters) by the
Division of Environm tal Management. The Shellfish Sanitation section of the Division
of Health Services hav determined that the waters are open to shellfishing. The Division
of Marine Fisheries ha ve designated the area as a primary nursery area. The Division of
Coastal Management h ave designated the high ground area with 575 feet of the mean
high water elevation o Mason Creek and Alligator as an Estuarine Shoreline ORW AEC.
The federal 404 wetl ds on the tract have been identified and are designated on the
project plat. The first line of stable vegetation on the ocean front was determined in
March 1993 and is als shown on the project plats. The ocean front portion of the project
appears to have receiv, impacts from the public use of the nearby unimproved access
feature to the west. V ry little in the way of dune features are present except for the
oceanward side. This ccess point is on private property whose owner apparently does
not object to the use b the public. Onslow County has an access facility to the east of
the project site. It is tiguous with the site on the sound side but is separated from the
project on the ocean f ont by a tract reserved for future development. The sound side
portion of the tract is v egetated by typical maritime thicket type vegetation. The project
site is located within area where federal flood insurance is not available. However,
private insurance can a obtained. This property is zoned as R20 by the Town. It is
located within an area classified as Limited Transitional in the Town's Land Use Plan
recently approved by a Coastal Resources Commission.
The applicant's Engineers/Consultants have submitted plans to develop the available
portion of high groun property into 11 single family residential lots. Of that number
eight will be located o the sound (north) side of SR 1568 and the other three will be on
the oceanfront. Building envelops have been identified for all of the lots based either on
the 90' setback on the ean side or the location of the federal 404 wetlands on the sound
side. Access from SR 1568 will be provided by several common limited access 20' drives
(sheet 2 of 4). There has been a set of protective covenants developed for this
development which, ariong other things, limits the "built upon area" of each lot to the
area calculated to be co sistent with current regulations by the Division of Environmental
Management in theirs rmwater review of the project. This value has been determined
to be 5940 S. F. and 7!41 S. F. on the ocean front. There are also two access features
shown on the plans. B oh are indicated to be 10 feet wide. On the sound side this feature
is located between lot 6 and 7. On the ocean front the feature is located along the
eastern property line an a walk (dune crossover) is also indicated. (sheet 2 of 4). No plan
for the walk is Drovid .

The project is located wvithin the ES ORW AEC. Therefore, the amount of "built upon
area" is limited to no more than 25% within 575 feet of the mhw contour of Mason
Creek or Alligator Ba . Also, no engineered stormwater system can be utilized in order
to control run off from the project site. The project has been designed to conform with
current regulations for ES ORW AEC. As stated above the "built upon area" of the lots
has been limited to 59 S. F. for the sound side lots and 7241 S. F. for the ocean front.
The building envelops have also been determined and designated in the plans for the
project (sheet 2 of 4) The proposed development will result in approximately 22.0%
coverage of the tract. The project appears to be consistent with the Land Use Plan for
the Town. The R20 zoning provides for the least dense development of land which is
required by the Limit Transitional classification of the property. There exists the
potential for water qu ity impacts on the sound side. This would be the result of the
apparent available rip 'an access for lots 1 - 8. This impact is compounded by the
presence of several newly proposed subdivisions all touching the waters of Mason Creek.
The excellent water qu ity now existing in this water body could be seriously impacted
by the proliferation of ingle family piers with up to 4 slips each. This could result in the
build out of a total of 2 slips maximum under the current rules for exempt piers. At
present there is a singl 10' access proposed to the sound with no proposed construction
of a walk or pier. Thee are at present four subdivisions being proposed all of which
touch the waters of son Creek to some degree. There are approximately 62 lots
which appear to have ri arian access rights associated with these four subdivisions. Based
on current interpretati of the rules this would provide for up to 248 slips along the
combined shoreline of a embayment of Mason Creek affecting approximately 4000 feet
of shoreline. This react is somewhat divided by the presence of the county recreational
facility which itself haslseveral hundred feet of shoreline without divided riparian access
claims. It is apparent, ii i the case of these subdivisions, that the cumulative impact of the
possible boat slips mus be considered. There are also areas identified as shellfish leases
located within Mason reek. Although it is not known at this time if all are active,
consideration must be g ven to the possible impacts of future boat access activity on those
that may be.In order t protect the adjacent waters to the maximum extent possible,
access must be limited ?Io that which can be provided by a common feature of minimal
design.

A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to carry out
the project.
An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources
Commission Rule 7J.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers, landmarks, and
the like.

The project is located $etween Mason Creek off Alligator Bay and the Atlantic Ocean
on both sides of the rec ntly relocated portion of SR 1568 in the Town of North Topsail
Beach, Onslow Count . The tract has an area of approximately 8.8 acres of area
landward of the mean igh water contour. The largest portion of the project is situated
to the north of the exiting road on the sound side. The waters of Mason Creek and
Alligator Bay have b n classified as SA ORW (Outstanding Resource Waters) by the
Division of Environme tal Management. The Shellfish Sanitation section of the Division
of Health Services hav, determined that the waters are open to shellfishing. The Division
of Marine Fisheries ha e designated the area as a primary nursery area. The Division of
Coastal Management ave designated the high ground area with 575 feet of the mean
high water elevation of Mason Creek and Alligator as an Estuarine Shoreline ORW AEC.
The federal 404 wetl ds on the tract have been identified and are designated on the
project plat. The first line of stable vegetation on the ocean front was determined in
March 1993 and is als shown on the project plats. The ocean front portion of the project
appears to have V id impacts from the public use of the nearby unimproved access
feature to the west. ry little in the way of dune features are present except for the
oceanward side. This ccess point is on private property whose owner apparently does
not object to the use y the public. Onslow County has an access facility to the east of
the project site. It is c ntiguous with the site on the sound side but is separated from the
project on the ocean ont by a tract reserved for future development. The sound side
portion of the tract is tegetated by typical maritime thicket type vegetation. The project
site is located within ?n area where federal flood insurance is not available. However,
private insurance can'be obtained. This property is zoned as R20 by the Town. It is
located within an arei classified as Limited Transitional in the Town's Land Use Plan
recently approved by the Coastal Resources Commission.
The applicant's Engi eers/Consultan ts have submitted plans to develop the available
portion of high ground property into 11 single family residential lots. Of that number
eight will be located n the sound (north) side of SR 1568 and the other three will be on
the oceanfront. Building envelops have been identified for all of the lots based either on
the 90' setback on thel ocean side or the location of the federal 404 wetlands on the sound
side. Access from SR.J1568 will be provided by several common limited access 20' drives
(sheet 2 of 4). Th e has been a set of protective covenants developed for this
development which, mong other things, limits the "built upon area" of each lot to the
area calculated to be onsistent with current regulations by the Division of Environmental
Management in their stormwater review of the project. This value has been determined
to be 5940 S. F. and 7241 S. F. on the ocean front. There are also two access features
shown on the plans. oth are indicated to be 10 feet wide. On the sound side this feature
is located between 1 is 6 and 7. On the ocean front the feature is located along the
eastern property line d a walk (dune crossover) is also indicated. (sheet 2 of 4). No plan
for the walk is provi ed.

The project is located ithin the ES ORW AEC. Therefore, the amount of "built upon
area" is limited to no ore than 25 % within 575 feet of the mhw contour of Mason
Creek or Alligator Bay. Also, no engineered stormwater system can be utilized in order
to control run off from the project site. The project has been designed to conform with
current regulations for ORW AEC. As stated above the "built upon area" of the lots
has been limited to 594 S. F. for the sound side lots and 7241 S. F. for the ocean front.
The building envelops have also been determined and designated in the plans for the
project (sheet 2 of 4) he proposed development will result in approximately 22.0%
coverage of the tract. he project appears to be consistent with the Land Use Plan for
the Town. The R20 z ing provides for the least dense development of land which is
required by the Limit Transitional classification of the property. There exists the
potential for water quality impacts on the sound side. This would be the result of the
apparent available riparian access for lots 1 - 8. This impact is compounded by the
presence of several ne+y proposed subdivisions all touching the waters of Mason Creek.
The excellent water qu ity now existing in this water body could be seriously impacted
by the proliferation of ingle family piers with up to 4 slips each. This could result in the
build out of a total of 32 slips maximum under the current rules for exempt piers. At
present there is a single 10' access proposed to the sound with no proposed construction
of a walk or pier. Th re are at present four subdivisions being proposed all of which
touch the waters of Mason Creek to some degree. There are approximately 62 lots
which appear to have dparian access rights associated with these four subdivisions. Based
on current interpretati n of the rules this would provide for up to 248 slips along the
combined shoreline of he embayment of Mason Creek affecting approximately 4000 feet
of shoreline. This rea is somewhat divided by the presence of the county recreational
facility which itself ha several hundred feet of shoreline without divided riparian access
claims. It is apparent, n the case of these subdivisions, that the cumulative impact of the
possible boat slips mint be considered. There are also areas identified as shellfish leases
located within Masoni Creek. Although it is not known at this time if all are active,
consideration must be ?iven to the possible impacts of future boat access activity on those
that may be.In order to protect the adjacent waters to the maximum extent possible,
access must be limit to that which can be provided by a common feature of minimal
design.
