Topsail Beach. The applic its have provided a set of covenants by which to control the

The project is located to he north and south of the relocated portion of SR 1568 within
the Town of North Tops it Beach. The recently permitted Onslow County access area
#4 is located just west o the tract. The applicant's Engineers/ Consultants indicate that
approximately 32.5 acr s of property are in the Tract. Of that total acreage,
approximately 1/3 is located to the south of the existing State Road adjacent to the
Atlantic Ocean. The other 2/3 is located to the north of the road adjacent to the waters
of Alligator Bay. The A antic Ocean is classified as SB water by the NC Division of
Environmental Managem nt (DEM). Alligator Bay is classified as SA-ORW by DEM.
It is also open to shellfis ing. The Alligator Bay is also designated as a primary nursery
area by the NC Division of Marine Fisheries (DMF). The highground portion of the
property can be classified as beach dune community on the ocean front and maritime
thicket on the sound side. There has been a 404 wetland determination completed on the
property. This informatio is shown on the bluelines submitted with the application. The
application indicates that ke subdivision is approved for a R20 density.
The applicants are pro*sing to parcel the existing tract into 28 residential lots.
Of that number there wild be 15 lots located on the Ocean side of the project. The other
13 lots will be on the so* side. Lots 13, 14 and 15 on the ocean side will be combined
in order to construct the proposed clubhouse. There were no plans submitted for this
structure with the applic tion. The smallest lot is identified as Lot 27 located on the
sound side which has an ea of approximately 30,513 square feet. There are two 10 feet
wide public access easem nts identified on the property. The one on the ocean front is
located on the east side f Lot #1 on the ocean front. On the sound side the access is
located approximately i the middle of the tract and crosses the 404 wetlands
approximately four-fifths' f the way between Lot 19 and Lot 20 and extends from SR
1568 to Mason Creek. A present there are no structures proposed in either easement.

The applicants have fu er restricted the usable area of the individual lots adjacent to
the Corps of Engineers 04 wetlands by identifying the building envelope area within
each lot. All constructio must take place within this area in order to avoid significant
impacts on the Corps w lands. The subdivision will be provided with central water and
sewer service by an existing private utility. Due to the apparent restricted status of this
facility it was necessary for the applicants to secure approval from DEM to connect to
it. The ocean front lots so have a building envelope established for them. The first line
of stable natural vege tion as determined in January 1993 is shown on the plans
submitted with the appli ation (Sheet 1 of 8).

8 ADDITIONAL INFORMATION
In addition to the completed application form, the follow-
ing items must be submitted:
A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to carry out
the project.
An accurate -work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources
Commission Rule 7J.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers, landmarks, and
the like.

application indicates th t the subdivision is approved for a R20 density.
The applicants are proposing to parcel the existing tract into 28 residential lots.
Of that number there w 11 be 15 lots located on the Ocean side of the project. The other
13 lots will be on the nd side. Lots 13, 14 and 15 on the ocean side will be combined
in order to construct a proposed clubhouse. There were no plans submitted for this
structure with the app cation. The smallest lot is identified as Lot 27 located on the
sound side which has area of approximately 30,513 square feet. There are two 10 feet
wide public access eam ents identified on the property. The one on the ocean front is
located on the east side of Lot #1 on the ocean front. On the sound side the access is
located approximately in the middle of the tract and crosses the 404 wetlands
approximately four-fifths of the way between Lot 19 and Lot 20 and extends from SR
1568 to Mason Creek. At present there are no structures proposed in either easement.

appears to be consistent with the Land Use Plan recently adopted for the Town of North
Topsail Beach. This d ument classifies the project area as Limited Transitional. The
description in the plan for this classification speaks to those areas more suitable for lower
density development. T?e R20 zoning is the lowest density designation in the Town.
The project, as stated'above, is located within an ORW Estuarine Shoreline AEC.
Therefore, the built upoi or disturbed area is limited to 25 % coverage within 575' of the
mean high water (mhw) contour. Also no engineered stormwater system can be utilized
to control the run-off ticipated from any project located within an ORW AEC. The
applicants have design the proposed project within the limits required by the existing
standards. The total co erage by "built upon areas" is approximately 5.5 % of the total
available area above th mhw contour. Although there are wetlands identified on the
property the plans ind' to that these areas will be avoided by the incorporation of
building envelopes into the plans for each lot. The usable space of each lot is further
restricted through the in trument prepared between the Applicants and DEM whereby the
"built upon area" of ea (h residential lot is limited to a total disturbance of 6,932 S. R.
A somewhat signifi tly different value (11,830.3) is included in the Protective
Covenants document as ubmitted at our request by the applicant's Engineers/Consultants
at the request of this 'ter. A folloe up conversation with the Engineers/Consultants
indicates that this diff ence has been resolved. It seems that the second value was
originally calculated baied on the original approximation of the mhw contour presented
