PROJECT SUMMAR The applicant proposes to upgrade the existing fishhouse to a recreational marina providing small craft rental and boatdocks. In order to accomplish this he proposes to carry out minor maintenance dredging within the existing basin add finger piers to an existing pier and dock area; and add an additional pier with finger piers and add a boat ramp. Donald E. Mercer Page 2 of 3 9. The project is located on the New River in the Central business district of Sneads Ferry, Onslow County. The pro t site is on the south bank of the river. There is an existing fish house on the site which has apparently not been operated in the past several years. The fish house is approximately 4 ' x 49' and is constructed in such a way as to extend waterward of the mean high water ` (mhw) contour. There is also a block building located on the highground property which appears to have been used for storage or as a freezer. The site was recently issued a bulkhead permit under the General Permit authorization in order to re-stabilize the eroding s oreline. There are two existing piers located along the existing shoreline. The first is as ociated with the fish house and is approximately 242' long x 5' wide. There are no existi g finger piers on this structure. The other pier is aligned along the downstream property li and is approximately 220' long. The existing basin area is somewhat irregular in siz . The portion upstream of the fishhouse pier is approximately 242' long x 110'wide. The rtion between the fishhouse pier and the downstream pier is approximately 220'long x 110'wide. Depths within the basin range from - 3.5' to -4.0' mean low water (mlw) in the Win middles to -0.5' mlw along the edges. The river is classified as SA water and although the waters in the project site were closed to shellfishing originally due to the boats associat with the former fishhouse, the immediate area has been opened since 1989. However, it _ is not a designated primary nursery area. There are no coastal wetlands within the projot area. The applicant proposes t develop the site into a public/commercial marina. In order to accomplish this he is p posing to add finger piers to a portion of the existing dock associated with the fish house. He also proposes to construct a new pier with finger piers at the downstream corner f the project site just inside the existing pier at that location. Additionally he proposes o add additional finger piers to that area of the basin between the existing fish house and toe proposed new pier. He also indicates that a boat ramp will be located adjacent to the existing storage building which will be used for small rental boat access. The applicant is proposing to add from 8 to 10 finger piers to the existing large pier. The new pier will be app ximately 220' in length and will be approximately 6' wide. There are 8 fingers proposed on the new pier. An additional 4 fingers will be added to the southern side of the basin. The pl s indicate that the finger piers will be approximately 15' in length x 4' wide. The applica ' n indicates that there will be 30 slips available in the upgraded facility which will provid? for boats up to 35' in length. The applicant is also proposing to maintenance dredge two areas of the basin. The smaller area is approximately 60x 40' and the larger approximately 230' x 30'. Approximately 1100 cu. yds. will be moved to a highground disposal by means of barge mounted mechanical excavation eqaipment. The high ground area adjacent to the basin will be used for activities related to a proposed marina facility. ANTICIPATED IMP TS At present this facility appears to have the capacity to dock approximately 25 vessels approximately 24' in le gth. However it is highly unlikely that this number has ever been in this location at on time. A conservative estimate of the total possible number of available slips which ill be created by the proposed project is approximately 40. This number would be of mi ed lengths. The marina supplement of the application indicates that 30 slips are proposed. he current Health Services Guidelines provide for up to 29 (less than 30) slips provided that there are no boats with cabins; no boats greater than 24' in length; and no boats wi h marine sanitation devices (heads). The proposed facility appears to exceed the allowed umber of vessels by one (1) boat according to the application and approximately 11 boats by apparent slip count based on existing and proposed structures. Also, it appears that se, the 24' length criteria appears that the dockinj compliance with Health a resulting denial of the configuration of slips w be an operational stater with cabins and/or mar eral slips could accommodate vessels which could be at or exceed and the application states that up to 35' boats are anticipated. On February 6, 1990, the DA and the U.S. Environmental Protection Agency (EPA) signed a memorand of agreement (MOA) establishing procedures to determine the type and level of mitigation necessary to comply with the Clean Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding impacts to waters and we lands through the selection of the least damaging, practical alternative; s cond, taking appropriate and practical steps to minimize impacts on wate s and wetlands; and finally, compensating for any remaining unavoidable im acts to the extent appropriate and practical. To enable us to process you application in full compliance with this MOA, we request that you provide the following additional information: a. Permits for work within wetlands or other special aquatic sites are available only if the proposed work is the least environmentally damaging, practicable alternative. PROJECT SU INIARY The applicant proposes to upgrade the existing fishhouse to a recreational marina provi ing small craft rental and boatdocks. In order to accomplish this he proposes to carry out minor maintenance dredging within the existing basin add finger piers to an existing pier and dock area; and add an additional pier with finger piers and add a boat ramp. Donald E. Mercer Page 2 of 3 9. PROJECT DESCRIPTIO N The project is located on e New River in the Central business district of Sneads Ferry, Onslow County. The prof t site is on the south bank of the river. There is an existing fish house on the site which h apparently not been operated in the past several years. The fish house is approximately 48 x 49' and is constructed in such a way as to extend waterward of the mean high water mhw) contour. There is also a block building located on the highground property whic appears to have been used for storage or as a freezer. The site was recently issued a bull head permit under the General Permit authorization in order to re-stabilize the eroding Sh oreline. There are two existing piers located along the existing shoreline. The first is ass ociated with the fish house and is approximately 242' long x 5' wide. There are no existin finger piers on this structure. The other pier is aligned along the downstream property lin and is approximately 220' long. The existing basin area is somewhat irregular in size The portion upstream of the fishhouse pier is approximately 242' long x 110'wide. The po rtion between the fishhouse pier and the downstream pier is approximately 220'long x 10'wide. Depths within the basin range from - 3.5' to -4.0' mean low water (mlw) in the b sin middles to -0.5' mlw along the edges. The river is classified as SA water and although he waters in the project site were closed to shellfishing originally due to the boats associat with the former fishhouse, the immediate area has been opened since 1989. However, it s not a designated primary nursery area. There are no coastal wetlands within the prof t area. The applicant proposes t develop the site into a public/commercial marina. In order to accomplish this he is pr posing to add finger piers to a portion of the existing dock associated with the fish h use. He also proposes to construct a new pier with finger piers at the downstream corner the project site just inside the existing pier at that location. Additionally he proposes add additional finger piers to that area of the basin between the existing fish house and fte, proposed new pier. He also indicates that a boat ramp will be located adjacent to the e isting storage building which will be used for small rental boat access. The applicant is p posing to add from 8 to 10 finger piers to the existing large pier. The new pier will be appr ximately 220' in length and will be approximately 6' wide. There are 8 fingers proposed on e new pier. An additional 4 fingers will be added to the southern side of the basin. The pl s indicate that the finger piers will be approximately 15' in length x 4' wide. The applicati n indicates that there will be 30 slips available in the upgraded facility which will provide for boats up to 35' in length. The applicant is also pro sing to maintenance dredge two areas of the basin. The smaller area is approximately 60 x 40' and the larger approximately 230' x 30'. Approximately 1100 cu. yds. will be q moved to a highground disposal by means of barge mounted mechanical excavation eq ipment. The high ground area adjacent to the basin will be used for activities related to e proposed marina facility. The existing fish house and storage building will be utilized ads sales and/or rental facilities. Donald E. Mercer Page 3 of 3 10. ANTICIPATED IMP CTS - At present this facility appears to have the capacity to dock approximately 25 vessels approximately 24' in length. However it is highly unlikely that this number has ever been in this location at one time. A conservative estimate of the total possible number of available slips which w 11 be created by the proposed project is approximately 40. This number would be of mi lengths. The marina supplement of the application indicates that 30 slips are proposed. The current Health Services Guidelines provide for up to 29 (less than 30) slips provided at there are no boats with cabins; no boats greater than 24' in length; and no boats wit marine sanitation devices (heads). The proposed facility appears to exceed the allowed n mber of vessels by one (1) boat according to the application and approximately 11 boats y apparent slip count based on existing and proposed structures. Also, it appears that se ral slips could accommodate vessels which could be at or exceed the 24' length criteria and the application states that up to 35' boats are anticipated. It appears that the docking plan must be modified in order to bring the proposed facility into compliance with Health Services regulations or an automatic closure will be necessary with a resulting denial of the permit request. The proposal must include changes in the physical configuration of slips w ich will not allow for more than 29 total spaces. Also there should be an operational state ent which will limit vessel length to 24', will not allow for boats with cabins and/or man e sanitation devices (heads). Submitted by: C.
