On February 6, 199Q, the DA and the U.S. Environmental Protection Agency (EPA) signed a memoran um of agreement (MOA) establishing procedures to determine the type and level of mitigation necessary to comply with the Clean Water Act Section 404(:))(1) Guidelines. This MOA provides for first, avoiding impacts to waters and etlands through the selection of the least damaging, practical alternative; second, taking appropriate and practical steps to minimize impacts on wa ers and wetlands; and finally, compensating for any remaining unavoidable 'mpacts to the extent appropriate and practical. PROJECT SUMMARY: The applicant proposes to maintenance excavate a man-made boat basin, bulkhead and fill a portion of an existing boat basin and construct a pier. FIELD INVESTIGATION REPORT: ROBERT SAIEED, ONSLOW COUNTY PAGE #2 9. NARRATIVE DESCRIPTION: The applicant's property is an approx. 1.8 ac. tract of land located at 216 Peninsula Manor Drive (SR1546) and adjacent to the AIWW between Queens and Browns Creek in Onslow County. The highground portion of the property consists of a grassed lawn area and a single-family residence has been constructed on the property. Many years ago, a boat basin was excavated into the applicant's high ground property. Over the years, the basin has partially filled in to a point where the head of the basin is unusable. A portion of the shoreline adjoining the basin and the AIWW has been bulkheaded. A dock has been also been constructed in the basin and along the AIWW. Waters in the area are classified as 'SA', ORW and are open to the harvesting of shellfish. The applicant proposes to bulkhead an approx 50' long x 35' wide portion of the boat basin which would be waterward of the MHW line. Additionally, an approx 75' long section of basin shoreline would be bulkheaded a maximum distance of 5' waterward of the M1 4W line. A portion of the boat basin (approx. 125'long x 25' wide) would be excavated to a -3'MLW depth. Spoils from the excavation would be used as backfill for the proposed bulkheads with any excess material being trucked-off the site. The applicant also proposes to extend an approx. 30' long x 6' wide dock within the basin area. 10. ANTICIPATED IMPACTS: The project as proposed would result in the filling in of approx. 1,750 sq. ft. of shallow bottom area at the head of a man-made boat basin with approx. 64 cu. yds. of material being placed below the MHW line. The proposed bulkhead along the basin shoreline would result in approx. 225 sq. ft. of shallow bottom area being filled-in with approx. 8 cu. yds. of material. An area of shallow bottom area measuring approximately 3125 sq.ft. would be excavated to a depth of -3' MLW deep. Approx 230 cu. yds. of mostly mud and silt substrate would be excavated and used as backfill material for the proposed bulkheads or will be trucked-off the site. No coastal wetlands or vegetated '404' wetlands would be impacted from the excavation and/or fill process. The proposed pier would be located over approx. 180 sq. ft. of estuarine waters. NARRATIVE DESCRIPTION: The applicant's property is an approx. 1.8 ac. tract of land located at 216 Peninsula Manor Drive (SR1546) and adjacent to the AIWW between Queens and Browns Creek in Onslow County. The highground portion of the property consists of a grassed lawn area and a single-family residence has been constructed on the property. Many years ago, a boat basin was excavated into the applicant's high ground property. Over the years, the basin has partially filled in to a point where the head of the basin is unusable. A portion of the shoreline adjoining the basin and the AIWW has been bulkheaded. A dock has been also been constructed in the basin and along the AIWW. Waters in the area are classified as 'SA', ORW and are open to the harvesting of shellfish. The applicant proposes to bulkhead an approx 50' long x 35' wide portion of the boat basin which would be waterward of the MHW line. Additionally, an approx 75' long section of basin shoreline would be bulkheaded a maximum distance of 5' waterward of the MHW line. A portion of the boat basin (approx. 125'long x 25' wide) would be excavated to a -3'MLW depth. Spoils from the excavation would be used as backfill for the proposed bulkheads with any excess material being trucked-off the site. The applicant also proposes to extend an approx. 30' long x 6' wide dock within the basin area. 10. ANTICIPATED IMPACTS: The project as proposed would result in the filling in of approx. 1,750 sq. ft. of shallow bottom area at the head of a man-made boat basin with approx. 64 cu. yds. of material being placed below the MHW line. The proposed bulkhead along the basin shoreline would result in approx. 225 sq. ft. of shallow bottom area being filled-in with approx. 8 cu. yds. of material. An area of shallow bottom area measuring approximately 3125 sq.ft. would be excavated to a depth of -3' MLW deep. Approx 230 cu. yds. of mostly mud and silt substrate would be excavated and used as backfill material for the proposed bulkheads or will be trucked-off the site. NARRATIVE DESCRIPTION: The applicant's property is an approx. 1.8 ac. tract of land located at 216 Peninsula Manor Drive (SR1546) and adjacent to the AIWW between Queens and Browns Creek in Onslow County. The highground portion of the property consists of a grassed lawn area and a single-family residence has been constructed on the property. Many years ago, a boat basin was excavated into the applicant's high ground property. Over the years, the basin has partially filled in to a point where the head of the basin is unusable. A portion of the shoreline adjoining the basin and the AIWW has been bulkheaded. A dock has been also been constructed in the basin and along the AIWW. Waters in the area are classified as 'SA', ORW and are open to the harvesting of shellfish. The applicant proposes to bulkhead an approx 50' long x 35' wide portion of the boat basin which would be waterward of the MHW line. Additionally, an approx 75' long section of basin shoreline would be bulkheaded a maximum distance of 5' waterward of the MHW line. A portion of the boat basin (approx. 125'long x 25' wide) would be excavated to a -3'MLW depth. Spoils from the excavation would be used as backfill for the proposed bulkheads with any excess material being trucked-off the site. The applicant also proposes to extend an approx. 30' long x 6' wide dock within the basin area. 10. ANTICIPATED IMPACTS: The project as proposed would result in the filling in of approx. 1,750 sq. ft. of shallow bottom area at the head of a man-made boat basin with approx. 64 cu. yds. of material being placed below the MHW line. The proposed bulkhead along the basin shoreline would result in approx. 225 sq. ft. of shallow bottom area being filled-in with approx. 8 cu. yds. of material. An area of shallow bottom area measuring approximately 3125 sq.ft. would be excavated to a depth of -3' MLW deep. Approx 230 cu. yds. of mostly mud and silt substrate would be excavated and used as backfill material for the proposed bulkheads or will be trucked-off the site. No coastal wetlands or vegetated '404' wetlands would be impacted from the excavation and/or fill process. The proposed pier would be located over approx. 180 sq. ft. of estuarine waters.
