Upon review of your request for 401 Water Quality Certification
to place fill material in 200 square feet of wetlands or waters which
are tributary to Hewlett Creek for lot fill underneath home located at
201 Quail Ridge Road in New Hanover County as described in your
submittal dated 12 October 1993, we have determined that the proposed
fill can be covered by General Water Quality Certification No. 2733.
A copy of the General Certification is attached. This Certification
may be used in qualifying for coverage under Corps of Engineers'
Nationwide Permit No. 18.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

Dear Mr. Vigus:
Reference your application of June 14, 1993, for Department of the Army
(DA) authorization to place fill material into wetlands adjacent to Hewletts
Creek to construct an access road no greater than 200 feet in length and
impacting less than 1/3 acre of wetlands and to fill 2,250 square feet of
wetlands to construct a single family residence at your property located at
201 Quail Ridge Road in Wilmington, New Hanover County, North Carolina.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization,
pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404
of the Clean Water Act, was provided for fills for roads crossing waters of
the United States (including wetlands and other special aquatic sites)
provided:
a. The width of the fill is limited to the minimum necessary for the
actual crossing;
b. The fill placed in waters of the United States is limited to a filled
area of no more than one-third acre. Furthermore, no more than a total of 200
linear feet of the fill for the roadway can occur in special aquatic sites,
including wetlands;
C. The crossing is culverted, bridged or otherwise designed to prevent
the restriction of, and to withstand, expected highflows and the movement of
aquatic organisms;
d. The crossing, including all attendant features, both temporary and
permanent, is part of a single and complete project for crossing of a water of
the United States; and
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization,
pursuant to Section 10 of the Rivers and Harbors Act and Section 404 of the

b. The discharge will not cause the loss of more than 1/10 acre of a

sites that are adversely affected by flooding and special aquatic sites that
are drained so that they would no longer be a water of the United States as a
result of the project;

Your work is authorized by these nationwide permits provided it is
accomplished in strict accordance with the enclosed conditions and provided
you receive a Section 401 water quality certification from the North Carolina
Division of Environmental Management (NCDEM). You should contact Mr. John
Dorney, telephone (919) 733-1786, regarding water quality certification. In
the coastal area, a consistency determination should be obtained from the
North Carolina Division of Coastal Management (NCDCM). Please call Mr. Steve
Benton, telephone (919) 733-2293, regarding this determination. This
nationwide permit does not relieve you of the responsibility to obtain other
required State or local approval.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.

The North Carolina Division of Coastal Management has reviewed the above-referenced revised application for a
Nationwide Permit dated October 11, 1993 pursuant to Section 307 of the Coastal Zone Management Act of 1972
as amended. Based upon our review, we have determined that the proposed activity is consistent with the North
Carolina Coastal Management Program provided the following conditions are met:
1. The activity described in the above referenced application qualifies to receive one of the Nationwide
Permits described in 33 CFR Part 330 with the exception of Numbers 17, 21, 24, and 34 which
were found inconsistent with the North Carolina Coastal Management Program.
2. A 401 Water Quality Certification is received, where required, from the North Carolina Division
of Environmental Management.
Any and all filling of 404 wetlands within an Area of Environmental Concern requires a Major CAMA
Permit from the Division of Coastal Management. The area you propose to fill is extremely close to the 75'
AEC bordering the estuarine shoreline. Care must be exercised during the grading/filling process to ensure
that wetlands within the AEC are not filled. It is recommended that a silt fence be installed along the 75'
AEC line to prevent washing of fill material into the wetlands or inadvertent land disturbance outside of the
200 square feet being requested. Attached is a detail illustrating how this fence should be installed. After
installation, please call me for an inspection.

The applicant is proposing to fill approximately 2,250 sq.
ft. of cypress/gum swamp adjacent to the "SA" surface waters of
Hewletts Creek in order to provide a level home site and yard.
Also proposed is the filling of an undetermined amount of
wetlands for driveway access.
A field investigation was conducted on June 23, 1993, along
with Tere Barrett (DCM). The majority of the property appeared
to be section 404 wetlands. The applicant has failed to provide
a wetland delineation map showing all wetlands on the property
per 17A. The applicant has also failed to provide sufficient
information to show that wetland impacts have been avoided. Due
to the high value of the wetlands on this property (see attached
rating sheet), wetland impacts associated with the house and yard
should be completely avoided. The applicant should provide
information to show that wetland impacts associated with the
driveway access_have?een minimized. This Office can not provide
comments c cerning impact'-m' mization unless the applicant
provides a ?tland delineation ma r the entire property. If

recommend that the project be denied.

The Division of Environmental Management, Water Quality
Section has reviewed your plans for wetland fill for 0.06 acres
of wetlands at 201 Quail Ridge Road in Wilmington in New Hanover
County for residential lot fill. Based on this review, we have
identified significant uses which would be removed by this
project. These uses are pollutant removal, streambank
stabilization, water storage, wildlife habitat and aquatic life
habitat. Furthermore, insufficient evidence is present in our
files to conclude that your project must be built in wetlands.
Therefore, we are moving toward denial of your 401 Certification.
Until we receive additional information, we are requesting (by
copy of this letter) that the U.S. Army Corps of Engineers and/or
the N.C. Division of Coastal Management place your project on
administrative hold.
Please provide us with information supporting your position
that your project must be constructed as planned. Specifically
can you construct your residential lot on nearby uplands or prior
converted farmland? Any documentation such as maps and narrative
which you can supply to address upland alternatives may be
helpful in our review of your 401 Certification. Please respond
within two weeks of the date of this letter.

Permit dated June 10, 1993 pursuant to Section 307 of the Coastal Zone Management Act of 1972 as amended.

Management Program provided the following conditions are met:
