DEM has no objections to the abovementioned project as long
as the following conditions are adhered to:
1. Any maintenance activity on boats must be within a
confined area. If motor repair work is done, the repair work
must be wither performed inside of a building or an oil/water
separator must be within a bermed area to hold any oil washed
onto surface by rainwater.
2. If any sandblasting, scraping or painting of boats is
proposed, this must also be contained within a building or
curtain to prevent discharges into waters of the state.

9. NARRATIVE DESCRIPTION: The applicant's property is Lot #12 and two (2)
tracts reserved by the developer in Silver Acres Subdivision located off SR1327,
between Broad Creek and Coffee Creek, in Whortonsville, Pamlico County. The
applicant has constructed a pier into Coffee Creek, off of Lot #12, and is currently
completing construction of his house on the lot.
The applicant's proposed project, named Broad Creek Boat Yard, is to construct 2
travel lift tracts approximately 75' long x 4' wide. Water depths at the waterward end
of the lift are -4.5 NLW. The applicant proposes the travel lift extend out to the one-
third line on Coffee Creek. The proposed travel lift area (Reserved Area #2-4,931 sq.
ft.) is located on a 30' wide reserved strip between Lots #12 and #13. This strip will
provide access from the cul-de-sac of Silver Acres Drive down to Coffee Creek. The
applicant proposes to remove boats from the water with the travel lift and transport
them to Reserve Area #4 via Silver Acres Drive. Within Reserve Area #4 is a 2 acre
site which is the proposed boat yard. This boat yard area is located within the
subdivision but is outside of any AECs.
10. ANTICIPATED IMPACTS: The applicant's proposed project will occupy
approximately 2,100 sq. ft. of Public Trust Waters in Coffee Creek and will disturb
approximately 90,000 sq. ft. of highground in the subdivision. Coffee Creek is
designated as a Primary Nursery Area by the Division of Marine Fisheries, closed to
shellfishing by the Divisions of Marine Fisheries and Environmental Health, and is
classified 'SA' by the Division of Environmental Management.

8 ADDITIONAL INFORMATION
In addition to the completed application form, the follow-
ing items must be submitted:
A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to carry out
the project.
An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources
Commission Rule 7J.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers, landmarks, and
the like.

SUBJECT: CAMA\dredge & fill permit application for Fran
Law, off SR1327, Lot 12 in Silver Acres S/D,
Coffee Creek, Whortonsville, Pamlico County, North
Carolina.
We have reviewed the subject application and biologists
on our staff are familiar with habitat values of the project
area. A site visit was made on April 26, 1993 to assess
impacts to fish and wildlife resources. Our comments are
provided in accordance with provisions of the Coastal Area
Management Act (G.S. 113A-100 through 113A-128; 15NCAC7) and
the Fish and Wildlife Coordination Act (48 Stat. 401, as
amended; 16 U.S.C. 661 et seq.).
The applicant, Fran Law, proposes to construct a boat
travel lift and boat repair yard. The travel lift is to be
constructed on Coffee Creek. The two travel lift tracks are
to extend 4 ft. wide by 75 ft. long into a small bay near
the mouth of the creek. Water depth at the far end of the
lift would be 4.5 ft. NLW. The bottom in the project area
is sand/silt. Aquatic vegetation (widgeon grass) was
present at the time of inspection and appeared to be
healthy. In addition to providing nursery habitat for fin
and shellfish, widgeon grass provides high quality waterfowl
food. Coffee Creek is classified 'SA', is closed to
shellfishing, and is a Primary Nursery Area.
In our opinion, increased boat traffic associated with
the travel lift would adversely impact approximately 2,100
sq. ft. of Primary Nursery Area bottom. Widgeon grass in
the project area would likely be destroyed and silty bottom
substrates suspended, creating higher turbidities within the
lower portion of the creek. Use of the area by fish and

wildlife could decline. We therefore find the project
inconsistent with our Policies and Guidelines for
Conservation of Wetlands and Aquatic Habitats and recommend
that a permit not be issued. Suitable sites for a boat
travel lift may exist on nearby Broad Creek. Broad Creek is
not a Primary Nursery Area.

8 ADDITIONAL INFORMATION
In addition to the completed application form, the follow-
ing items must be submitted:
A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written pennission from the owner to carry out
the project.
An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources
Commission Rule 7J.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to -iide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers, landmarks, and
the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
