On 2 March 1993 you wrote to the Division of Environmental
Management requesting a 401 Water Quality Certification for your
project to construct a house and driveway at Lot 20, Block 13 old
Settler's Beach in Onslow County. We have been informed by the N.C.
Division of Coastal Management that this project will require a Permit
from the N.C. Division of Coastal Management We cannot continue to
process your application until the Division of Coastal Management
(DCM) begins the permitting process. Therefore I must hereby place
this project on indefinite hold until you and the Division of Coastal
Management gather the necessary information to develop an acceptable
DCM permit application. Also by copy of this letter, I am also
notifying the U.S. Army Corps of Engineers that this project will need
processing by the Division of Coastal Management.
If you believe that this decision is in error, please call me at
919-733-1786 to discuss the matter.

Dear Mr. Adams:
The Federal review has been completed for your proposal to discharge 0.03
acre of fill material into wetlands adjacent to Stump Sound on your property
located on 231'4:1 Street in North Topsail Beach, ozi•SlOw Go rrityf North Carolina.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization, pursuant to Section 10 of the Rivers and Harbors Act and
Section 404 of the Clear, rater Act, was provided for discharges of dredged or
fill material into all waters of the United States provided:
a. The discharge does not exceed 25 cubic _vards;
b. The discharge sjill not cause the loss of more than 1/10 acre of a
special aquatic sica, including -,etlands. For the purposes of this nationwide
permit, the acreage iimication includes the filled area plus special aquatic
sites that are adversely affected by flooding and special aquatic sites that
are drained so that they would no longer be a water of the United States as a
result of the project;
C. The ii_ch?rga, includiny all atcendant features, both temporary and
permanent, is part of a single and complete project and is not placed for the
purpose of atra_.:T: diversion.
