Reference the application of Mr. Albert L. Schomp, III, for Department of
the Army authorization to construct and backfill a bulkhead and fill wetlands
on Greenville Sound, the Atlantic Intracoastal Waterway (AIWW), Turtle Hall
Subdivision, Wilmington, l$. Hanover County, North Carolina.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. All work authorized by this permit must be performed in strict
compliance with the permit plans.
b. The bulkhead will be positioned in strict accordance with permit
plans. To prevent an unintentional violation of this authorization,
representatives of the North Carolina Division of Coastal Managment and the
Corps of Engineers will be available to stake the alignment prior to
construction.
c. All backfill materials will be obtained from a highground source and
confined landward of the permitted bulkhead.
d. The fill material will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials, or unsightly debris will
not be used.
e. The permittee will maintain the authorized work in good condition and
in conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transferred to a third party.
f. The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or
construction-related discharge. Increases such that the turbidity in the
waterbody is 25 NTU's or less are not considered significant.

Reference your application for a Department of the Army permit to
construct and backfill a bulkhead and fill approximately 0.04 acre of wetlands
on Greenville Sound, the Atlantic Intracoastal Waterway (AIWW), Turtle Hall
Subdivision, Wilmington,,-New Hanover County, North Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of general permit No. CESAW-C080-N-000-0291.
Therefore, you may commence construction activity in strict accordance with
applicable State authorization and the enclosed plan. Failure to comply with
the State authorization or conditions of the general permit could result in
civil and/or administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization modified.

Upon review of your request for 401 Water Quality
Certification to place fill material in 1604 square feet of
wetlands or waters which are tributary to AIWW for bulk head
construction located at Lot 16, Turtle Hall Subdivision in New
Hanover County, we have determined that the proposed fill can be
covered by General Water Quality Certification No. 2665 issued
January 21,. 1992. A copy of the General Certification is
attached. This Certification maybe used in qualifying for
coverage under Corps.of Engineers' Nationwide Permit No. 13.

9. PROTECT DESCRIPTION
The project is located in the Turtle Hall subdivision at lot 16. This is a subdivision located
adjacent to Greenville Sound off of S. R. 1421 in New Hanover County. The lot is vacant,
and is approximately .65 acres in size. There are upland grasses on the lot, as well as
delineated federal wetlands, and coastal marsh.
The area is classified as Conservation by New Hanover County. The waters are classified as
SA by the Division of Environmental Management (just north of the ORW designation). The
Division of Marine Fisheries has implemented a temporary shellfish closure in the area as
determined by Shellfish Sanitation. This is a designated Primary Nursery Area.
The applicant has stated that the lot is unbuildable by subdivision covenant if he cannot fill
the wetland area. Turtle Hall has a minimum structure size, and restrictive setbacks. The
value of the lot is severely reduced without the ability to fill this low area. The entire
subdivision was filled by the developer originally. The applicant's lot was filled for the front
part only.
The property drops quickly for about 3' in elevation. This area was delineated by Jeff
Richter of the USA COE approximately 6 months ago. The surveyor has re-established this
line, but Mr. Richter has not yet had the opportunity to confirm it. The flagged alignment
was established from the survey of the alignment defined by Mr. Richter originally, and
appears to be consistent with the survey. If confirmation proves the alignment to be
different, this report will be modified.
The applicant is proposing to construct a bulkhead extending for approximately 75' beginning
at the landward edge of the community walkway, and running in a northeasterly direction
until it connects to the existing high ground. The wetlands present waterward of the proposed
bulkhead are mixed coastal species - SSpartina ap tens, Juncus roemerianus, and also Iva
frutescens. These wetlands transition to a continual stand of Spartina alterniflora. There is a
high ground berm at the landward side of this marsh area that is approximately 75' x 10'.
The wetlands landward of the proposed bulkhead are cut off from connection to the coastal
marsh by this berm along all but the northeastern corner.
Construction of the proposed bulkhead would cause to be filled approximately 868 square
feet of relatively inactive SSpartina patens. There_ are no crab holes or wrack lines, and the
only connection is approximately 20' in length, and allows only extreme tides to enter the
area. It is my opinion that this area supports wetland vegetation because of the proximity to
the water table rather than a surface connection.

Outside of the coastal marsh in the project area, there is an area that, prior to clearing,
supported various transitional shrub species (Wax Myrtle, Cedar, Holly, Marsh Elder). This
is the area that has been delineated and determined to be "404" wetlands. It has not,
however, been re-confirmed within the past 6 months. This area is approximately 736
square feet.
Outside of the wetland areas, the bulkhead aligned as proposed would cause to be filled
approximately 26,710 square feet of high ground. The applicant is anticipating the need for
approximately 171 cubic yards of fill material.
The purpose of the bulkhead is to gain high ground to make the lot more valuable, and
buildable by subdivision covenant. There is no residence planned at this time.
10. ANTICIPATED IMPACTS
The bulkhead will require the filling of approximately 868 square feet of relatively isolated
and somewhat inactive coastal marsh. The project will require the filling of approximately
736 square feet of federal wetlands, and approximately 26,710 square feet of high ground.

Dear Mr. Schomp:
Through coordination with the North Carolina Division of Coastal
Management, we have learned of the modification of your State permit which
authorizes the construction and backfill of a bulkhead on Greenville Sound,
the Atlantic Intracoastal Waterway (AIWW), Turtle Hall Subdivision,
Wilmington, New. Hanover County, North Carolina. The modification provides for
extension of the bulkhead on highground, to the west and north, to assure
retention of fill material. No waters or addtional wetlands are to be filled.
Your revised proposal has been reviewed and is consistent with the
provisions and objectives of general permit No. CESAW-CO80-N-000-0291.
Therefore, you may continue construction activity in strict accordance with
the modified State authorization. Failure to comply with the State
authorization or conditions of the general permit could result in civil and/or
administrative penalties.
If any further change in your work is required because of unforeseen or
altered conditions or for any other reason, plans revised to show the change
must be sent promptly to this office and the North Carolina Division of
Coastal Management prior to performing any such change or alteration. Such
action is necessary as revised plans must be reviewed and the authorization
modified.

On February 11, 1991, we renewed general permit No. CESAW-CO80-N-000-0291
(copy enclosed), which provides Federal authorization for construction
activities that receive authorization from the State of North Carolina.
A review of your application received March 4, 1993, for Department of the
Army authorization to construct and backfill a bulkhead and fill wetlands on
Greenville Sound, the Atlantic Intracoastal Waterway (AIWW), Turtle Hall
Subdivision, Wilmington, New Hanover County, North Carolina, indicates it to
be a candidate for Federal authorization under this general permit.
Accordingly, the administrative processing of your application will be
accomplished uy the North Carolina Division of Coastal Management. Comments
from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit process for
any reason, you will be informed regarding its further management. If there
are no unresolved differences in State-Federal positions or policies, the
final action taken on your application by the state will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and Harbor Act and
Section 404 of the Clean Water Act, has been assigned Action ID No. 199201994

of the Army authorization and a State Water Quality Certification to construct

Intracoastal Waterway (AIWW), Turtle Hall Subdivision, Wilmington, New Hanover
County, North Carolina. Your receipt of this letter verifies your acceptance
of a valid request for certification in accordance with Section 325.2(b)(ii)
of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days
after receipt of a request for certification is a reasonable time for State
action. Therefore, if you have not acted on the request, or asked for an
extension of time, by May 10, 1993, the District Engineer will deem that
waiver has occurred.

sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources
Commission Rule 7J.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line 2,p
prints or other larger plats are acceptable only if it high
quality copies are provided by applicant (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers, landmarks, and
the like.
A stormwater management plan, if applicable, that
in ay have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These

8. PROJECT SUMMARY: Applicant proposes to construct a 75' bulkhead on his vacant lot,
requiring the filling of 868 square feet of coastal marsh, and another 736 square feet
previously of delineated "404" wetlands:

9. PROJECT DESCRIPTION
The project is located in the Turtle Hall subdivision at lot 16. This is a subdivision located
adjacent to Greenville Sound off of S. R. 1421 in New Hanover County. The lot is vacant,
and is approximately .65 acres in size. There are upland grasses on the lot, as well as
delineated federal wetlands, and coastal marsh.
The area is classified as Conservation by New Hanover County. The waters are classified as
SA by the Division of Environmental Management (just north of the ORW designation). The
Division of Marine Fisheries has implemented a temporary shellfish closure in the area as
determined by Shellfish Sanitation. This is a designated Primary Nursery Area.
The applicant has stated that the lot 'is unbuildable by subdivision covenant if he cannot fill
the wetland area. Turtle Hall has a minimum structure size, and restrictive setbacks. The
value of the lot is severely reduced without the ability to fill this low area. The entire
subdivision was filled by the developer originally. The applicant's lot was filled for the front
part only.
The property drops quickly for about 3' in elevation. This area was delineated by Jeff
Richter of the USA COE approximately 6 months ago. The surveyor has re-established this
line, but Mr. Richter has not yet had the opportunity to confirm it. The flagged alignment
was established from the survey of the alignment defined by Mr. Richter originally, and
appears to be consistent with the survey. If confirmation proves the alignment to be
different, this report will be modified.
The applicant is proposing to construct a bulkhead. extending for approximately 75' beginning
at the landward edge of the community walkway, and running in a northeasterly direction
until it connects to the existing high ground. The wetlands present waterward of the proposed
bulkhead are mixed coastal species - S rtina paten s, Juncus roemerianus, and also Iva
frutescens. These wetlands transition to a continual stand of Spartina alterniflora. There is a
high ground berm at the landward side of this marsh area that is approximately 75' x 10'.
The wetlands landward of the proposed bulkhead are cut off from connection to the coastal
marsh by this berm along all but the northeastern corner.
Construction of the proposed bulkhead would cause to be filled approximately 868 square
feet of relatively inactive Spartina patens. There are no crab holes or wrack lines, and the
only connection is approximately 20' in length, and allows only extreme tides to enter the
area. It is my opinion that this area supports wetland vegetation because of the proximity to
the water table rather than a surface connection.

Outside of the coastal marsh in the project area, there is an area that, prior to clearing,
supported various transitional shrub species (Wax Myrtle, Cedar, Holly, Marsh Elder). This
is the area. that has been delineated and determined to be "404" wetlands. It has not,
however, been re-confirmed within the past 6 months. This area is approximately 736
square feet.
Outside of the wetland areas, the bulkhead aligned as proposed would cause to be filled
approximately 26,710 square feet of high ground. The applicant is anticipating the need for
approximately 171 cubic yards of fill material.
The purpose of the bulkhead is to gain high ground to make the lot more valuable, and
buildable by subdivision covenant. There is no residence planned at this time.
10. ANTICIPATED IMPACTS
The bulkhead will require the filling of approximately 868 square feet of relatively isolated
and somewhat inactive coastal marsh. The project will require the filling of approximately
736 square feet of federal wetlands, and approximately 26,710 square feet of high ground.
