Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the stream is 25 NTU's or less are not considered significant). Violations of any condition herein set forth shall result in revocation of this Certification. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. All work authorized by this permit must be performed in strict compliance with the permit plans. b. In order to avoid periods of high biological activity, no excavation or beach nourishment will be permitted between the dates of April 1 and September 30 of any year without the prior approval of the North Carolina Division of Coastal Management. C. No vegetated wetlands will be excavated or filled. d. Excavation will not exceed eight (8) feet below the elevation of normal water. e. Dredge effluent runoff will be controlled by a silt screen barrier erected waterward of the beach area to be renourished and landward of the normal water elevation contour. f. PROJECT SUMMARY: The applicant proposes to maintain a 400' x 50' entrance channel and use the 1850 cubic yards of dredge spoil material for beach nourishment. w FIELD INVESTIGATION REPORT: N innesott Beach Yacht Basin, Pamlico County PAGE #2 9. NARRATIVE DESCRIPTION: The applicant's property; known as Minnesott Beach Yacht Basin is located off the Neuse River on Alligator Gut in Minnesott Beach, Pamlico County. Several permits have been issued for various projects at this site including CAMA Majors, #114-73, #19-82 and #109-84. Permit #109-84 is still current for maintenance. The applicant's proposed project is to perform maintenance dredging on a 400' x 25' x -8' portion of the entrance channel in the Neuse River which leads into the marina channel. Existing water depths in the project area range from 0 to -8' NWL. The maintenance dredging has been previously authorized under a current permit(#109-84) with a diked highground spoil area. The applicant proposes to perform the maintenance dredging with a hydraulic dredge and pump the spoils onto an 800' x 30' area of dry sand beach along the shoreline of the Minnesott Beach Golf and Country Club. The applicant's project is thus twofold ; maintenance dredging and beach nourishment. The shoreline along the project site is eroding at approximately 2'-3' per year(SCS-USDA). The proposed spoil disposal method is to spray the dredged material onto the open beach with a perforated diffuser attached to the end of the dredge pipeline. The applicant proposes to uniformly spray the sandy dredge spoil on the open beach above the Normal Water Level. The applicant is not proposing to construct a diked highground spoil disposal as traditionally utilized in hydraulic dredging operations. The applicant proposes to control dredge effluent runoff by erecting a silt screen barrier waterward of the spoil area. A sieve analysis of the dredge material has been conducted by an engineering firm for the applicant and is included in this permit application package. 10. ANTICIPATED IMPACTS: The proposed maintenance dredging will require the removal of approximately 1,850 cubic yards of fine to coarse sand material from approximately 10,000 square feet of previously dredged river bottom. The spoil will be pumped to a 24,000 square foot area of dry sand beach along the Neuse River shoreline at the Minnesott Beach Golf and Country Club. The waters of the Neuse River are classified as 'SB' by the Division of Environmental Management and are closed to shellfishing by the Division of Environmental Health and the Division of Marine Fisheries. The proposed spoil disposal method is not considered a conventional method and there is a potential for violation of water quality standards. The proposed project is not consistent with NCAC 7H.0208(b)(8)(C): "Placing unconfined sand material in the J FIELD INVESTIGATION REPORT: Minnesott Beach Yacht Basin, Pamlico County PAGE #3 water and along the shoreline will not be allowed as a method of shoreline erosion control." NCAC 7H.0208(b)(8)(E) states that " Material from dredging projects can be used for beach nourishment if. (i) it is first handled in a manner consistent with regulations governing spoil disposal; (ii) it is allowed to dry for a suitable period. ....Material shall not be placed directly on the beach by dredge or dragline during maintenance excavation. FIELD INVESTIGATION REPORT: Minnesott Beach Yacht Basin, Pamlico County PAGE #2 9. NARRATIVE DESCRIPTION: The applicant's property, known as Minnesott Beach Yacht Basin is located off the Neuse River on' Alligator Gut in Minnesott Beach, Pamlico County. Several permits have been issued for various projects at this site including CAMA Majors, #114-73, #19-82 and #109-84. Permit #109-84 is still current for maintenance. The applicant's proposed project is to perform maintenance dredging on a 400' x 25' x -8' portion of the entrance channel in the Neuse River which leads into the marina channel. Existing water depths in the project area range from 0 to -8' NWL. The maintenance dredging has been previously authorized under a current permit(#109-84) with a diked highground spoil area. The applicant proposes to perform the maintenance dredging with a hydraulic dredge and pump the spoils onto an 800' x 30' area of dry sand beach along the shoreline of the Minnesott Beach Golf and Country Club. The applicant's project is thus twofold ; maintenance dredging and beach nourishment. The shoreline along the project site is eroding at approximately 2'-3' per year(SCS-USDA). The proposed spoil disposal method is to spray the dredged material onto the open beach with a perforated diffuser attt????y-1 -to: the end of 6,:-e d.`_:dge pipeiire. The applicant proposes to uniformly spray the sandy dredge spoil on the open beach above the Normal Water Level. The applicant is not proposing to construct a diked highground spoil disposal as traditionally utilized in hydraulic dredging operations. The applicant proposes to control dredge effluent runoff by erecting a silt screen barrier waterward of the spoil area. A sieve analysis of the dredge material has been conducted by an engineering firm for the applicant and is included in this permit application package. 10. ANTICIPATED IMPACTS: The proposed maintenance dredging will require the removal of approximately 1,850 cubic yards of fine to coarse sand material from approximately 10,000 square feet of previously dredged river bottom. The spoil will be pumped to a 24,000 square foot area of dry sand beach along the Neuse River shoreline at the Minnesott Beach Golf and Country Club. The waters of the Neuse River are classified as 'SB' by the Division of Environmental Management and are closed to shellfishing by the Division of Environmental Health and the Division of Marine Fisheries. The proposed spoil disposal method is not considered a conventional method and there is a potential for violation of water quality standards. The proposed project is not consistent with NCAC 7H.0208(b)(8)(C): "Placing unconfined sand material in the FIELD INVESTIGATION REPORT: Minnesott Beach Yacht Basin, Pamlico County PAGE #3 water and along the shoreline will not be allowed as a method of shoreline erosion control." M m N m m N a NI r -4 N N m m CAA n r D In nn V NOTICE OF FILING OF D APPLICATION FOR CAMA MAJOR DEVELO T' PERMIT AND WATER QUALITY CERTIFICA The Department of Environment, Health and Natural Resources hereby gives public notice as required by NCGS 113A-119(b) and 1437215 3(a)(1)(c) that Minnesott Beach Yacht Basin of Pamlico County, filed an application on January 4, 1993, for a permit from the Division of Coastal Management to develop in an Area of Environmental Concern and for certification from the Division of Environmental Management that a discharge of fill material in project wetlands will not violate applicable water quality standards. According to said application, the applicant is proposing to perform maintenance dredging of the entrance channel in the Neuse River which leads into the marina channel on Alligator Gut in Minnesott Beach, Pamlico County. Spoils from the dredging operation are proposed to be pumped onto adjacent beach areas. A copy of the entire application and additional information may be examined (or copies furnished upon request and payment of reproduction costs) during normal business hours at the office of David Noble, Division of Coastal Management, located in the Division of Marine Fisheries Building, Morehead .City, N.C., 919/726-7021, and/or the office of Deborah Sawyer, Division of Environmental Management, DEHNR Regional Field Office, Washington, N.C., 919/946-6481. The Division of Environmental Management proposes to take final action 'on this wa.,-A- quality certification on or before Fec ra:y 29, 1993. The- issuance of the LAMA Major Development permit and the Section 401 Certification may deviate from this projected date depending upon the nature of the comments submitted and subsequent hearings at may ti r i. result.
