TROGDON, III SECRETARY SUBJECT: Permit Modification Request for W-5107 US 70 East of I-95 from SR 2305 (Firetower Rd.) to East of SR 2310 (Davis Mill Rd. — Sevens Chapel Rd.) (SAW-2010-01219 and NCDWR 20140914) Mr.Ridings: NCDOT requests the modification of the above permit in order to install a 60" floodplain pipe at the Quincosin Creek crossing under US 70 in order to reduce upstream flooding. Within this permit request NCDOT is asking for temp stream impacts (134 LF) in order to dewater the site if needed in order to reshape and stabilize this floodplain and stream bank associated with this new floodplain pipe. In addition to these impacts, we are asking for the reapproval or reverification that 2772 SF is covered and mitigated for under the above mentioned permit, that 482 SF needs to be permitted and mitigated for, and finally 6699 SF needs to permitted and will be replanted per the previously submitted replanting plan. REGAN Secretary TIM BAUMGARTNER Director Mr. Chad Coggins Division 4 Environmental Officer North Carolina Department of Transportation Post Office Box 3165 Wilson, North Carolina 27895 Dear Mr. Coggins: NORTH CAROLINA Environmental Quality July 10, 2019 Subject: Mitigation Acceptance Letter: Division 4 Project - TIP W-5107, US 70 Interchange Improvements, Johnston County, WBS No. 41871.3.FS.1 References: USACE 404 Individual Permit issued November 11, 2014 and modification issued July 2, 2015 (USACE Action ID 2010-01219) NCDWR 401 Water Quality Certification issued October 23, 2014 and modification issued June 16, 2015 (NCDWR Project ID 2014-0914) The purpose of this letter is to notify you that the Division of Mitigation Services (DMS) will provide the additional buffer mitigation for the subject project. Based on the information supplied by you on July 8, 2019, the additional buffer impacts are located in CU 03020201 of the Neuse River Basin in the Northern Inner Coastal Plain (NICP) Eco-Region, and are as follows: Table 1- Additional Impacts (feet / acresl Neuse 03020201 Stream Wetlands Buffer (Sq. See permit application for details. DMS will provide the amount of mitigation as determined by the regulatory agencies. This impact and associated mitigation need were under projected by the NCDOT in the 2019 impact data. DMS will commit to implement sufficient compensatory mitigation credits to offset the additional impacts associated with this project as determined by the regulatory agencies using the delivery timeline listed in Section F.3.c.iii of the In -Lieu Fee Instrument dated July 28, 2010. This mitigation acceptance letter replaces the mitigation acceptance letters that were issued on August 19, 2014 and June 9, 2015.
