Richter and Dorney: The purpose of this letter is to request a Nationwide Permit 14 and a section 401 Water Quality Certification for the project to be known as The Country Club of North Carolina Executive Course. The project is near Southern Pines, NC (Moore County). It is located about 3/4 mile west of the intersection of Highways 1 and 15-501 as shown on the enclosed plans and vicinity map. An approximate wetland delineation is shown on the attached map. Wetland delineations of the entire site were reviewed by Mr. Jeff Richter of the U.S. Army Corps of Engineers. Please note that wetlands have not been surveyed, so the wetland map is approximate. Since wetland impacts will only occur at two road crossings, our client hopes to minimize expenses by foregoing survey costs until the entire project is approved. Please contact us if this is not acceptable for the time being. Once the client has some assurance that unforeseen circumstances will not deter the project, they fully intend to survey the wetlands an apply for any other permits that may be needed for the project. The client realizes that there is no guarantee that any other approvals will be granted. Fill in the wetlands will be required for road crossings, to begin work on a proposed residential development and golf course (see attached map). Available uplands have been utilized as much as possible, and road crossings are perpendicular to the wetlands that wetland fills have been minimized. It will be necessary to impact approximately .20 acres (see map) of jurisdictional wetlands above headwaters for placement of the proposed facilities. To expedite the permitting process and to ease the process for everyone involved, the following individuals/agencies have been provided with a complete copy of this entire application package: David Franklin (Wilmington Corps) and Ken Averette (DEM Fayetteville Regional office), N.C. Cultural Resources, USF&WS, so Soil/Site Evaluation ¦ Mapping and Physical Analysis ¦ Wetlands Mapping and Mitigation ¦ Environmental Audits On-Site Waste Treatment Systems, Evaluation uod Design and National Marine Fisheries Service. Since wetland impacts are restricted to two small road crossings, for now our client wishes to minimize expenses for the time being by foregoing survey costs. our client realizes that if other impacts are to occur, they must first survey wetlands and obtain appropriate Corps and DEM approvals. Since the verification is only valid for two years and the client will not be completed with work by the end of May we request a reauthorization. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for fills for roads crossing waters of the United States (including wetlands and other special aquatic sites) provided: a. The width of the fill is limited to the minimum necessary for the actual crossing; b. The fill placed in waters of the United States is limited to a filled area of no more than one-third acre. Furthermore, no more than a total of 200 linear feet of the fill for the roadway can occur in special aquatic sites, including wetlands; C. The crossing is culverted, bridged or otherwise designed to prevent the restriction of, and to withstand, expected highflows and the movement of aquatic organisms; d. The crossing, including all attendant features, both temporary and permanent, is part of a single and complete project for crossing of a water of the United States; and e. For fills in special aquatic sites, including wetlands, the permittee notifies the District Engineer (DE) in accordance with the "Notification" general condition. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. By letter dated March 7, 1994, from the US Fish and Wildlife Service (USFWS), we understand that the proposed project is likely to jeopardize the federally endangered red-cockaded woodpecker (RCW). A reasonable and prudent alternative has been identified by USFWS and is included as a condition of this nationwide permit authorization. Furthermore, USFWS has developed elements which are to be included in the Country Club of Nort { -2- (CCNC)Ia restrictive covenants for the property. This reasonable and prudent alternative states that; The RCW management plan... shall be incorporated into the CCNC restrictive covenants for the property with the following statement: All property subject to this declarant is hereby declared to be a bird sanctuary for the RCW and the property shall be subject to the terms, conditions, and requirements set forth in that certain RCW Plan dated February 1993 and amended November 1993, for the CCNC located in Pinehurst, North Carolina, and prepared by Soil and Environmental Consultants, Inc. The following elements will be included in the CCNC restrictive covenants for the property. This covenant, as amended, is a condition of this authorization. a. "Red-cockaded woodpecker" shall mean the red-cockaded woodpecker (Picoides borealis) which is an endangered species protected by Federal law. It lives in mature pine forest and requires living pine trees generally 100 years old or older cavity trees which are used for nesting and roosting. b. The architectural committee of the declarant shall ensure compliance with the provision of this article. The responsibilities of the architectural committee shall include, but not be limited to, ensurance of compliance by lot owners with the requirements and restrictions relating to cavity trees and foraging habits as set forth in the management plan described in article VII. The USFWS retains the right to monitor the architectural committee's compliance responsibilities to further ensure that covenant restrictions are being followed. c. All pets shall be kept in confined areas or on leashes. d. No trees having a trunk of 10 inches diameter at breast height (dbh) or more shall be removed or relocated on any lot without prior written approval of the architectural committee. e. No owner shall commit any act which adversely impacts any area of his/her lot that has been designated as "jurisdictional wetland" by the Corps pursuant to Section 404 of the Clean Water Act, as amended, without first obtaining proper authorization from the appropriate state and federal agencies. f. The restrictive covenants for the property should contain a separate article worded as follows: All property subject to this declaration is hereby declared to be a bird sanctuary for the red-cockaded woodpecker and the property shall be subject to the terms, conditions and requirements set forth in that certain red-cockaded woodpecker Management Plan dated February 1993 and amended August 1993 for The Country Club of North Carolina located in Pinehurst, North -3- Carolina, and prepared by Soil and Environmental Consultants, Inc., a copy of which plan is attached hereto as Exhibit A and incorporated herein by reference (The Management Plan). As many pines as possible should be left along the lake adjacent to fairway five. These pines should be protected to facilitate those RCWs that would overfly the lake and forage on the tract. We understand, by copy of the USFWS letter, that no other federally threatened or endangered species will be impacted as a result of this proposed work. By copy of a letter dated November 17, 1993, the proposed work has been covered by the North Carolina Division of Environmental Management's general water quality certification No. 2671. This verification will be valid for two years from the date of this letter unless the nationwide authorization is modified, reissued or revoked. Also, this verification will remain valid for the two years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. This Biological opinion satisfies the consultation requirements of Section 7(a)(2) of the Act but does not address requirements of other environmental laws. A this consultation is on file in Field Office. complete administrative record of the Raleigh, North Carolina, PROJECT DESCRIPTION CCNC proposes to develop an Executive Golf Course and Residential Housing Community on a 127-acre tract located in the Sandhills Soil system, Pinehurst, Moore County, North Carolina. The tract is contiguous to the existing CCNC Development (Figure 1). The community will consist of a nine-hole golf course, clubhouse, putting greens, lake, associated roadways/cartways, and two residential areas. The residential areas are separated by waterbodies and consist of 22 lots and 31 lots, respectively. The 22 lots of the residential community in the northern half of the tract range in size from 0.6 acres to 1.8 acres and cover a total of 24.9 acres. The lots of the residential community in the southern half of the tract range in size from 0.4 acres to 0.9 acres (Figure 2). The tract falls within the foraging I-` w ,g sick or injured specimens to ensure effective treatment care, and in handling dead specimens to preserve biological ,materials in the best possible state for later analysis of cause of death. In conjunction with the care of sick or injured endangered species or preservation of biological materials from a dead animal, the finder has the responsibility to ensure that evidence intrinsic to the specimen is not unnecessarily disturbed. If during the course of the action, the amount or extent of the incidental take limit is exceeded, the Federal agency must reinitiate consultation with the Service immediately to avoid violation of Section 9. Operations must be stopped in the interim period between the initiation and completion of the new consultation if it is determined that the impact of the additional taking will cause an irreversible and adverse impact on the species as per Section 402.14(1). REASONABLE AND PRUDENT MEASURES CCNC through project design, has minimized project related loss of foraging habitat from cluster SOPI 61. For this reason, the Service believes there are no reasonable and prudent measures that can be implemented by CCNC that will further minimize the anticipated incidental take. This concludes formal consultation on this action. Reinitiation of the formal consultation is required if (1) the amount or extent of incidental take is exceeded, (2) new information reveals effects of the action that may impact listed species or critical habitat in a manner or to an extent not considered in this Biological Opinion, (3) the action is subsequently modified in a manner that causes an effect to the listed species or critical habitat that was not considered in this opinion, or (4) a new species is listed or critical habitat designated that may be affected by the action.
