A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 13. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. PROTECT DESCRIPTION 10/27/93 The project site is located adjacent to 8124 Bald Eagle Lane in New Hanover County. This is off of Porter's Neck Rd. and Highway 17. Bald Eagle Lane lies parallel to the AIWW extending from Futches Creek south to the Figure 8 Island Bridge. The area is developed with single family residences. Mr. Evans lot is located approximately 1/4 mile south of the Porter's Neck intersection with Bald Eagle Lane. His tract of land is approximately .57 acre in size. There is a single family home on the lot. At the water's edge there is a poured concrete bulkhead that averages 3' in width. Towards the southern edge of the waterfront, there is a 10' x 13' shed located partially over high ground, and partially over a poured concrete deck that lies in the intertidal area. There is a 25' x 6' pier existing. The concrete decking averages 15' in width, extending from about midway under the shed for 15' waterward. This deck stretches approximately 24' to the north of the shed where it joins the bulkhead, and approximately 2' to the south where it joins a boatramp. This existing ramp is approximately 17' in width, and 20' in length. Spartina alterniflora thrives adjacent to the entire lot except that which is covered by concrete. New Hanover County classifies this area Conservation in their Land Use Plan. The area is not a designated Primary Nursery Area, and is open to the taking of shellfish. The waters of Middle Sound are classified SA-ORW by the Division of Environmental Management. The proposal is to construct a 35' bulkhead approximately 1' waterward of the concrete decking. The concrete is cracking as it subsides, and extreme tides come over the structure and through the cracks, undermining the structure. The applicant fears that without protecting the concrete deck, the shed will soon collapse. The shed is referred to as a boathouse in the application; rather, it is a storage shed. The submitted plat shows the high ground protruding around the shed. In actuality, high ground extends about halfway into the shed with the remainder of the building over the concrete decking which extends approximately 15' from mean high water. Aerial photography indicates that in 1984 high ground or high marsh extended beyond the shed. It appears that, although the applicant stated in the application that there is zero erosion per year, there has been a loss of approximately 15' - 20' since 1984. 10. ANTICIPATED IMPACTS -The new impact from this project is the filling of approximately 35 square feet of shallow bottom. The more significant impact would be that of allowing the perpetuation of a non-water dependent structure usurping approximately 455 square feet of non-vegetated wetlands. Submitted by: T. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on an 8 1/2 x 11 white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if 18 high quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.)
