PROJECT SUMMARY: Applicant proposes to provide an 8 slip community docking facility to serve residents of the Pelican Point area. Pete and Terry DeVita Page 2 9. PROTECT DESCRIPTION 11/8/93 Mr. and Ms. DeVita own approximately 2.5 acres of land adjacent to Masonboro Sound at the end of Pelican Point Road in New Hanover County. Pelican Point Road is off of S. R. 1492. The property lies between Whiskey Creek and the Masonboro Boatyard to the north, and the Channel Haven canal to the south. The area is one of single family residences, and rather large riparian lots. The project site averages 7' above mean sea level. There is a residence on site, as well as a community boatramp for the 20+ families along Pelican Point Rd. This ramp lies on the applicant's property, but within an easement dedicated to the property owners. To the north of the ramp is a berm vegetated with Spartina patens and Borrichia frutescens that continues across the neighboring lot, narrowing as it moves north. At the north end of this berm, high water comes around the feature. There is a cove of S artina alterniflora behind the berm lying within these two properties. For the purpose of determining riparian corridors, the applicant used the mean high water established by the berm, as it was only logical for this purpose. The body of water is approximately 870' across at the project site. The New Hanover County Land Use Plan classifies the wetland and water area as Conservation, and the high ground as Resource Protection. The Division of Marine Fisheries has designated this area as Primary Nursery, and the area is closed to the taking of shellfish. The Division of Environmental Management has classified the waters as SA-ORW. The applicant is proposing to construct a community docking system, to ultimately serve the residents of a subdivision that he may develop in the future. Future plans involve subdividing his 2.5 acre parcel into 3-5 lots. If he constructs the pier prior to subdividing his property, he may open the docking system to the Pelican Point Community that has use of the adjoining ramp. The proposed structure consists of a 330' x 6' pier, a 12' x 15' fixed deck, a 76' x 6' float, and four fingers - two at 25' x 4', and two at 14' x 4'. There is a 16' x 16' gazebo proposed over the berm at the landward end of the structure. The applicant represents this as a shell berm, as it appears on aerial photography. However, this berm is now vegetated with S artina patens and Borrichia frutescens. The first 115' of the pier extends over S _ artina alterniflora marsh. The gazebo is positioned over berm approximately 30' from the beginning of the pier. The next 215' of the pier extends over open water. The 12' x 15' deck is at the waterward end of the pier. The 76' x 6' float is perpendicular to the pier, with the four fingers extending waterward. There are three pilings set approximately 15' outside of the structure to either side. There are eight pilings set within the system. All together, the docking system will provide 8 mooring spaces. The docking structure has an outer perimeter of 106' x 31'. The structure extends into open water approximately 260' to reach a water depth of approximately 4' at mean low. The structure is situated 15' from each adjacent riparian corridor, and is approximately 90' from the near edge of the AIWW. 9. PROJECT DESCRIPTION, CONT. The intent of this docking system is to exclusively serve a future development of 3-5 homes. However, the Pelican Point Community is essentially landlocked, and currently has access to water only by the boatramp. It is probable that these property owners will have some use of the structure until the subdivision is built. At this time, there may be slips available to a very few of these homeowners. 10. ANTICIPATED IMPACTS The project as proposed will provide 8 mooring spaces to the people of the Pelican Point Community. The project will shade approximately 690 square feet of Snartina alterniflora marsh. It will incorporate approximately 2238 square feet of open water, and approximately 256 square feet of high marsh. The project meets with the 1/3 rule, is located 15' from adjacent corridors, and >85' from the AIWW. The docking facility will utilize approximately 948 square feet of Public Trust Area, and will in actuality incorporate a footprint of 3286 square feet.. Submitted by: T. If the applicant is not claiming to be the owner of said property, then forward a copy of the deed or other instrument under which the owner claims title, plus written permission from the owner to carry out the project. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on an 8 1/2 x 11 white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if 18 high quality copies are provided by applicant. (Contact the U.S. Arty Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the site. Include county road (SR) numbers, landmarks, and the like. A stormwater management plan, if applicable, that may have been developed in consultation with the Division of Environmental Management. A list of the names and complete addresses of the adjacent waterfront (riparian) landowners. Under conditions existing in the Atlantic Intracoastal Waterway (AIWW), a possibility exists that the structure may be damaged by wave wash from passing vessels. Unreasonable slowing down of vessel traffic cannot be required because it would tend to nullify the navigational benefits on which the AIWW was justified. Issuance of this permit should not be construed as relieving the permittee of taking proper steps to insure the structure and moored boats will not be damaged by wave wash normally to be expected in the AIWW. PROTECT DESCRIPTION 11/8/93 Mr. and Ms. DeVita own approximately 2.5 acres of land adjacent to Masonboro Sound at the end of Pelican Point Road in New Hanover County. Pelican Point Road is off of S. R. 1492. The property lies between Whiskey Creek and the Masonboro Boatyard to the north, and the Channel Haven canal to the south. The area is one of single family residences, and rather large riparian lots. The project site averages 7' above mean sea level. There is a residence on site, as well as a community boatramp for the 20+ families along Pelican Point Rd. This ramp lies on the applicant's property, but within an easement dedicated to the property owners. To the north of the ramp is a berm vegetated with Spartina en and Borrichia frutescens that continues across the neighboring lot, narrowing as it moves north. At the north end of this berm, high water comes around the feature. There is a cove of Spartin alterniflora behind the berm lying within these two properties. For the purpose of determining riparian corridors, the applicant used the mean high water established by the berm, as it was only logical for this purpose. The body of water is approximately 870' across at the project site. The New Hanover County Land Use Plan classifies the wetland and water area as Conservation, and the high ground as Resource Protection. The Division of Marine Fisheries has designated this area as Primary Nursery, and the area is closed to the taking of shellfish. The Division of Environmental Management has classified the waters as SA-ORW. The applicant is proposing to construct a community docking system, to ultimately serve the residents of a subdivision that he may develop in the future. Future plans involve subdividing his 2.5 acre parcel into 3-5 lots. If he constructs the pier prior to subdividing his property, he may open the docking system to the Pelican Point Community that has use of the adjoining ramp. The proposed structure consists of a 330' x 6' pier, a 12' x 15' fixed deck, a 76' x 6' float, and four fingers - two at 25' x 4', and two at 14' x 4'. There is a 16' x 16' gazebo proposed over the berm at the landward end of the structure. The applicant represents this as a shell berm, as it appears on aerial photography. However, this berm is now vegetated with Spartin a n and orr' i frutescens. The first 115' of the pier extends over Spain alterniflora marsh. The gazebo is positioned over berm approximately 30' from the beginning of the pier. The next 215' of the pier extends over open water. The 12' x 15' deck is at the waterward end of the pier. The 76' x 6' float is perpendicular to the pier, with the four fingers extending waterward. There are three pilings set approximately 15' outside of the structure to either side. There are eight pilings set within the system. All together, the docking system will provide 8 mooring spaces. The docking structure has an outer perimeter of 106' x 31'. The structure extends into open water approximately 260' to reach a water depth of approximately 4' at mean low. The structure is situated 15' from each adjacent riparian corridor, and is approximately 90' from the near edge of the AIWW. 9. PROTECT DESCRIPTION. CONT. The intent of this docking system is to exclusively serve a future development of 3-5 homes. However, the Pelican Point Community is essentially landlocked, and currently has access to water only by the boatramp. It is probable that these property owners will have some use of the structure until the subdivision is built. At this time, there may be slips available to a very few of these homeowners. 10. ANTICIPATED IMPACTS The project as proposed will provide 8 mooring spaces to the people of the Pelican Point Community. The project will shade approximately 690 square feet of Spartin alterniflora marsh. It will incorporate approximately 2238 square feet of open water, and approximately 256 square feet of high marsh. The project meets with the 1/3 rule, is located 15' from adjacent corridors, and > 85' from the AIWW. The docking facility will utilize approximately 948 square feet of Public Trust Area, and will in actuality incorporate a footprint of 3286 square feet. Submitted by: T.
