[4*74AP [D F= Flt Subject: Proposed fill in Wetlands or Waters Maintenance dredging in Anchorage Basin, Wilmington Harbor New Hanover and Brunswick Counties DEM Project # 93743 Upon review of your request for 401 Water Quality Certification to place fill material in upland disposal areas which are tributary to Wilmington Harbor for maintenance dredging located on Eagle Island and Ideal Cement in New Hanover and Brunswick Counties as described in your submittal dated 26 August 1993, we have determined that the proposed fill can be covered by General Water Quality Certification No. 2668. A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 16. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such demands are made, this Certification shall be final and binding. 1786. C NOTICE CESAW-CO-N-93-0010 DATED AUGUST 26, 1993 IS AMENDED AS FOLLOWS: The WILMINGTON DISTRICT CORPS OF ENGINEERS, Wilmington, North Carolina, proposes to perform dredging in Wilmington Harbor, North Carolina (Anchorage Basin and 38-foot Project). PROJECT DESCRIPTION: The routine maintenance work which is scheduled to begin November 993 wi 1 be completed prior to March 31, 1994. The work consists of the removal of all material lying above the plane of 40 feet below mean low water (MLW) within the limits of the channels as shown on the enclosed drawing. The estimated quantity of material to be removed from the Anchorage Basin and Between Channel is approximately 800,000 cubic yards. The type of material is predominately silt with lesser amounts of sand. The frequency of dredging this project is once a year. The dredged material will be disposed of within the upland diked disposal area on Eagle Island with the liquid effluent being returned to the Brunswick River. The disposal area on Eagle Island is a permanent disposal area owned by the Government and has been previously used for maintenance of the project. This material will be placed on an existing upland diked disposal area. Approximately 370,000 cubic yards of material will be removed from Upper Midnight Channel, Upper Lilliput, Keg Island, Lower Brunswick, Upper Brunswick, and Lower Big Island. The material consists mostly of fine sand and silt with lesser amounts of shell fragments. The method of disposal is upland disposal. Also to be dredged at this time is approximately 30,000 cubic yards of material from the 25-foot Project Turning Basin which is predominately fine sand. This material will be placed in the Ideal Cement disposal area. This work will be accomplished by an hydraulic pipeline dredge selected by competitive bidding. A drawing showing the proposed dredging and the disposal site is enclosed with this notice. There is enclosed a list of Federal, state and local agencies with whorn this activity is to be coordinated. The proposed discharge of liquid effluent from diked upland disposal areas resulting from the proposed hydraulic dredging, although subject to review under Section 404 (b) of the Clean Water Act of 1977, has been determined to satisfy the terms and conditions of Nationwide Permit 33 CFR 33.5(a)(16) and the N.C. Division of Environmental Management General Water Quality Certification No. 2668 issued January 21, 1992, which replaced Water Quality Certification No. 1273 issued on November 10, 1978. -2- The proposed action is consistent with the approved Coastal Management Program of the State of North Carolina. The consistency determination is included in the Final Environmental Impact Statement (FEIS) for the Long-term Maintenance of Wilmington Harbor, North Carolina, dated October 1989. Concurrence was received from N. C. Department of Environment, Health, and Natural Resources on January 10, 1990. The availability of the FEIS for maintenance dredging of the project was published in the Federal Register on December 1, 1989. No impacts to known archeological/historical resources or endangered species will occur.
