Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* This project proposes to restore 1150 linear feet of Cathay's Creek and 213 linear feet of Kuydendall Creek to improve ecological conditions and streambank stability. The streams currently have eroding banks causing impacts to water quality and habitat conditions. The mostly forested watershed drainage area is 11 square miles on Cathay's Creek at the downstream end of the project. The City of Brevard Water Treatment Plant is located on the right side of Cathey's Creek along the lower 600 linear feet of the project. The property includes energy transmission lines, gravel roads, water treatment plant infrastructure, and forest. 4b. Explain the purpose of the proposed project:* The stream channels will be restored using natural channel design techniques and native vegetation to improve ecological conditions and streambank stability. The project will provide a sustainable ecosystem with limited eroding banks upstream of the water intake. 41. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* The stream channels will be restored by grading the channel and streambanks to a naturally stable morphology and adding native vegetation for bank protection and soil strength. In - stream rock and log vanes will be used to maintain grade control, enhance bedform diversity, and protect streambanks from erosive hydraulic forces. Illative riparian vegetation will be established to support long-term stream health. The project will have a positive impact on the downstream watershed by reducing sediment loading. Over time, due to high flows and the current water intake design, excessive sedimentation at the water intake has impeded their ability to provide water to the City. The Forest Service has rated this watershed as "functioning at risk". Some of the Forest Service's specific concerns are to stabilize the stream bank and road next to Catheys Creek and to improve aquatic organism passage. Sedimentation along Catheys Creek and its tributaries, primarily Kuykendall creek is causing a decrease in water quality and high flows are contributing to road instability along Catheys Creek Road. In addition, the existing dam does not allow for aquatic organism passage. PROJECT DESCRIPTION This project was designed in partnership with the City of Brevard to improve their municipal water intake system, in addition to addressing the concerns listed above. The activities described below are only those activities located on National Forest System (NFS) lands unless otherwise noted to more fully describe the project. Note: Some activities associated with this project will occur on the City of Brevard's property, the center of the creek is the property line in this area. The specific activities are: ■ Implement 1,300 feet of stream restoration in Catheys Creek with native riffle, boulder steps, log J -Hooks with boulders, Boulder J -Hooks and Toe Wood Revetment ■ Implement 200 feet of stream restoration in Kuykendall Creek upstream from the confluence with Catheys Creek. This work will include the same types of activities listed above in Catheys Creek. ■ Eliminate a 200 foot man-made channel on the north side of Catheys Creek. ■ Install a water intake 150 feet upstream of the current water intake in Catheys Creek. A scour pool will be constructed at this location to maintain the pool. — Decision Memo — Page 1 of 4 USDA MM Install a 50 foot boulder wall upstream of the dam to stabilize/protect Catheys Creek Road. Close the three designated roadside campsites on Catheys Creek Road (upstream of the water intake). The activities listed above will serve to: • Provide a reliable water intake system for the City of Brevard. • Improve water quality at the water intake by reducing streambank erosion and the likelihood of human waste entering Catheys Creek from streamside campsites. • Protect road stability and bridge crossing on Catheys Creek Road adjacent to the City of Brevard's water treatment plant. • Improve aquatic habitats by allowing for aquatic organism passage over the existing dam. DECISION I have decided to take the following actions: Amend the existing special use authorization issued to the City of Brevard to modify the existing dam to allow aquatic organism passage and locate a new water intake 150 feet upstream of the dam, a pool will be constructed at the intake to reduce the need for maintenance. The City of Brevard will be authorized to conduct stream restoration activities by creating a riffle, boulder steps, log J -Hooks with boulders, Boulder J -Hooks and Toe Wood Revetment in Catheys creek for approximately 1300 feet and 200 feet in Kuykendall Creek. Additional activites the City of Brevard will complete are the closure of a 200 foot man-made channel on the north side of Catheys Creek and installation of a 50 foot boulder wall upstream of the dam to stabilize/protect Catheys Creek Road. The Forest Service will close three designated roadside campsites on Catheys Creek Road (upstream of the water intake). This action is categorically excluded from documentation in an environmental impact statement (EIS) or an environmental assessment (EA). The applicable categories are identified in agency procedures as 36 CFR 220.6(e)(3) –Approval, modification, or continuation of minor special uses that require less than five contiguous acres of land, and 36 CFR 220.6(e)(18) – Restoring wetlands, streams, riparian areas or other water bodies by removing, replacing, or modifying water control structures such as, but not limited to, dams, levees, dikes, ditches, culverts, pipes, drainage tiles, valves, fates, and fencing, to allow waters to flow into natural channels and — Decision Memo — Page 2 of 4 SDA Uarm— floodplain and restore natural flow regimes to the extent practicable where valid existing rights or special use authorizations are not unilaterally altered or cancelled. I find that there are no extraordinary circumstances that would warrant further analysis and documentation in an EA or EIS. I took into account resource conditions identified in agency procedures that should be considered in determining whether extraordinary circumstances might exist: • Federally listed threatened or endangered species or designated critical habitat, species proposed for Federal listing or proposed critical habitat, or Forest Service sensitive species – The project may affect, but is not likely to adversely affect the Northern Long- eared Bats (NLEB). NLEB occur across the Pisgah Ranger District however, the project area is not near any known maternity roost trees or hibemacula. The project will not affect any other federally proposed, threatened or endangered, sensitive or Forest concern terrestrial wildlife, aquatic, or botanical species because species and/or habitat are not known to occur within the project or analysis area. • Flood plains, wetlands, or municipal watersheds – The project is specifically designed to improve the municipal water intake and water quality. • Congressionally designated areas such as wilderness, wilderness study areas, or national recreation areas – None are present. • Inventoried roadless areas or potential wilderness areas – None are present. • Research natural areas – None are present. • American Indians and Alaska Native religious or cultural sites – Cultural Resource surveys within the project area documented two archaeological sites. One site is not considered significant and is not Eligible to the National Register of Historic Places (NRHP), but the other site exhibited potential for significance and yet remains Unevaluated with respect to NRHP eligibility. Project mitigations for the Unevaluated site include an area that will not be disturbed to eliminate potential impacts and/or Adverse Effects to this site. Consulting Tribes have concurred with the Cultural Resource survey findings and recommendations and have not identified any supplementary Tribal concerns with the project as planned. • Archaeological sites, or historic properties or areas – (see above also) Project specific Cultural Resource Survey findings and recommendations were submitted to the State Historic Preservation Office for review and comment. As planned, the project will have No Effect on NRHP Eligible Historic Properties and the NC SHPO concurred with the NFsNC Cultural Resource findings and recommendations on 03/12/2019. PUBLIC INVOLVEMENT This action was listed as a proposal on the Pisgah National Forest Schedule of Proposed Actions on April 1, 2018 and updated periodically during the analysis. A scoping letter was emailed on March 28, 2018 to those who have expressed interest in projects on the Pisgah Ranger District. A news release was published on March 30, 2018 which informed the public about the project — Decision Memo — Page 3 of 4 and how to comment. In addition, an open house was held at the Pisgah Ranger Station the evening of April 10, 2018 to invite comments and discussion regarding several projects (of which this project was one). 126 members of the public attended this open house. There were over 100 comments received from the scoping letter but only 6 comments were specific to this project. All comments were supportive of the project but a question was raised about where people would camp once the designated roadside campsites were closed. There are approximately 350 campsites within developed campgrounds on the Pisgah Ranger District in addition to approximately 50 free designated roadside campsites. Also, camping is permitted in the general forest area at distances greater than 1,000 feet from an open road. FINDINGS REQUIRED BY OTHER LAWS AND REGULATIONS This decision is consistent with the Nantahala and Pisgah National Forest Land Management Plan.
