Reference the application of Messrs. Steve Carlson, S. J. Stern and
Eric R. Calhoun for a Department of the Army permit to maintain access
channels on the Atlantic Intracoastal Waterway (AIWW) and Pages Creek, west of
Figure Eight Island, Wilmington, $&w Hanover C,.ounty, North Carolina.
The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. All work authorized by this permit must be performed in strict
compliance with the permit plans.
b. All excavated materials will be confined landward of the mean high
water (MHW) elevation contour within adequate dikes or other retaining
structures to prevent spillover of solids into any vegetated wetlands or
surrounding waters.
C. The terminal end of the pipeline from the dredge into the diked
retention area will be positioned at or greater than 50 feet from any part of
the dike and a maximum distance from spillways to prevent dike erosion and to
allow adequate settlement of suspended solids.
d. A water control structure will be installed at the intake end of the
effluent pipe leading from the retention area in order to ensure maximum
settlement of suspended solids.

e. Flow from the diked retention area will be confined by pipe, trough,
or similar device to a point at or below the mean low water (MLW) elevation
contour to prevent gully erosion and siltation.
f. No excavated or fill materials will be placed at any time in any
vegetated wetlands or waters.
g. No vegetated wetlands will be excavated or filled.
h. Excavation will not exceed six (6) feet below the elevation of mean
low water (MLW).
i. This permit does not authorize the interference with any existing or
proposed Federal project, and the permittee will not be entitled to
compensation for damage or injury to the authorized structure or work which
may be caused from existing or future operations undertaken by the United
States in the public interest.
j. No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.
k. The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or
construction-related discharge. Increases such that the turbidity in the
waterbody is 25 NTU's or less are not considered significant.
1. The permittee will advise the Wilmington District Engineer,
Navigation Branch, in writing at least two weeks before he intends to
undertake any maintenance dredging.

On February 11, 1991, we renewed general permit No. CESAW-CO80-N-000-0291
(copy enclosed), which provides Federal authorization for construction
activities that receive authorization from the State of North Carolina.
A review of your application received August 13, 1993, for Department of
the Army authorization to maintain channels and basins on Pages Creek, off the
Atlantic Intracoastal Waterway (AIWW), Middle Sound, near Wilmington, New
Hanover County, North Carolina, indicates it to be a candidate for Federal
authorization under this general permit. Accordingly, the administrative
processing of your application will be accomplished by the North Carolina
Division of Coastal Management. Comments from Federal review agencies will be
furnished to the State.
If your application must be withdrawn from this general permit process for
any reason, you will be informed regarding its further management. If there
are no unresolved differences in State-Federal positions or policies, the
final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and Harbor Act, has
been assigned Action ID No. 199302678 and will be coordinated by Mr. Jeff

Reference your application for a Department of the Army (DA) permit to

Pages Creek, west of Figure Sight Island, Wilmington, New Hanover County,
North Carolina.

provisions and objectives of general permit No. CESAW-C080-N-000-0291.
Therefore, you may commence construction activity in strict accordance with
applicable State authorization and the enclosed plan. Failure to comply with
the State authorization or conditions of the general permit could result in

8. PROJECT SUMMARY: Applicant proposes maintenance dredging of the northeast
shoreline of Pages Creek and the western side of Middle Sound to the north of Pages
Creek.

9. PROTECT DESCRIPTION 8/26/93
The project site is located off of Highway 17 and S.R. 1402 in New Hanover County. This area
is west of Figure 8 Island in the northeast portion of Pages Creek and the western side of Middle
Sound to the north of Pages Creek.
The applicants are three property owners in this area. Together they own approximately 16 acres,
averaging 12' above mean sea level. This site is the location of 4 residences, each with a pier and
dock.
The project area is classified as Conservation by the New Hanover County Land Use Plan. The
waters of Pages Creek are classified SA by the Division of Environmental Management. Middle
Sound is classified SA-ORW. The area is open to shellfishing and is not a designated Primary
Nursery Area.
The proposal is the maintenance dredging of the channel in Pages Creek (approximately 600' x 40'
x -6') and two portions of Middle Sound (approximately 950' x 40' x -6'). Photographic evidence
indicates that the Middle Sound portion of the project area was dredged between 1978 and 1984.
Photos also indicate that the Pages Creek section of the proposal was dredged between 1984 and
1989. The bottom in the project area is sandy with no evidence of shellfish.
Section A of the proposal, the Pages Creek portion, is presently approximately 100' wide,
extending southward for approximately 400' and eastward for another 200'. Current depths vary
from -2' to 4' mlw.
Section B, which is the southernmost section of the Middle Sound proposal is approximately 350'
to 400' long, and approximately 50' in width. Current soundings indicate a water depth of +2'
mlw to -17 mlw.
Section C, or the northernmost section of the project is approximately 600' in length and 40' in
width. The current depths range from + l' mlw to -4.1' mlw.
The request is to dredge the existing channels to their existing lengths for a width of 40' and a
depth of -6' mlw. This would re-connect the basin in Pages Creek to the channel intersecting the
AIWW and would renew the connection between sections A & B which also join the AIWW.
The dredging is to be accomplished hydraulically. The material, approximately 8600 cu. yd.,
would be placed on a spoil island opposite the project site. This has received U.S. Army Corps
of Engineers approval, as well as approval from the owner of the island (on file).

9. PROTECT DESCRIPTION - Continued:
A dike is to be constructed on the island to contain the spoil. This spoil area is proposed at 200'
x 300' with a 6' dike wall. This calculates out to retain 13,333 cubic yards of material.
There is to be a settling basin, with adjustable flashboards, and an effluent pipe to carry return
water to the low water line.
10. ANTICIPATED IMPACTS
The project would require the disturbance of approximately 62,000 square feet of sandy, shallow
bottom material. This would remove from the system approximately 8600 cubic yards of material.
Disposal would require the disturbance of approximately 60,000 s.f. of highground. There would
be temporary turbidity from the activity.

9. PROJECT DESCRIPTION 8/26/93
The project site is located off of Highway 17 and S.R. 1402 in New Hanover County. This area
is west of Figure 8 Island in the northeast portion of Pages Creek and the western side of Middle
Sound to the north of Pages Creek.
The applicants are three property owners in this area. Together they own approximately 16 acres,
averaging 12' above mean sea level. This site is the location of 4 residences, each with a pier and
dock.
The project area is classified as Conservation by the New Hanover County Land Use Plan. The
waters of Pages Creek are classified SA by the Division of Environmental Management. Middle
Sound is classified SA-ORW. The area is open to shellfishing and is not a designated Primary
Nursery Area.
The proposal is the maintenance dredging of the channel in Pages Creek (approximately 600' x 40'
x -6') and two portions of Middle Sound (approximately 950' x 40' x -6'). Photographic evidence
indicates that the Middle Sound portion of the project area was dredged between 1978 and 1984.
Photos also indicate that the Pages Creek section of the proposal was dredged between 1984 and
1989. The bottom in the project area is sandy with no evidence of shellfish.
Section A of the proposal, the Pages Creek portion, is presently approximately 100' wide,
extending southward for approximately 400' and eastward for another 200'. Current depths vary
from -2' to -4' mlw.
Section B, which is the southernmost section of the Middle Sound proposal is approximately 350'
to 400' long, and approximately 50' in width. Current soundings indicate a water depth of +2'
mlw to -1.7' mlw.
Section C, or the northernmost section of the project is approximately 600' in length and 40' in
width. The current depths range from + l' mlw to -4. l' mlw.
The request is to dredge the existing channels to their existing lengths for a width of 40' and a
depth of -6' mlw. This would re-connect the basin in Pages Creek to the channel intersecting the
AIWW and would renew the connection between sections A & B which also join the AIWW.
The dredging is to be accomplished hydraulically. The material, approximately 8600 cu. yd.,
would be placed on a spoil island opposite the project site. This has received U.S. Army Corps
of Engineers approval, as well as approval from the owner of the island (on file).

A dike is to be constructed on the island to contain the spoil. This spoil area is proposed at 200'
x 300' with a 6' dike wall. This calculates out to retain 13,333 cubic yards of material.
There is to be a settling basin, with adjustable flashboards, and an effluent pipe to carry return
water to the low water line.
10. ANTICIPATED IMPACTS
The project would require the disturbance of approximately 62,000 square feet of sandy, shallow
bottom material. This would remove from the system approximately 8600 cubic yards of material.
Disposal would require the disturbance of approximately 60,000 s.f. of highground. There would
be temporary turbidity from the activity.
