Upon review of your request for 401 Water Quality
Certification to place fill material in 0.70 acres of wetlands or
waters which are tributary to Howe Creek for sanitary sewer
construction located at 295 Military Cut-Off Road in New Hanover
County as described in your submittal dated 6 July 1993, we have
determined that the proposed fill can be covered by General Water
Quality Certification No. 2664 issued January 21, 1992. A copy of
the General Certification is attached. This Certification may be
used in qualifying for coverage under Corps of Engineers'
Nationwide Permit No. 12.
If this Certification is unacceptable to you, you have the
right to an adjudicatory hearing upon written request within
thirty (30) days following receipt of this Certification. This
request must be in the form of a written petition conforming to
Chapter 150B of the North Carolina General Statutes and filed
with the Office of Administrative Hearings, P.O. Box 27447,
Raleigh, N.C. 27611-7447. Unless such demands are made, this
Certification shall be final and binding.

9. PROTECT DESCRIPTION
The project is located in New Hanover County adjacent to the upper end of the Howe Creek.
This stream is classified as Outstanding Resource Water from the mouth to its source. As
a result the estuarine shoreline extends to and around the upper most main tributaries of the
stream. The tract is comprised of approximately 206 acres of predominately highground
property. There is an existing power line which crosses the property in a south-north
direction. There are several pockets of wetlands which extend from the main wetlands
associated with the creek, under the power line. Species included in the makeup of these
pockets are ?g (cat-tail); Cladium (saw grass); Blackneedlerush (Juncus) and artin
cynosuroides (giant cord grass). Further away from the power line are fingers of woody and
herbacious fresh water "404" type wetlands which extend up into the main tract. The waters
of Howe Creek are classified as SA-ORW and are closed to shellfishing in this location.
The applicants propose to develop a 380 lot subdivision on the property. They indicate in
the application that phase I will include only eight (8) acres. The project is being reviewed
for total impact. A sedimentation plan is required and is administered by New Hanover
County Engineering Department. A Stormwater Control plan is being reviewed by DEM.
Of the 380 lots approximately 64 are in at least a portion of the ORW estuuine shoreline
AEC. In order to provide wastewater treatment for the project a sanitary sewer outfall will
be constructed and will tie into a previously constructed system serving the adjacent
subdivision. This system will cross several of the wetland pockets mentioned above.
Beginning at the connection and traveling northward the first crossing will involve an area
of approximately 577' long x 30' wide. The second will be approximately 210' long x 30'
wide. The third crossing involves high "404" only wetlands with no coastal involvement.
This area is approximately 290' long x 30' wide. These three crossing are candidates for the
USA Corp of Engineers nationwide 12 which will be available upon the issuance of the State
permit. The applicants have identified the 575' ORW line and will avoid working in this
area until the project is permitted. Work is ongoing in the interior portion of the project.
10. ANTICIPATED IMPACTS
Howe Creek is unusual in that DEM has designated the entire length of the creek as ORW.
This action has extended the 575' ORW-ES AEC further inland that most streams in the
coastal area. Approximately 17% of the lots proposed for the entire project are within this
AEC. Provided that the sewer line crossings of the marsh wetlands are accomplished using
fabric pens for the material stockpiling and the areas are restored to existing grade and for
the "404" only crossing the excavate materials are placed on the "up-hill" side of the site
only minimal impact should result.

9. PRO.IECT DESCRIPTION
The project is located in New Hanover County adjacent to the upper end of the Howe Creek.
This stream is classified as Outstanding Resource Water from the mouth to its source. As
a result the estuarine shoreline extends to and around the upper most main tributaries of the
stream. The tract is comprised of approximately 206 acres of predominately highground
property. There is an existing power line which crosses the property in a south-north
direction. There are several pockets of wetlands which extend from the main wetlands
associated with the creek, under the power line. Species included in the makeup of these
pockets are Ty hh (cat-tail); ladium (saw grass); Blackneedlerush uncus) and artin
cynosuroides (giant cord grass). Further away from the power line are fingers of woody and
herbacious fresh water "404" type wetlands which extend up into the main tract. The waters
of Howe Creek are classified as SA-ORW and are closed to shellfishing in this location.
The applicants propose to develop a 380 lot subdivision on the property. They indicate in
the application that phase I will include only eight (8) acres. The project is being reviewed
for total impact. A sedimentation plan is required and is administered by New Hanover
County Engineering Department. A Stormwater Control plan is being reviewed by DEM.
Of the 380 lots approximately 64 are in at least a portion of the ORW estuurine shoreline
AEC. In order to provide wastewater treatment for the project a sanitary sewer outfall will
be constructed and will tie into a• previously constructed system serving the adjacent
subdivision. This system will cross several of the wetland pockets mentioned above.
Beginning at the connection and traveling northward the first crossing will involve an area
of approximately 577' long x 30' wide. The second will be approximately 210' long x 30'
wide. The third crossing involves high "404" only wetlands with no coastal involvement.
This area is approximately 290' long x 30' wide. These three crossing are candidates for the
USA Corp of Engineers nationwide 12 which will be available upon the issuance of the State
permit. The applicants have identified the 575' ORW line and will avoid working in this
area until the project is permitted. Work is ongoing in the interior portion of the project.
10. ANTICIPATED IMPACTS
Howe Creek is unusual in that DEM has designated the entire length of the creek as ORW.
This action has extended the 575' ORW-ES AEC further inland that most streams in the
coastal area. Approximately 17% of the lots proposed for the entire project are within this
AEC. Provided that the sewer line crossings of the marsh wetlands are accomplished using
fabric pens for the material stockpiling and the areas are restored to existing grade and for
the "404" only crossing the excavate materials are placed on the "up-hill" side of the site
only minimal impact should result.
