PROJECT SUMMARY: Applicant proposes to construct an additional dock, 10' x 50', within the USS NC Battleship boat basin to serve as a station for a public tour boat. DARE Page 2 9. PROTECT DESCRIPTION 5/13/93 The project site is located adjacent to the boat basin of the USS NC Battleship, off of the Cape Fear River. This is on Eagle Island, off of Highway 421, at the western limit of the New Hanover County line. The site is directly across the river from the Wilmington waterfront. This basin averages 1100' x 260', and has widely varying bottom depths. The shoreline at the project site is stabilized with riprap, and there is no marsh. The entire tract is approximately 60 acres. The site houses a museum and a stadium, along with the necessary parking. The battleship is open to tours by the public, and shows are presented at the stadium occasionally. The waters of the Cape Fear River at this location are classified SC by the Division of Environmental Management. The area is designated Primary Nursery by the Division of Marine Fisheries, and there is no shellfish resource. New Hanover County classifies the area as Conservation. There is presently a 6' x 30' pier with a 10' x 20' floating dock located on the southeast side of the basin. This structure serves to dock the Capt. Maffit, a boat used to take the public on river tours. The size of this dock has proven inadequate for its purpose. The applicant proposes to add an additional 10' x 50' floating dock to that existing. This would extend in an easterly direction, in keeping with the existing structure. The completed structure would terminate approximately 150' short of the Cape Fear River. 10. ANTICIPATED IMPACTS The proposed dock would incorporate 500 square feet of Public Trust Area in addition to the 200 square feet presently incorporated. This Public Trust Area is man made, and off of the natural river. The project as proposed would not extend 1/3 of the distance across the basin, and would not extend into the river at all. The project is well within the confines of the property's riparian corridors. The intended use of the project is well established in the area. Submitted by: T. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on an 8 1/2 x 11 white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if 18 high quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the site. Include county road (SR) numbers, landmarks, and the like. A stormwater management plan, if applicable, that may have been developed in consultation with the Division of Environmental Management. A list of the names and complete addresses of the adjacent waterfront (riparian) landowners. A review of your application received May 17, 1993, for Department of the Army authorization to construct a tour boat dock within the USS North Carolina Battleship basin off the Cape Fear River, Wilington, 4Ww')iianover County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit. Accordingly, the administrative processing of your application will be accomplished by the North Carolina Division of Coastal Management. Comments from Federal review agencies will be furnished to the State. If your application must be withdrawn from this general permit process for any reason, you will be informed regarding its further management. If there are no unresolved differences in State-Federal positions or policies, the final action taken on your application by the State will result in your receiving written notice from us that your application is consistent with the general permit and you may commence your activity. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. All work authorized by this permit must be performed in strict compliance with the permit plans. b. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. C. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. d. It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats. The permittee will not hold the United States liable for any such damage. -2- e. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. PROJECT SUMMARY: Applicant proposes to construct an additional dock, 10' x 50', within the USS NC Battleship boat basin to serve as a station for a public tour boat. DARE Page 2 9. PROTECT DESCRIPTION 5/13/93 The project site is located adjacent to the boat basin of the USS NC Battleship, off of the Cape Fear River. This is on Eagle Island, off of Highway 421, at the western limit of the New Hanover County line. The site is directly across the river from the Wilmington waterfront. This basin averages 1100' x 260', and has widely varying bottom depths. The shoreline at the project site is stabilized with riprap, and there is no marsh. The entire tract is approximately 60 acres. The site houses a museum and a stadium, along with the necessary parking. The battleship is open to tours by the public, and shows are presented at the stadium occasionally. The waters of the Cape Fear River at this location are classified SC by the Division of Environmental Management. The area is designated Primary Nursery by the Division of Marine Fisheries, and there is no shellfish resource. New Hanover County classifies the area as Conservation. There is presently a 6' x 30' pier with a 10' x 20' floating dock located on the southeast side of the basin. This structure serves to dock the Capt. Maffit, a boat used to take the public on river tours. The size of this dock has proven inadequate for its purpose. The applicant proposes to add an additional 10' x 50' floating dock to that existing. This would extend in an easterly direction, in keeping with the existing structure. The completed structure would terminate approximately 150' short of the Cape Fear River. 10. ANTICIPATED IMPACTS The proposed dock would incorporate 500 square feet of Public Trust Area in addition to the 200 square feet presently incorporated. This Public Trust Area is man made, and off of the natural river. The project as proposed would not extend 1/3 of the distance across the basin, and would not extend into the river at all. The project is well within the confines of the property's riparian corridors. The intended use of the project is well established in the area. Submitted by: T.
