Dear Mr. Baker:
Reference your application for a Department of the Army permit to replace
a floating platform, extend floating docks and install pilings on the Atlantic
Intracoastal Waterway (AIWW), Bridge Tender Resturant, Wrightsville Beach, New
Hanover County, North Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of general permit No. CESAW-CO80-N-000-0291.
Therefore, you may commence construction activity in strict accordance with
applicable State authorization and the enclosed plan. Failure to comply with
the State authorization or conditions of the general permit could result in
civil and/or administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization modified.

Applicant: Johnnie Baker
Project Location: 1410 Airlie Road imnnediately south of the Bridge Tender Restaurant in
New Hanover County
Proposed Project: add to his marina by extending his existing floating docks by adding a
section approximately 130' x 5'. In addition to thirteen mooring
pilings would result in 12 transient slips. Also proposed is the
replacement of an existing 3' x 60' floating platform with one
approximately 5' x 60'.
Please indicate below your agency's position or viewpoint on the proposed project and return
this form by March 23, 1993. If you have any questions regarding the proposed project,

Reference the application of Mr. Johnnie C. Baker for a Department of the
Army permit to replace a floating platform, extend floating docks and install
pilings on the Atlantic Intracoastal Waterway (AIWW), Bridge Tender Resturant,
Wrightsville Beach, New Hanover County, North Carolina.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. All work authorized by this permit must be performed in strict
compliance with the permit plans.
b. The permittee's scheme of development, of which the authorized work is
a part, contemplates the presence of structures and their attendant utilities
on lands subject to an easement in favor of the United States for the
operation, maintenance, improvement, and enlargement of the Atlantic
Intracoastal Waterway (AIWW). Accordingly, the permittee will be required to
remove such structures and improvements at his own expense in the event that,
in the judgment of the U.S. Army Corps of Engineers acting on behalf of the
United States, the lands are needed at any time for any purpose within the
scope of the easement. Permanent buildings will not be constructed within the
easement.
C. This permit does not authorize the interference with any existing or
proposed Federal project, and the permittee will not be entitled to
compensation for damage or injury to the authorized structure or work which
may be caused from existing or future operations undertaken by the United
States in the public interest.

d. No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.
e. If the display of lights and signals on the authorized structure is
not otherwise provided for by law, such lights and signals as may be
prescribed by the U.S. Coast Guard will be installed and maintained by and at
the expense of the permittee.
f. The permittee will maintain the authorized work in good condition and
in conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transferred to a third party.
g. Approval of the structure was based on determination that there would
be no obstruction to navigation. Under conditions existing in the Atlantic
Intracoastal Waterway (AIWW), a possibility exists that the structure may be
damaged by wave wash from passing vessels. Unreasonable slowing down of
vessel traffic cannot be required because it would tend to nullify the
navigational benefits on which the AIWW was justified. Issuance of this
permit should not be construed as relieving the permittee of taking proper
steps to ensure the structure and moored boats will not be damaged by wave
wash normally to be expected in the AIWW.

8. PROJECT SUMMARY: The applicant proposes to add to his marina by extending his
existing floating docks by adding a section approximately 130' x 5'. This, in addition to
thirteen mooring pilings would result in 12 transient slips. Also proposed is the replacement
of an existing 3' x 60' floating platform with one approximately 5' x 60'.

9. PROJECT DESCRIPTION 1/6/93
The applicant owns several lots along Airlie Road beginning at the Highway 74 drawbridge
and running south. The property supports a business office, two restaurants, a tourist shop,
three parking lots, and a vacant lot. There is a somewhat extensive marina system between
these lots. There appear to be approximately 40 permanent slips, and two transient docks.
There is a transient dock connecting to the watermost structure and extending southward that
was permitted by modification in 1990, and does not show up on the photography.
The waters of Motts Channel are not designated Primary Nursery in this location. The
waters are classified SB by the Division of Environmental Management, and are not open to
shellfishing. New Hanover County classifies the area as Conservation in their Land Use
Plan. The water depth in the project area is approximately -.5' to -1' mean low water.
The applicant requests to modify his Major Permit #127-89 to connect the floating docks in
front of the Bridge Tender Restaurant across the vacant lot to the south, and to the floating
docks in front of the Fish House Grill. A 130' x 5' floating dock would be placed
approximately 20' waterward of the marshgrass. This is approximately 10' landward of the
Bridge Tender floating docks, and approximately 10' waterward of the Fish House Grill
floating docks. It would be connected by ramps to these two structures. The applicant has
indicated that the structure is 120' because he did not count the 5' on either side that extends
under the ramps.
There are no fingers proposed as the plat may imply; rather, this was the applicant's way of
indicating "imaginary slips". The applicant is proposing to define the transient slips with 13
mooring pilings placed approximately 25' waterward of the dock.
The floating dock in front of the Fish House Grill is presently 3' x 60'. This dock is to be
replaced in the same location. The width will increase to 5'.
The intended use of both structures is temporary docking for the use of customers to the
various commercial ventures on the site.
10. ANTICIPATED IMPACTS
The project would incorporate approximately 4200 square feet of Public Trust Area. The
structure would be connecting a system stretching continuously some 330' across the Public
Trust Area. However, given the expanse of dock system in this area, this does not remove
from use a significant area that is presently available for navigation. The structure would
allow for the dockage of 12 more vessels at the site.

On February 11, 1991, we renewed general permit No. CESAW-CO80-N-000-0291
(copy enclosed), which provides Federal authorization for construction
activities that receive authorization from the State of North Carolina.
A review of your application received March 4, 1993, for Department of the
Army authorization to replace a floating platform, extend floating docks and
install pilings on the Atlantic Intracoastal Waterway (AIWW), Bridge Tender
Resturant, Wrightsville Beach, New Hanover County, North Carolina, indicates
it to be a candidate for Federal authorization under this general permit.
Accordingly, the administrative processing of your application will be
accomplished by the North c:aroiina Division of Coastal Management. Comments
from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit process for
any reason, you will be informed regarding its further management. If there
are no unresolved differences in State-Federal positions or policies, the
final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should you begin work.

8. PROJECT SUMMARY: The applicant proposes to add to his marina by extending his
existing floating docks by adding a section approximately 130' x 5'. This, in addition to
thirteen mooring pilings would result in 12 transient slips. Also proposed is the replacement
of an existing 3' x 60' floating platform with one approximately 5' x 60'.

9. PROJECT DESCRIPTION 1/6/93
The applicant owns several lots along Airlie Road beginning at the Highway 74 drawbridge
and running south. The property supports a business office, two restaurants, a tourist shop,
three parking lots, and a vacant lot. There is a somewhat extensive marina system between
these lots. There appear to be approximately 40 permanent slips, and two transient docks.
There is a transient dock connecting to the watermost structure and extending southward that
was permitted by modification in 1990, and does not show up on the photography.
The waters of Motts Channel are not designated Primary Nursery in this location. The
waters are classified SB by the Division of Environmental Management, and are not open to
shellfishing. New Hanover County classifies the area as Conservation in their Land Use
Plan. The water depth in the project area is approximately -.5' to -1' mean low water.
The applicant requests to modify his Major Permit #127-89 to connect the floating docks in
front of the Bridge Tender Restaurant across the vacant lot to the south, and to the floating
docks in front of the Fish House Grill. A 130' x 5' floating dock would be placed
approximately 20' waterward of the marshgrass. This is approximately 10' landward of the
Bridge Tender floating docks, and approximately 10' waterward of the Fish House Grill
floating docks. It would be connected by ramps to these two structures. The applicant has
indicated that the structure is 120' because he did not count the 5' on either side that extends
under the ramps.
There are no fingers proposed as the plat may imply; rather, this was the applicant's way of
indicating "imaginary slips". The applicant is proposing to define the transient slips with 13
mooring pilings placed approximately 25' waterward of the dock.
The floating dock in front of the Fish House Grill is presently 3' x 60'. This dock is to be
replaced in the same location. The width will increase to 5'.
The intended use of both structures is temporary docking for the use of customers to the
various commercial ventures on the site.
10. ANTICIPATED IMPACTS
The project would incorporate approximately 4200 square feet of Public Trust Area. The
structure would be connecting a system stretching continuously some 330' across the Public
Trust Area. However, given the expanse of dock system in this area, this does not remove
from use a significant area that is presently available for navigation. The structure would
allow for the dockage of 12 more vessels at the site.
