waters which are tributary to Masonboro Sound for minor road

we have determined that the proposed fill can be covered by
General Water Quality Certification No. 2732 issued January 21,
1992. A copy of the General Certification is attached. This
Certification may be used in qualifying for coverage under Corps
of Engineers' General Permit No. 14.

Dear Mr. Evans:
Reference your application of December 16, 1992, for Department of the
Army authorization to construct a fill road across 198 feet of wetlands
subject to our regulatory jurisdiction, and spanning approximately 270 feet of
wetlands and coastal marsh, for access to a high ground building lot, adjacent
to Myrtle Grove Sound at 1666 Indian Cove Avenue, in Wilmington, New Hanover
County, North Carolina.
Mr. Jeff Richter of my staff has determined that your fill road can be
authorized by our Nationwide Permit No. 14. The span does not require
authorization from this office provided no fill material is placed in wetlands
during, or as a result of, its construction.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899
and Section 404 of the Clean Water Act, was provided for fills for roads
crossing waters of the United States (including wetlands and other special
aquatic sites) provided:
a. The width of the fill is limited to the minimum necessary for the
actual crossing;
b. The fill placed in waters of the United States is limited to a filled
area of no more than one-third acre. Furthermore, no more than a total of 200
linear feet of the fill for the roadway can occur in special aquatic sites,
including wetlands;
C. The crossing is culverted, bridged or otherwise designed to prevent
the restriction of, and to withstand, expected highflows and the movement of
aquatic organisms;
d. The crossing, including all attendant features, both temporary and
permanent, is part of a single and complete project for crossing of a water of
the United States; and

e. For fills in special aquatic sites, including wetlands, the permittee
notifies the District Engineer in accordance with the "Notification" general
condition.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions. Mr. Richter
has spoken with Ms. Tere Barrett of the North Carolina Division of Coastal
Management and Mr. Jim Gregson of the North Carolina Division of Environmental
Management. Ms. Barrett has indicated that a LAMA major permit will be
required from her office authorizing your proposed work. Mr. Gregson stated
that a 401 Water Quality Certification review and issuance (or verification)
is included in the CAMA review and permit. Please be aware that our permit
will be valid only upon your receipt of these agencies issued permits.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.

9. PROTECT DESCRIPTION 1/26/93
The project site is located at 1666 Indian Cove Avenue in New Hanover County. This is a dirt road
off of S. R. 1492. The site lies adjacent to Myrtle Grove Sound. The applicant owns
approximately 6.55 acres of land, with only .31 acres in high ground. The lot averages 5' above
mean sea level.
The New Hanover County Land Use Plan classifies the area as Conservation. The area is
designated as Primary Nursery by the Division of Marine Fisheries, and is open to shellfishing.
The Division of Environmental Management has classified the waters of Myrtle Grove Sound as SA
- ORW.
The applicant has only .31 acres of high ground in two sections. The largest and only buildable of
these is approximately .25 acres in size. He has attempted to obtain permission to access the
property through an already established private road in order to forego the expense and impact of a
new road and bridge. The applicant was successful in obtaining verbal approval for use of the
neighboring road, but could not secure a loan without a deeded access. The owners of the road
would not furnish this. Hence, the applicant is left with the alternative of crossing coastal marsh
and delineated "404" wetlands to gain access to his high ground.
The proposal begins adjacent to Myrtle Grove Sound where the applicant anticipates eventually
constructing a residence and gravel road. At this time, these two items are not addressed. The
bridge begins at the flagged "404" line on the west side of the high ground "peninsula". The
structure will be 10' feet wide and approximately 270' in length, averaging 4' above the marsh
substrate. As it begins, the proposed bridge crosses approximately 30' of transitional wetland
species (Bordghia frutescens, Oaks, and Cedars). It continues for approximately 9' across Spartin
patens and Iva frutescens. The next 15' or so cross dwarfed Spartina alterniflora mixed with
Limonium carolinianum. The bridge crosses a 50' expanse of Phragmites u r li mixed with
Spartin alterniflora, and 120' of Tvna 1 of li mixed with Distichlis 59icata. The next 15' will
cross Distichlis spicata and 1 di m jamaicense. At this point, the structure will move once again
into the more transitional wetlands; approximately 31' over Iva frutescens, Myrica Vp,, Cedars,
and Oaks.
At this point, the bridge will end, aiW will give way to a marl roadbed, 198' in length, and 20' in
width. The first 30' of this is across high ground. From here the road cuts through Pocosin type
wetlands, also delineated by the U.S. Army COE. This 168' stretch will fill approximately 3960
square feet of Bays, Hollies, Pines, Black Gum, and Smilax spy.
The road bed will consist of sandy fill material placed under marl. The sides will be sloped and
vegetated. Silt fencing will be used to contain the fill material until the vegetative border is secure.

10. ANTICIPATED IMPACTS
The intended use of the project is for access to a single family residence; given the size of the lot,
nothing more could be expected. The project will disturb a total of approximately 7260 square feet.
Of this, the bridge will be elevated above approximately 610 sf of transitional wetland species; it
will be elevated above approximately 2090 square feet of mixed coastal wetland species; and the
associated roadbed will fill approximately 3960 sf of Pocosin type wetlands. Approximately 600 sf
of high ground will also be filled for the roadbed.

access his high ground. Fill will be placed for a road through the adjoining, delineated
"404" wetlands.

9. PROJECT DESCRIPTION 1/26/93
The project site is located at 1666 Indian Cove Avenue in New Hanover County. This is a dirt road
off of S. R. 1492. The site lies adjacent to Myrtle Grove Sound. The applicant owns
approximately 6.55 acres of land, with only .31 acres in high ground. The lot averages 5' above
mean sea level.
The New Hanover County Land Use Plan classifies the area as Conservation. The area is
designated as Primary Nursery by the Division of Marine Fisheries, and is open to shellfishing.
The Division of Environmental Management has classified the waters of Myrtle Grove Sound as SA
- ORW.
The applicant has only .31 acres of high ground in two sections. The largest and only buildable of
these is approximately .25 acres in size. He has attempted to obtain permission to access the
property through an already established private road in order to forego the expense and impact of a
new road and bridge. The applicant was successful in obtaining verbal approval for use of the
neighboring road, but could not secure a loan without a deeded access. The owners of the road
would not furnish this. Hence, the applicant is left with the alternative of crossing coastal marsh
and delineated "404" wetlands to gain access to his high ground.
The proposal begins adjacent to Myrtle Grove Sound where the applicant anticipates eventually
constructing a residence u?•: gravel roan. At these two items are not addressed. "?-
bridge begins at the flagged "404" line on the west side of the high ground "peninsula". The
structure will be 10' feet wide and approximately 270' in length, averaging 4' above the marsh
substrate. As it begins, the proposed bridge crosses approximately 30' of transitional wetland
species (Borrichia frutescens, Oaks, and Cedars). It continues for approximately 9' across S_partina
patens and Iva frutescens. The next 15' or so cross dwarfed S artina alterniflora mixed with
Limonium carolinianum. The bridge crosses a 50' expanse of Phragmites australis mixed with
Sparting alterniflora, and 120' of Typha latifolia mixed with Distichlis s icata. The next 15' will
cross Distichlis spicata and Cladium jamaicense. At this point, the structure will move once again
into the more transitional wetlands; approximately 31' over Iva fnrtescens, M•yrica WP., Cedars,
and Oaks.
At this point, the bridge will end, and will give way to a marl roadbed, 198' in length, and 20' in
width. The first 30' of this is across high ground. From here the road cuts through Pocosin type
wetlands, also delineated by the U.S. Army COE. This 168' stretch will fill approximately 3960
square feet of Bays, Hollies, Pines, Black Gum, and Smilax sp..
The road bed will consist of sandy fill material placed under marl. The sides will be sloped and
vegetated. Silt fencing will be used to contain the fill material until the vegetative border is secure.

10. ANTICIPATED IMPACTS
The intended use of the project is for access to a single family residence; given the size of the lot,
nothing more could be expected. The project will disturb a total of approximately 7260 square feet.
Of this, the bridge will be elevated above approximately 610 sf of transitional wetland species; it
will be elevated above approximately 2090 square feet of mixed coastal wetland species; and the
associated roadbed will fill approximately 3960 sf of Pocosin type wetlands. Approximately 600 sf
of high ground will also be filled for the roadbed.
