For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management (NCDEM). You should contact Mr. John Dorney, telephone (919) 733-1786, regarding water quality certification. This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. Based on this review, we have identified significant uses which would be removed by this project. These uses are water storage, bank stabilization, pollutant removal, wildlife habitat and aquatic life habitat. Furthermore, insufficient evidence is present in our files to conclude that your project must be built as planned in wetlands. Therefore, we are moving toward denial of your 401 Certification. Until we receive additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal Management place your project on administrative hold. Please provide us with information supporting your position that your project must be constructed as planned and that you have no practicable alternative to fill of these wetlands without fill on lots 18,19 and 20. In addition, fill on lot 13 beyond contour 572 feet is unlikely to be approved. Finally, storm sewers should end at the edge of the wetlands and stormwater be allowed to sheetflow across the wetlands before entering the'stream.channel. Specifically can you construct your residential development uplands or prior converted farmland? Any documentation such as maps and narrative which you can supply to address upland alternatives may be helpful in our review of your 401 Certification. Please respond within two weeks of the date of this letter by sending a copy of this information to me and one copy to our Mr. Kim Colson at the Mooresville Regional Office at 919 N. Munici-pal sanitary sewer system 8 as 93 OWNER'S SIGNATURE DATE Project Location The Piper Glen Property is located south of Charlotte, Mecklenburg County, NC south of the intersection of NC 51 (Pineville-Matthews Road) and Rea Road. The general boundaries of Piper Glen are formed by Elm Lane West (on the west), NC 51 and Four-mile Creek (on the north), the existing Raintree Community,(on the east), and by the proposed outer belt and Providence Road West (to the south). The entire project is located within the Weddington NC USGS Quadrangle and within the watershed of the Fourmile Creek. The specific study area consists of several separate parcels under the ownership of Crosland Land Company (now or formerly). The study area includes: Parcels 13, 14, 15, 16, 26, 29, and the property to encompass the future extensions of Rea Road and Providence Road West. (Text revised 8-25-93) Parcel 26 Parcel 26 is bounded generally on the East by a minor un-named tributary to Four-Mile Creek and the existing Raintree residential development, on the North by the TPC hole #2 green, on the West by TPC hole #3 & #4, and on the South by existing lots on Sheperdleas Lane. Those portions of this parcel which exhibit positive wetland indicators consist of the minor tributary on the East parcel boundary and its immediate annual floodplain. The total contributing drainage basin of this stream is approximately 330 acres. Three transects were established through this area to document the positive wetland characteristics and to establish an upper wetland boundary. At its upper reaches, the stream channel only, being a single inscised channel, exhibited positive wetland indicators. At its lower reaches, the stream channel becomes braided within its floodplain so the entire floodplain has been characterized as exhibiting positive wetland indicators. For most of its course, this stream and its associated wetland are located outside of the parcel boundaries. Stone, Jr. & Associates North Charlotte, NC Scale: 1 "=2000' Hydrology The dominant hydrologic feature of the Piper Glen site is Four-Mile Creek which has a drainage basin comprised of approximately 17.9 square miles. None of the parcels which were a part of this study are adjacent to the main Four-Mile Creek channel. All parcels are located above the headwaters to this creek on minor un-named tributaries or drainageways. The Mecklenburg County Floodway maps were reviewed to determine if a regulated floodway or f]oodway fringe occurs in any of the study area. None of the streams or drainageways within the Crosland parcels were within areas designated as floodway or fringe. National Wetland Inventory The Weddington quadrangle of the US Fish and Wildlife Service National Wetland Inventory were reviewed to determine if any portion of the study area had been previously identified as wetland, The only portions of the study area which have been classified as wetland by the NWI are the minor tributary in Parcel 26 (PFOIA) and the minor tributary in Parcel 29 (PFOIA), Both of these tributaries have been delineated in the field. Stone, Jr. & Associates North Charlotte, NC Scale: 1 "=2000' Soils The soils of the site have been mapped by the Mecklenburg County office of the USDA Soil Conservation Service and are documented on sheet 12 of the Mecklenburg County Soil S urvey. Soils which have been identified within the reviewed parcels are generally comprised of the following series: Ce Cecil Sandy Clay Loam, Typic Hapludults Ir Iredell Fine Sandy Loam, Typic Hapludalfs Me Mecklenburg Fine Sandy Loam, Ultic Hapludalfs MO ' Monocan soils, Fluvaquentic Eutrochrepts Pa Pacolet Sandy Loam, Typic Hapludults Wk Wilkes Loam, Typic Hapludalfs Although none of the soils are listed as hydric in the National List of Hydric Soils, 1991, Monocan soils are listed by the Mecklenburg County SCS as somewhat poorly drained and are known to have hydric inclusions of Wehadkee series within floodplain depressions. Depth to seasonal high water table is 0.5.2.0' in winter and early spring. The majority of the floodplain portions of this site are mapped as Monocan series, however none of the mapped areas occur within the portions of the site which are within the study area. Cecil, Iredell, Mecklenburg, Pacolet, and Wilkes series are described as well drained to moderately well drained soils which typically occur on broad ridges and upland sideslopes. Some Iredell soils are described as having seasonal wetness due to impermeable clay subsoil. A perched water table may be observed at 1.0-2.0' during November through March under normal conditions. Stone, Jr, & Associates Charlotte, NC Scale: 1 "=2000' Vegetation Communities Only a portion of the site remains in its original forested state, the remainder having been cleared for golf course or residential development. Of those areas which are within the study area, Parcels 13, 26, and 29 are nearly entirely forested with the excption of existing cleared trails and sewerline rights-of-way. Parcel 14,15,10 is forested with the exception of a +5 acre clearing near the center of the parcel which is dominated by medium aged successional growth. The Rea Road Extension and the Providence Road West Extension follow existing cleared jeep trails. Communities which occur in the various parcels could be generally grouped into one of five categories: Upland Deciduous - Dominated by Oak and Hickory Upland Coniferous/Mixed - Dominated by Pine, Cedar, and Mixed Deciduous species Upland Successional / Open - Dominated by Blackberry, Grasses, andiMixed saplings Wetland Deciduous / Floodplain Forest - Dominated by Birch, Sycamore, Gum, and Maple Wetland Herbaceous - Dominated by Sedge (Carex) and Rush (Juncus) The relative dominance of species within each strata has been determined at representative sample plots within each community and the indicator status of each dominant species has been noted based upon "The National List of Plant Species Which Occur in Wetlands, 1988 National Summary" US Fish and Wildlife Service. Piper Glen Preliminary Wetlands Delineation - Crosland Parcels - EDSA - June 1993 Wetland Determination Methodology Those portions of the site which have been identified (in a preliminary manner) as jurisdictional under Section 404 of the Clean Water Act or Section 10 of the Rivers and Harbors Act include the channel of minor tributaries to Four-Mile Creek and wetland areas which satisfy the definition of a wetland in the "Corps of Engineers Wetlands Delineation Manual, Technical Report Y-87.1 ", January 1987, U.S. Army Corps Environmental Laboratory. A routine on-site determination method utilizing the multi-parameter approach was implemented to identify the upper wetland boundary of all areas which satisfy the three parameters as described in the manual: 1. Hydrophytic Vegetation 2. Hydric Soils 3. Wetland Hydrology The methodology was utilized to make the determination: 1. Preliminary data gathering and synthesis, Data sources USGS Quadrangle Map National Wetlands Inventory Map USDA-SCS Soil Survey Flood Insurance Rate Maps Mecklenburg County Engineering Department Flood Data Applicant provided topography, boundary survey and flood data. 2. ,Selection of Routine on-site Determination Method 3. Identification of Plant Community Types The site was divided into its major vegetation communities for charactization. 4. Transects were established approximately perpendicular to the major water course for location of sample observation points, 5. Observation points were located along transects within each major vegetation community to observe and record the characteristics of hydrophytic vegetaion, hydric soils and wetland hydrology. Each sample observation point (sample plot) consisted of one or more 18-24" deep test pits dug with a spade to characterize soils and hydrology, and a thirty foot radius area to characterize tree and woody vine species, and a five foot radius area to characterize a representative sample of the sapling, shrub, and herbaceous plant species. All observed data. was recorded on an appropriate Data Form 1 as well as notation of Atypical Conditions and Normal Environmental Conditions. A determination was made whether or not the sample plot was a wetland based upon available and observed data. Each sample plot has been marked in the field with labelled pink and black striped flagging. When a wetland/non-wetland determination had been made at all sample plots, an upper wetland boundary was assumed to occur between wetland plots and non-wetland plots. Numerous additional test pits were dug along each transect to identify the boundary Piper Glen Preliminary Wetlands Delineation - Crosland Parcels - EDSA - June 1993 location. These test pits have been marked in the field with orange and black striped flagging. Once boundaries had been located along each transect, the characteristics at this point were utilized to determine the boundary location between transects until the entire site had been divided into wetland and non-wetland areas. This boundary was then confirmed and adjusted through the use of visual observation and additional test pits on either side of the line. All upper wetland boundaries have been located in the field with striped blue and white surveyors flagging. Each flag has been assigned a number and has been located on a topographic map of the site with a compass and field measurement.
