Reference your letter of August 30, 1993, regarding a proposed fire plow
training session in Hoffman Forest in Jones and Onslow Counties on October 28,
1993.
On October 8, 1993, we issued general permit No. 199303393, (copy
enclosed) that authorizes the discharge of dredged or fill material associated
with the construction of fire plow lines for the purpose of training forest
fire equipment operators, by the U.S. Forest Service or N.C. Division of
Forest Resources, within non-tidal waters of the United States in the State of
North Carolina.
Your proposed work is authorized if you can comply with all permit
conditions. Please read the enclosed permit to prevent an unintentional
violation of Federal law. As this Department of the Army general permit does
not relieve you of the responsibility to obtain any other required approvals,
you should contact appropriate State and local agencies before beginning work.

Upon review of your request for 401 Water Quality Certification
to plow 31.5 acres of wetlands or waters which are tributary to North
Prong White Oak River for training purposes located at Hoffman State
Forest in Jones and Onslow Counties as described in your submittal
dated 1 September 1993, we have determined that the proposed fill can
be covered by General Water Quality Certification No. 2679. A copy of
the General Certification is attached. This Certification may be used
in qualifying for coverage under Corps of Engineers' General Permit
No. 297 or the proposed General Permit for fireplow training
discharges in wetlands. An additional condition is that berms between
roads and canals must be repaired after training exercises are
complete.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This -request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.
