Upon review of your request for 401 Water Quality Certification
to place fill material in 0.06 acres of wetlands or waters which are
tributary to Mallard Creek for condominuim developement located at
Mallard Creek Church Road in Mecklenburg County as described in your
submittal dated 20 August 1993, we have determined that the proposed
fill can be covered by General Water Quality Certification No. 2671
issued January 21, 1992. A copy of the General Certification is
attached. This Certification may be used in qualifying for coverage
under Corps of Engineers' Nationwide Permit No. 26.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

On behalf of Mr. Robert Bradley, of The Bradley Company, I am requesting a
General 401 Water Quality Certification-NWP #26, for the North Pointe Condomi-
nium Project on Mallard Creek Church Road in Charlotte. It is near UNCC.
A Plan and background information is attached for your information.
The site is generally open cow pasture and woodland. The Jurisdictional Waters
are tributaries and intermittent tributaries of Mallard Creek which has a
water classification of C, and wetlands that formed in a former pond bed. The
dam was breached several years ago. The plan indicates that there will be less
than 1/3 Acre of impact with the actual impact approximately 1/10th of an Acre
to Jurisdictional Waters.
I have informed my client that additional application and review would be re-
quired if the plans change and involve impact of more than 1/3 Acre.

Dear Steve,
On behalf of Robert Bradley, of The Bradley Company, I am requesting confirma-
tion of the Jurisdictional Waters and eligibility for NWP #26 on the proposed
North Pointe Condominium Project in Northeast Charlotte. The project is on
Mallard Creek Church Road and is near UNC-Charlotte.
The site is generally open pasture and woodland. The Jurisdictional Waters are
made up of tributaries and intermittent tributaries of Mallard Creek, and Wet-
lands that formed in a former pond bed. The plan indicates that there will be
less than 1/3 Acre of impact to Jurisdictional Waters.
I have informed my client that application to NCDEM will be necessary for im-
pacts of 1/3 Acre or greater are necessary. Note that the total acres of Juris-
dictional Water on the site is less than .60 Acres.
