On June 21, 2019, the Division of Water Resources (Division) received your "After the Fact" application dated June 19,
2019, requesting a 401 Water Quality Certification from the Division for the subject property. The Division has
determined that your application is incomplete and cannot be processed. The application is on -hold until the following
information is received:
Page 12 of 12 carries the signature of Melissa Mathis. In order for Melissa Mathis to sign, the application
package requires an agent authorization letter from the applicant. A sample agent authorization letter is
attached. [15A NCAC 02H .0502(f)]
Please update table 3 on page 5 of 12 to indicate the stream impacts for rip -rap. The plan indicates 102 linear
feet. You will also need to update table 4 on page 6 of the application to indicate the area of impact (acres) for
the dredging and installation of the cold water release. Please separate these out as 01 and 02. [15A NCAC
02H .0502(c)]
Per Condition 9 of GC 4132, all work must be done "in the dry". Therefore, dewatering methods will be
necessary to temporarily dewater the stream channel during rip rap installation. Please provide a construction
sequence that details the method of dewatering to be utilized at the site and the sequence of construction
events to be followed to ensure compliance with this condition. [15A NCAC 02H .0502(b)(3)]
Pursuant to Title 15A NCAC 02H .0502 (c), the applicant shall furnish all of the above requested information for the
proper consideration of the application. If all of the requested information is not received within 30 calendar days, of
receipt of this email, the Division will be unable to approve the application and it will be returned. The return of this
project will necessitate reapplication to the Division for approval, including a complete application package and the
appropriate fee.

Thanks for the email and taking the time to meet with me onsite last week. We have redrawn our plans to show the
information that's required and Melissa will be submitting early next week if she hasn't already. I spoke to Joe from
Macon Co. today and we will be meeting at the Crum's property on Monday of next week. Again thank you for your
willingness to work with us and we will make sure to avoid these situations moving forward.

Joe,
I just wanted to send a summary of what we discussed in the field on June 6, 2019. 1 am okay with continuing the pond
work while the water is being diverted. This includes the dredging and installation of the cold water release. We are
requiring an after the fact permit application for the rip -rap and pond work. Do not install the rip rap until you have
authorization and we have had a chance to review what you are proposing. In the application, I want to see a cross
section of the rip rap showing how it will be embedded into the stream. Also, include a pump around sequence of how
the water will be diverted so that the work is being performed "in the dry". You will also want to contact Joe Allen with
Macon County to make sure you meet their erosion control requirements. He has already been to the site and is copied
on this email. I will follow up with a phone call to make sure you received this. Please let me know if you have any
questions.

This is continuing to be a problem with your company. You need to contact us before beginning work to see if a
corresponding Water Quality Certification is required. Do not proceed with the work until we have spoken. I will follow
up with a phone call.

Mr. Mitchell,
Thanks for the email. We had previously acquired approval from Army Corps for this project and I thought we were ok
to proceed. The total length of the streams armored will be approximately 600' over four sections. There will be a new
water level control structure installed in place of the old drain. The crew is currently working on this and have rerouted
the water and drained most of the pond. Let me know how we need to proceed.

Thanks for the courtesy copy application for the Crum property. I'm trying to determine if this project is going to require
written approval from our office. What is the total length of stream that is being proposed for rip -rap placement? Are
you planning to replace the existing drainage pipe? If so are you going to have to lower the pond level to do the work?
