Army Corps of Engineers Public Notice Action ID. 199301768 dated April 29, 1993 which describes a project proposal by the City of-Charlotte. The project, involving wetland fill to facilitate improvements to Old Providence Road, is located at the intersection of Sharon View Road and Old Providence Road in Charlotte, in Mecklenburg County. Based on a coordinated agency review, the state interposes no objection to the project. Comments were submitted by two of the several cooperating agencies. These are as follows: Division of Environmental Management - issued the required Section 401 Water Quality Certification on May 15, 1993. Certification No. 2828 provides a turbidity turbidity standard for the project; Wildlife Resources Commission - found it could approve of the project provided the following controls were included in the permit: 1) Sedimentation and erosion control measures should be installed prior to land-disturbing activities and maintained throughout the life of the project. 2) Temporary ground cover (e.g., hardwood mulch, straw, etc.) should be placed on all bare soil during construction. Permanent herbaceous vegetation in these same areas should be established within 15 days of ground-disturbing activities to provide long term erosion control. P.C. Region Coordinator Habitat Conservation Program DATE: May 27, 1993&4 ?a.ATJ SUBJECT: U.S. Army Corps of Engineers Public Notice No. 199301768, review of application by City of Charlotte for a permit to place fill materials into wetlands adjacent to McAlpine Creek for improvements to Old Providence Road, Mecklenburg;.County .: The North Carolina Wildlife Resources Commission (NCWRC) has reviewed the information provided by the U.S. Army Corps of Engineers, and biological field staff conducted a site visit on May 24, 1993. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d.). The applicant proposes to place approximately 200 cubic yards of fill into 1/4-acre of forested wetlands along 1,300 linear feet of Old Providence Road where it crosses McAlpine Creek. The existing road shoulders would be widened to an average of 10 feet to accommodate a new turning lane on the east and a new sidewalk on the west side of the existing approach fills. Finished slopes would be increased from 2:1 to 3:1 to improve safety. The purpose of the work is to add a turning lane to Old Providence Road at its intersection with Sharon View Road, construct a new sidewalk, and improve public safety. Seasonally flooded forested wetlands in the project area are vegetated with green ash, sycamore, box elder, sweet gum, and water oak. Wetlands on the west side of Old Providence Road have been partly cleared to accommodate overhead utility lines and buried gas pipelines. Although wetlands have been disturbed in the project area, they provide good habitat for various species of mammals, birds, reptiles, and amphibians. Stream banks have ,r been cleared of all woody vegetation and riprap placed along McAlpine Creek. The stream is somewhat degraded from sedimentation, but may support nongame fish species. The NCWRC does not object to the issuance of this permit, provided the project sponsors modify the project as follows: 1) Sedimentation and erosion control measures should be installed prior to land disturbing activities and maintained throughout the life of the project. 2) Temporary ground cover (e.g. hardwood mulch, straw, etc.) should be placed on all bare soil during construction. Permanent herbaceous vegetation in these same areas should be established within 15 days of ground disturbing activities to provide long term erosion control. On February 6, 1990, the DA and the U.S. Environmental Protection Agency (EPA) signed a memorandum of agreement (MOA) establishing procedures to determine the type and level of mitigation necessary to comply with the Clean Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding impacts to waters and wetlands through the selection of the least damaging, practical alternative; second, taking appropriate and practical steps to minimize impacts on waters and wetlands; and finally, compensating for any remaining unavoidable impacts to the extent appropriate and practical. To enable us to process your application in full compliance with this MOA, we request that you provide the following additional information: In addition to the alternatives analysis submitted with your permit application, please provide a comparative cost analysis between maintaining 2:1 side slopes and installing guardrail versus the current proposal of increasing sideslopes to 3:1 with no guardrail. Also include any safety aspects of guardrail installation that you consider pertinent. This information is essential to our expeditious processing of your application and it should be forwarded to us by June 3, 1993. ATTACHMENT Block 4 Continued. 4345 4a. ACTIVITY Shoulder reconstruction associated with widening Old Providence Road will extend along approximately 1300 linear feet of wetlands. Approximately 200 cubic yards of upland fill material is proposed below the elevation of the ordinary high water flow line. The 12' depth for HWL is based upon a USGS recommendation. The area of wetlands being impacted is approximately 12,235 square feet, and consists of those areas bounded by the existing toe of slope and the proposed toe of slope. A shallow ditch averaging 3' deep and 350' long is located at the toe of the existing slope on the east side of Old Providence Road, north of the bridge. We propose to reconstruct approximately 300 feet of this ditch at the toe of the proposed slope. None of the recent construction in the project area was associated with the roadway improvement. Shoulder reconstruction will extend into the McAlpine Creek floodplain. * Widen the shoulder along the west side of Old Providence Road and construct sidewalk. The new sidewalk will connect with existing sidewalk along Sharon View Road and the existing sidewalk which ends just south of the McAlpine Creek bridge. * Change the vertical alignment of Sharon View Road to flatten its tie-in with old Providence. * Add guardrail at the McAlpine Creek bridge. * Signalize the intersection We expect to begin construction in spring 1994, and complete during fall 1994. ATTACHMENT 4c. DISCHARGE OF DREDGED OR FILL MATERIAL Approximately 200 cubic yards of upland fill material is proposed below the elevation of the ordinary high water flow line. The contractor will be responsible for supplying fill material, which is subject to City approval. Erosion control will consist of rock check dams and silt fence, and is subject to State approval. The City of Charlotte Engineering Department considered three alternates: Alternate #1: * 9' shoulder; guardrail at bridge approaches and at face of curb along fill embankments; 2:1 embankment slopes * Comments: - According to NCDOT, guardrail is warranted along the fill embankment due to the fill height (average 15'*in this case) whenever the fill slope is 2:1 or steeper. Alternate #2• * 14' shoulder; guardrail at bridge approaches and 12' from face of curb along fill embankments; 2:1 embankment slopes * Comments: - According to NCDOT, guardrail is warranted along the fill embankment due to the fill height whenever the fill slope is 2:1 or steeper. Alternate #3: (RECOMMENDED ALTERNATE) * 8' shoulder; guardrail at bridge approaches only; 2:1 embankment slopes behind guardrail; 3:1 embankment slopes elsewhere * Comments NCDOT guidelines do not require guardrail whenever fill slope is 3:1 or flatter. The City selected alternate #3 because it is the safest design. Guardrail is not required along the length of the fill embankment because the proposed slopes are 3:1. We have proposed 2:1 fill slopes behind the guardrail which is warranted at the bridge. Alternates #1 and #2 would require several hundred additional feet of guardrail. Barrier systems such as guardrail are hazards themselves, and AASHTO and NCDOT design guidelines recommend their use be minimized. HUMPHREY, ASSISTANT CITY ENGINEER, 600 EAST FOURTH STREET, CHARLOTTE, NORTH CAROLINA 28202-2844, has applied for a Department of the Army (DA) permit TO PLACE FILL MATERIALS INTO WETLANDS ADJACENT TO MCALPINE CREEK TO WIDEN AND MAKE IMPROVEMENTS TO OLD PROVIDENCE ROAD AT ITS INTERSECTION WITH SHARON VIEW ROAD IN CHARLOTTE, Mecklenburg County, North Carolina. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the U.S. Army Corps of Engineers. Plans submitted with the application show the proposed placement of approximately 200 cubic yards of fill into approximately 1/4 acre of wooded wetlands along 1,300 linear feet of Old-Providence Road where it crosses McAlpine Creek. The existing road shoulders would be widened an average of 10 feet to accommodate•a new turning lane on the east and a new sidewalk on the west side of the existing approach fills. Finished.side slopes would be increased from 2:1 to 3:1 to improve safety. All fill would be obtained from an upland source. The affected wetlands consist mostly of seasonally flooded, immature forest vegetated with green ash, American elm and box elder. Prior utility work has disturbed some of these wetlands on the north side of the creek. The purpose of the work is to add a turning lane to Old Providence Road at its intersection with Sharon View Road, construct a new sidewalk and improve public safety. Plans showing the proposed work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No DA permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (DEM) has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Any.person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. -2- ? The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The . decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important.resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies, 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. Generally, the decision whether to issue this DA permit will not be made until the DEM issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army permit serve as application to the DEM for certification. HUMPHREY, ASSISTANT CITY ENGINEER, 600 EAST FOURTH STREET, CHARLOTTE, NORTH CAROLINA 28202-2844, has applied for a Department of the Army (DA) permit TO PLACE FILL MATERIALS INTO WETLANDS ADJACENT TO MCALPINE CREEK TO WIDEN AND MAKE IMPROVEMENTS TO OLD PROVIDENCE ROAD AT ITS INTERSECTION WITH SHARON VIEW ROAD IN CHARLOTTE, Mecklenburg County, North Carolina. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the U.S. Army Corps of Engineers. Plans submitted with the application show the proposed placement of approximately 200 cubic yards of fill into approximately 1/4 acre of wooded wetlands along 1,300 linear feet of Old Providence Road where it crosses McAlpine Creek. The existing road shoulders would be widened an average of 10 feet to accommodate a new turning lane on the east and a new sidewalk on the west side of the existing approach fills. Finished side slopes would be increased from 2:1 to 3:1 to improve safety. All fill would be obtained from an upland source. The affected wetlands consist mostly of seasonally flooded, immature forest vegetated with green ash, American elm and box elder. Prior utility work has disturbed some of these wetlands on the north side of the creek. The purpose of the work is to add a turning lane to Old Providence Road at its intersection with Sharon View Road, construct a new sidewalk and improve public safety. Plans showing the proposed work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No DA permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (DEM) has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. W 21993 M -2- The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies, 4Q4(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, .a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. Generally, the decision whether to issue this DA permit will not be made until the DEM issues, denies, or waives State certification required by Section 401 of the Clean Water Act. Wayne Wright's letter dated April 26, 1993 to Mr. J. G. Humphrey, requesting additional information necessary for the Corps to process our 404 permit application. There is negligible cost difference between constructing 2:1 slopes with guardrail along the top of the fill embankment, versus our original proposal of constructing 3:1 side slopes with no guardrail. Both alternatives meet established design guidelines. Since constructing 2:1 slopes would impact the wetlands less than constructing 3:1 slopes, the City has revised its design. Although the new design produces a wider shoulder width at road level due to setback requirements for guardrail, the toe of slope does not extend out as far as it would with 3:1 slopes. The attached drawings reflect the new design. Note that the area of wetlands being filled is now approximately 8707 SF (.20 acres), compared to about 12,234 SF (.28 acres) with our original proposal.
