Upon review of your request for 401 Water Quality
Certification to place fill material in wetlands or waters which
are tributary to Thompson Fork, Nix Creek, Cane Creek, Mackey
Creek and Catawba River for fiber optic cable located near Marion
and Old Fort, N.C. in McDowell County as described in your
submittal dated 22 March 1993, we have determined that the
proposed fill can be covered by General Water Quality
Certification No. 2664 issued January 21, 1992. A copy of the
General Certification is attached. This Certification may be
used in qualifying for coverage under Corps of Engineers'
Nationwide Permit No. 12.

SUBJECT: A review of an application by
to install buried fiber optic
Burke and McDowell Counties
Dear Mr. Chapin:
Southern Bell Telephone
cable line along US 70,
Southern Bell Telephone, represented by Mr. Baxter Hayes, is
requesting a letter of concurrence from the North Carolina
Wildlife Resources Commission (NCWRC) to obtain a 404 permit from
the U.S. Army Corps of Engineers. The NCWRC has reviewed
information provided by the applicant, and field biologists on
our staff are familiar with habitat values of the project area.
These comments are provided in accordance with provisions of the
Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C.
661-667d).
The applicant proposes to install buried fiber optic cable
line along SR 1400 and US 70 in McDowell County starting at the
Buncombe-McDowell County line and continuing along US 70 to just
east of Parkhill in Burke County. Numerous streams supporting
trout will be crossed, and nine wetland areas associated with
streams will be impacted. The applicant proposes to restore
wetland areas to pre-project contours.
The NCWRC does not object to this project, provided the
applicant implement the following modifications:
1) A 25-foot undisturbed vegetated buffer zone should be left
between land disturbing activities and streams running
parallel to this work. This will minimize sedimentation
into streams, preserve riparian vegetation that stabilizes

stream banks, and maintain a travel corridor for wildlife.
Where a 25-foot buffer zone is not feasible, sedimentation
control measures should be especially stringent between
streams and construction activities.
Fiber optic cable should be buried in the substrate at
stream crossings so as not to block fish passage and collect
debris.
3) If concrete will be used, construction must be accomplished
so that wet concrete does not contact water of live streams.
This will lessen the chance of altering water chemistry and
causing a fish kill.
4) Excavated material should be stockpiled away from streams.
5) Riparian vegetation, especially trees, should be preserved
as much as possible at stream crossings. Trees that must be
removed should be cut near ground level, leaving the stump
and roots in the bank for stability and to possibly sprout.
6) Natural materials should be used as much as possible to
restore stream banks at crossings. Riprap may be used on
the stream bank below the high water mark, but vegetation
should be used for stabilization above high water.
7) Permanent herbaceous vegetation in disturbed areas should be
established within 15 days of ground disturbing activities
to provide long term erosion control. We prefer a "seed as
you go" strategy rather than allowing a large amount of soil
to lay bare.
