As of today, we have not received a response to our earlier letter. Unless we receive a written response from you by 29 October 1993, we will consider that you have withdrawn this application and are not interested in pursuing the project at this time. O. Box 27687 Raleigh, NC 27611 Dear Mr. Mills: The purpose of this letter is to request a Section 401 Water Quality Certification for the.project to be known as Gold Leaf Plaza. The project is located in Smithfield. NC sJohnston Count and is bordered by Highway 301, Buffaloe Creek and the Seaboard Railroad as shown on the enclosed plans. Our firm has performed a detailed wetland delineation of the wet- lands on the property. We have also had these delineations approved by Mr. Ken Jolly of the U S Army Corps of Engineers. Upon receiving our Water Quality Certification, we will then proceed with obtaining the necessary Corps permits. Fill in the wetlands will be required to utilize the property for a shopping center as shown on the enclosed plans. As you can see, uplands on the property have been completely utilized in order to minimize wetland impacts as much as possible. The original plans (copy attached) called for a total of 4.06 acres of wetland to be filled (2.26 acres of forested wetlands, 1.80 acres.of wetlands in abandoned agricultural fields and/or wetlands previously impacted during the widening of Highway 301). After meeting with Mr. Ron Ferrell (DEM Regional Office), he stated concerns that proposed fill would encroach closer than 25' from Buffalo Creek and that.stormwater from the parking let would be dis- charged directly into the creek. After S&EC relayed these concerns to Plaza Associates, they immediately requested that Ragsdale Con- sultants work with them to address Mr. Ferrell's concerns. As a result, the plans were modified (see attached plans) to maintain a minimum of 25' vegetated buffer from Buffalo Creek. This was accomplished by omitting 40 parking spaces from the plans, reducing available retail space by 1,000 square feet, shifting the entire project as far "uphill" as possible and offsetting the theater entrance. Parking is?now at minimum allowed by Smithfield. Con- siderable negotiation-with potential tenants was required in order to get their approval on these changes. Stormwater discharge concerns will be addressed by placement of "created wetland" filters behind sediment basins and/or at discharge Soil/Site Evaluat ion, Mapping and Physical Analysis Wetland Mapping and Mitigation. This seems to have "dried" up the area considerably. In fact, in April of this year, during our initial work, the water table was greater than 4' below land surface in the forested "wetland" adjacent to Buffalo Creek. Therefore, it is likely that a significant portion of the jurisdictional wetlands presently claimed on-site no longer meet the wetland hydrology criteria. Unfortunately, due to time constraints of this project, our client does not have a year (or possibly longer) to monitor the water table in order to have the area reclassified as non-wetland. So for the purposes of this project, we will assume the area indicated on the maps as wetland based on soils and vegetation does have wetland hydrology. Copies of the Corps required delineation. fdtms completed on-site are attached for your information. These forms contain information on soils, hydrology and. vegetation observed on-site. _We have also discovered that the North Carolina Division of Trans- portation would like to construct a road from the intersection of Booker Dairy Road and US 301 across the property (through the wetland area) to the access road adjacent to Interstate 95. It is likely that this road will be installed, filling these wetlands, especially if the shopping center is not constructed. The revised project development plans will require fill in a.total of 3,77 acres of jurisdictional wetland above headwaters. There will be 2,c m acres of fill in forested wetlands and 1,7f acres of fill in abandoned agricultural fields and/or areas previously impacted by the widening of Highway 301. You originally issued SAW26-90-69 in August 1990 (see copy attached). Therefore, unless reauthorized,. our client must have completed work in permitted wetland areas prior to January 13, 1993. Our understanding is that the permit is expired and must be reauthorized. Due to the "slow" commercial real estate market over the last few years this project has moved more. slowly than our client had hoped. Based on current.market conditions, our client should be able to complete the project within the time limit allowed under a new Nationwide 26. The May 1990 Corps approved wetland delineation is shown on the attached map. It has been our experience that delineations performed utilizing the 1989 manual resulted in larger wetland areas than those utilizing the 1987 manual. We would like to emphasize that the 1990 delineation probably indicates more wetland area than `exists under current rules However, to save the client time and money we felt it would be better to utilize the old delineation since the original permit was authorized utilizing it. It seems senseless for our client to incur additional costs of delineation and surveying for the sake of reducing impacts "on paper" As you can see, the proposed impacts have not changed from the original application. The Water Quality Certification from DEM issued in July 1990 is attached. The property is bordered by Highway 301, Buffalo Creek and the Seaboard Railroad, as shown on the enclosed vicinity map. A completed Permit application form is attached as per current rules. Please note that the address and name of the permittee are different than on the original application but the same person still owns the site (Dr. Booker).
