Box 3136 Greensboro, N.C. 27402-3136 Ad03 31lj Dear Mr, Shaw: You have our approval to place fill material in 0.02 acres of wetlands or waters for the purpose of installing sanitary sewer lines across a small tributary system at Lynwood Lake and along Lynwood Drive, as you described in your revised application dated 6 September 1995. After reviev,ing your application, we have decided that this fill is covered by General Water Quality Certification Number 3022. This certification allows you to use Nationwide Pennit Number 12 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application, If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. This , Certification replaces the one issued in January of 1992. In addition, you should get any other federal, state or local pennits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing, You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which confonns to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O, Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are fmal and binding unless you ask for a hearing. This letter completes the review of the Division of Environmental Management under Section 401 of the Clean Water Act. C. 27626-0535 Attn: Mr. John Dorney Gentlemen: In 1993, a Section 404 Nationwide permit and a 401 Water Quality Certification were issued for a sewer line adjacent to an unnamed tributary to Little Alamance Creek (Lynwood Lake). This was Action ID 199303969 and Nationwide Permit No. 12. The 401 certification was No. 2664 issued January, 1992. Of the total lineal feet of sewer line proposed for installation along the Lake, 2,794 L.F. has been shifted to a street (Lynwood Drive). A total of 1,378 L.F. of the previously permitted and certified line will now be installed instead of the 4,172 L.F., as originally approved. Attachments to the Action ID 199303969 consisting of proposed tributary crossings at Stations 15+40, 24+60 and 33+50 have been eliminated from construction. The sewer line containing these crossings has been relocated to Lynwood Drive. The proposed tributary crossing at Station 43+25 will be constructed. The tributary crossing at Station 3+24 by Hunters Ridge Outfall sewer and the relocation of approximately 50 linear feet of drainage ditch in the vicinity of Station 4+00 have been completed. In order to eliminate the originally proposed 2,794 L.F. of outfall along the Lake encompassing the 3 tributary crossings, an outfall sewer is proposed to be extended from Station 33+96 to Lynwood Drive and a pumping station cons'tructed on the opposite side of Lynwood Drive. Attachments to the new Nationwide Permit request and Section 401 Certification include 8 1/2" x 11" Plan Sheets for the outfall sewer extension to Lynwood Drive and the pumping station site. Reference is also made to the site visit conducted on July 15, 1993, by Mr. John Thomas of the Raleigh Regulatory staff at the site of the proposed sewer outfall project. The purpose of the site visit was to review plans for the aforementioned project, and to inspect the site for waters and wetlands subject to Department of the Army permitting authority. The site visit revealed and the plans/pr~files for the aforementioned project provided with a notification application form showed that you propose construction for the aforementioned sanitary sewer below natural grade within a 40' construction easement adjacent to an unnamed tributary to Little Alamance Creek (Lynwood Lake). Also your plans and profiles show other sections of proposed sewer outfall either located on high ground or elevated over waters of the United States without discharge of fill into regulated areas. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR) , Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to Section 404 of the Clean Water A~t, was provided for the discharge of material for backfill or bedding for utility lines, including outfall and intake structures, provided there is no change in pre-construction contours. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. Please be aware that this authorization does not relieve you of the responsibility to obtain any other required or local approval. You should contact Mr. John Dorney, North Carolina Division of Environmental Management, (919) 733-1786, to obtain the necessary Section 401, Water Quality Certification prior to starting work. -2- This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. If during the 2 years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit will remain authorized provided the activity is completed within 12 months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-casebasis to modify, suspend, or revoke the authorization.
