Upon review of your request for 401 Water Quality Certification
to place fill material in 0.66 acres of wetlands or waters which are
tributary to Horse pen Creek for road crossing and utility crossing
located at Sedge field, Ragney and Swim Club in Guilford County as
described in your submittal dated 28 July 1993, we have determined
that the proposed fill can be covered by General Water Quality
Certification Nos. 2664 & 2671 issued January 21, 1992. Copies of the
General Certifications are attached. These Certifications may be used
in qualifying for coverage under Corps of Engineers' Nationwide Permit
Nos. 12 & 14.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

Enclosed please find Koury Corporation's initial request for a Nationwide Wetlands Permit for
property west/north of Trailwood Lane (see location map). Koury Corporation is in the process
of developing plans for a residential/golf community located south of their existing "Sedgefield
Section Eleven Subdivision". The preliminary concept proposes extending Robeson Road in
Section Eleven to meet the existing Tarr Road at the intersection of Trailwood Lane in order to
facilitate future access.
The first phase of this project includes the relocation and construction of a "new" racquet and
swim club to replace an old, obsolete facility currently located on Tarr Road. The proposed site
(see location map) provides close proximity to the "old" site, gentle topography for facilities, and
requires only a reasonable extension of roadways and utilities to the site. Moreover, this location
is ideal because it easily isolates the new club from any future developments because of the
existing Duke Power Easement and the proposed roadway extensions.
As plans become more defined for the balance of Koury Property, a more complete and
comprehensive wetland application will be submitted In the mean time, Koury Corporation has
contractually agreed in the purchase contract to open the new racquet/swim club by March 1,
1994. Permitting for this facility, therefore, must move forward if this schedule is to be met.

Please reference your field meeting of February 4, 1993, with Messrs. John
Thomas and Ken Jolly of my staff at the Koury Corporation property located of
Pinetop Street, adjacent to an unnamed tributary of Horsepen Creek,
Greensboro, Guilford County, North Carolina. The purpose of these meetings
was to conduct field delineations of wetlands subject to Department of the
Army permitting authority. This letter also confirms the May 3, 1993 wetlands
survey verification.
Based upon previous onsite inspections and review of the aforementioned
survey, we recognize this surveyed alignment to be the limits of our
regulatory jurisdiction on the property. Unless there is a change in the law
or our published regulations, this determination of the limits of wetlands may
be relied upon for a period not to exceed 3 years.
Please be reminded that no excavated or fill materials may be placed in
any waters or wetland areas without prior Federal permit authorization. Please
contact this office for any future proposed impacts in any water or wetland
areas subject to Department of the Army permitting authority.

12. A new racquet and swim facility is proposed along the extension of existing Robeson and
Tarr Roads (public roads). Approximately 20 single family lots and a regional stormwater
detention facility are also proposed. Water and sanitary sewer lines will be extended to
all future lots and the swim club.
13. This project is the first step (phase) in replacing the `old' Sedgefield Racquet/Swim Club
with a new facility. Koury Corporation has contractually agreed to open the club by
March 1994. This timely move will facilitate the development of Koury property west
of existing Tarr Road. A wetlands plan for the balance of Koury Corporation land will
be submitted at a later date inclusive of this request.
14. Stormwater management is required for any development in Guilford County. The
`concept' management plan (based on watershed size and less than 50% impervious
surface) utilizes regional wet detention basins as required by Guilford County. One such
facility is proposed at the lowest point on Koury property along the Tan Road extension.
This site is the eastern most location for capturing all the watershed's stormwater for
controlling flooding and water quality.
