Highway 42 East Clayton, North Carolina 27520 Dear Mr. and Ms. Finch: On July 14, 1993, Ms. Jean Benton of my Raleigh Field Office staff met with you and Mr. Kyle Richter on your property on Lot No. 2-D and No.3-D, on Queen Ann Drive, Neuse Colony Subdivision, adjacent and below the headwaters of the Neuse River, east of Clayton, Johnston County, North Carolina. The purpose of the meeting was to determine the presence of wetlands subject to our regulatory jurisdiction pursuant to Section 404 of the Clean Water Act and whether any Department of the Army (DA) permit would be required for your proposed construction of a sewerline. During this meeting,-it was determined that no wetlands will be impacted by the proposed septic drainage field. However, it was observed that a small area of wetlands will be impacted with the construction of the sewerline. Enclosed are copies of two Wetland Determination Forms, providing specific information obtained at stations on your property. The data on these forms support the delineation of wetlands on your site. Ms. Benton also spoke with you regarding the proposed construction of six ponds. Ms. Benton informed you that the construction of these ponds will require that DA authorization be obtained prior to the commencement of construction activities. Issuance of DA authorization must precede any placement of excavated or fill material within any wetlands on your property. Unauthorized activity would be a violation of Federal law. Before you undertake any work, we strongly suggest that the wetlands be surveyed and platted on a property map. Such mapping would help you avoid any unintentional disturbance of wetlands on the site and would assist your planning and be essential to any application for a permit which you might submit. Surveyed wetland lines, shown on property maps, must be field verified and confirmed in writing by our staff to be acceptable. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, -2- pursuant to Section 404 of the Clean Water Act, was provided for the discharge of material for backfill or bedding for utility lines, including outfall and intake structures, provided there is no change in pre-construction contours. Your proposed sewerline is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management (NCDEM). You should contact Mr. John Dorney, telephone (919) 733-1786,, regarding water quality certification. This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. If during the 2 years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit will remain authorized provided the activity is completed within 12 months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization.
