Dear Mr. Self:
Reference your application of June 7, 1993, for Department of the Army
(DA) authorization to construct a 12 inch force main, utilizing a cofferdam to
dewater the construction area, within the Neuse River, south of U.S. Highway
70 Business, Smithfield, Johnston County, North Carolina.
In regards to your proposed sewerline crossing, on April 1, 1988, we
renewed general permit no. 198100049, (copy enclosed) that authorizes the
maintenance, repair and installation of aerial and subaqueous utility lines
with attendant structures and the discharge of excavated or fill materials,
within construction/access corridors, associated with utility line
maintenance, repair and installation in navigable waters and waters of the
United States in the State of North Carolina. Your proposed sewerline
installation is authorized if you can comply with all general permit
conditions. Please read the enclosed permit to prevent an unintentional
violation of Federal law.
In regards to your proposed cofferdam construction, for the purposes of
the Corps of Engineers' Regulatory-Program, Title 33, Code of Federal
Regulations (CFR), Part 330.6, published in the Federal Register on November
22, 1991, lists nationwide permits. Authorization, pursuant to Section 10 of
the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was
provided for temporary structures and discharges, including cofferdams,
necessary for construction activities or access fills or dewatering of
construction sites; provided the associated permanent activity was previously
authorized by the Corps of Engineers or the U.S. Coast Guard, or for bridge
construction activities not subject to Federal regulation.
Your proposed cofferdam is authorized by this nationwide permit provided
it is accomplished in strict accordance with the enclosed conditions and the
following special provision:
To protect anadromous fishery resources, no construction may occur within
the Neuse River during the period March 15 through June 15 of any year.

This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this.verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.
Please be reminded that the above authorizations do not relieve you of the
responsibility to obtain other required State or local approval.

Upon review of your request for 401 Water Quality Certification
to place fill material in 0.1 acres of wetlands or waters which are
tributary to Neuse River for sewer force main located at US 70 in
Smithfield in Johnston County as described in your submittal dated 2
July 1993, we have determined that the proposed fill can be covered by
General Water Quality Certification Nos. 2664 & 2727 issued January
21, 1992. Copies of the General Certifications are attached. These
Certifications may be used in qualifying for coverage under Corps of
Engineers' Nationwide Permit Nos. 12 & 33.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

By this letter we are hereby requesting to construct a 12 inch force main within
the Neuse River at Smithfield in accordance to the requirements of Nationwide
Permit No. 12 and 33. As discussed during our site meeting May 28, 1993,
construction will not impact Corps of Engineers Jurisdictural Wetlands.
However, construction within the Neuse River will effect regulated and navigable
waters of the U.S. You will find attached reduced copies of the referenced site,
as well as a 1" = 40 scale plan view of the project site. The following presents
a written description of the project and a restoration plan as required by
Nationwide 33.
Project Description
The project entails the extension of a 12" force main from a pump station located
SUITE 117 at Miles, Inc., in Clayton to the existing 24" sanitary sewer outfall located on the
BUILDING I east side of the Neuse River. The purpose of the force main is to reduce
wastewater flows to the Town of Clayton Treatment Plant from the industrial
5625 DILLARD ROAD facilities located on the east side of Clayton.

The 12" force main will be installed below grade across the Neuse River at a
minimum depth of 24" to provide adequate cover. Within the river, 12" ductile
iron bell joint pipe shall be utilized. Upon crossing the river, the 12" force main
will tie into a new manhole located over the existing 24" force main
approximately 125' south of the US 70 east edge of payment.
The temporary construction easement will be 40 feet in width. The permanent
easement will be 20 feet.
Construction Plan
Actual construction technique will depend upon contractor. It is possible that the
river bottom is such that the trench may be dredged and dewatering will not be
necessary. Due to the uncertainty, we have presented the most likely construction
operation (sheet piling) in the following.
Construction of the force main within the river may require a cofferdam in order
to create "dry" conditions in which to lay the pipe. Due to the high water
velocities and the relatively narrow crossing width, we anticipate that the
cofferdam will be created by utilizing steel sheet piling. Sufficient water depth
exists such that installation of the sheet piling may be by barge mounted
equipment. The sheet piling will extend 60 in length into the river and be of
sufficient height to project above the river water surface at the time of
installation.
Construction will involve driving the sheet pile into the bottom of the river,
achieving a watertight seal, dewatering by pumping and excavation by barge
motinted crane with a clam shell or a drag line from the bank. Upon excavation,
the- ball joint ductile iron pipe will be floated into the river and placed in the
trench. Construction will progress in a staged manner from each bank to the
center of the river or approximately 60 feet. This will allow for approximately
50 percent of the river channel to be unobstructed at all times.
Excavated material will be removed from the river and placed on the river bank
for removal from the project site. The trench will be 36 inches wide and 36"
deep to bottom of pipe. The trench will be backfilled 24" (depth) to the top of
pipe with Class I Rip Rap such that proposed grades will be the same as existing
grades.
Rip Rap was selected for backfill because it offers immediate stabilization to the
disturbed areas, would minimize streambank degradation in the disturbed areas,
and would eventually allow for conditions to return to their natural state. And
finally, rip rap presents the least impact on the existing natural environment.

Restoration Plan
Restoration of the crossing as described above will be minimal. Upon placement
of the pipe, and covering with rip rap as described above, the sheet piling will be
removed. Disturbed areas will be restored to the existing conditions as close as
possible and stabilized by reseeding.
As previously noted, several construction alternatives exist. As such, it is
possible that a rip rap berm may be utilized in lieu of sheet piling or possibly
instead of a barge. If utilized in lieu of sheet piling, the berm will be lined with
a synthetic watertight liner such that the trench may be dewatered. As previously
discussed above, construction of the berm will proceed in a staged manner from
each bank with 50% of the river channel being left unobstructed at all times.
Placement and removal of the rip rap berm from the river will be by crane with
a clam shell bucket. The rip rap berm will be removed completely once
construction is completed and grades will be restored to existing conditions.
Obviously, if this alternative for construction is selected considerably more fill
(rip rap) will be placed into the river. Most of this rip rap will be removed
during restoration. The river bottom and slopes will be restored to existing grade
such that the river channel will have 100 percent of its natural flow capacity.

By this letter we are hereby requesting to construct a 12 inch force main within
the Neuse River at Smithfield in accordance to the requirements of Nationwide
Permit No. 12 and 33. As discussed during our site meeting May 28, 1993,
construction will not impact Corps of Engineers Jurisdictural Wetlands.
However, construction within the Neuse River will effect regulated and navigable
waters of the U.S. You will find attached reduced copies of the referenced site,
as well as a 1" = 40 scale plan view of the project site. The following presents
a written description of the project and a restoration plan as required by
Nationwide 33.
Project Description
The project entails the extension of a 12" force main from a pump station located
at Miles, Inc., in Clayton to the existing 24" sanitary sewer outfall located on the
east side of the Neuse River. The purpose of the force main is to reduce
wastewater flows to the Town of Clayton Treatment. Plant from the industrial
facilities located on the east side of Clayton.
The 12" force main will be installed below grade across the Neuse River at a
minimum depth of 24" to provide adequate cover. Within the river, 12" ductile
iron bell joint pipe shall be utilized. Upon crossing the river, the 12" force main
will tie into a new manhole located over the existing 24" force main
approximately 125' south of the US 70 east edge of payment.
The temporary 42 tion easement will be 40 feet in width. The permanent
easement will 0 f t.
Construction Plan
Actual construction technique will depend upon contractor. It is possible that the
river bottom is such that the trench may be dredged and dewatering will not be
necessary. Due to the uncertainty, we have presented the most likely construction
operation (sheet piling) in the following.
Construction of the force main within the river may require a cofferdam in order
to create "dry" conditions in which to lay the pipe. Due to the high water
velocities and the relatively narrow crossing width, we anticipate that the
cofferdam will be created by utilizing steel sheet piling. Sufficient water depth
exists such that installation of the sheet piling may be by barge mounted
equipment. The sheet piling will extend 60 in length into the river and be of
sufficient height to project above the river water surface at the time of
installation.
Construction will involve driving the sheet pile into the bottom of the river,
achieving a watertight seal, dewatering by pumping and excavation by barge
motinted crane with a clam shell or a drag line from the bank. Upon excavation,
'the-.ball joint ductile iron pipe will be floated into the river and placed in the
trench. Construction will progress in a staged manner from each bank to the
center of the river or approximately 60 feet. This will allow for approximately
50 percent of the river channel to be unobstructed at all times.
Excavated material will be removed from the river and placed on the river bank
for removal from the project site. The trench will be 36 inches wide and 36"
deep to bottom of pipe. The trench will be backfilled 24" (depth) to the top of
pipe with Class I Rip Rap such that proposed grades will be the same as existing
grades.
Rip Rap was selected for backfill because it offers immediate stabilization to the
disturbed areas, would minimize streambank degradation in the disturbed areas,
and would eventually allow for conditions to return to their natural state. And
finally, rip rap presents the least impact on the existing natural environment.

Restoration Plan
Restoration of the crossing as described above will be minimal. Upon placement
of the pipe, and covering with rip rap as described above, the sheet piling will be
removed. Disturbed areas will be restored to the existing conditions as close as
possible and stabilized by reseeding.
As previously noted, several construction alternatives exist. As such, it is
possible that a rip rap berm may be utilized in lieu of sheet piling or possibly
instead of a barge. If utilized in lieu of sheet piling, the berm will be lined with
a synthetic watertight liner such that the trench may be dewatered. As previously
discussed above, construction of the berm will proceed in a staged manner from
each bank with 50% of the river channel being left unobstructed at all times.
Placement and removal of the rip rap berm from the river will be by crane with
a clam shell bucket. The rip rap berm will be removed completely once
construction is completed and grades will be restored to existing conditions.
Obviously, if this alternative for construction is selected considerably more fill
(rip rap) will be placed into the river. Most of this rip rap will be removed
during restoration. The river bottom and slopes will be restored to existing grade
such that the river channel will have 100 percent of its natural flow capacity.
