Box 2755 Hendersonville, NC 28793 Re: Compliance Inspection of the Proposed Shopping Center off US 25 and Old Asheville Highway Dear Mr Morris: On March 15, 1995 you were issued General Water Quality Certification No. 2671 authorizing 0.9 acres of wetland impacts needed to develop a shopping center off US 25 and Old Asheville Highway in Henderson County. As part of an ongoing compliance monitoring and enforcement program for 401 Water Quality Certifications, Mike Parker from the Division's Asheville Regional Office and myself made a compliance inspection of the project site on March 18, 1997. From our inspection it appears that no work on the project has been started and no wetlands have been impacted. Please be aware that your Nationwide Permit from the US Army Corps of Engineers (USACOE) has likely expired and if so, your 401 Water Quality Certification will have expired also. You should contact the USACOE Asheville field office to see if you need to renew your authorization to impact the wetlands on your project site. Should you need to reapply for USACOE authorization you will also need to reapply for the 401 Water Quality Certification. As of October 1 1996, North Carolina Administrative Code 15A NCAC 2H.0506 now requires compensatory mitigation for wetland impacts which total greater than one acre in size. Your cooperation in adhering to the conditions of your 401 Water Quality Certification is appreciated. Based on this review, we have determined that the proposed fill is covered by General Water Quality Certification No. 2671. A copy of the General Certification is attached. This Certification is necessary for coverage under Corps of Engineers' Nationwide Permit No. 26. This action completes DEM's review under Section 401 of the Clean Water Act. Stormwater shell be managed as described in your 9 March 1994 submittal. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the office of Administrative Hearings, P.O. Dorney Request for 401 Certificate i+ WErtAPCI ? ; ???Ar?R u??rr? ? : On behalf of North 25 Associates, we respectfully request approval of the prior petition for 40? certification to permit filling the dry pond bed located at the southeastern corner of the enclosed plat map. As you perhaps will recall this commercial site was purchased with the intent to fully develop all the acreage by providing access to the southeastern section by ingress and egress over Lake Drive. As legal research now reveals, such is not possible. Access must be provided from Old Asheville Highway. (S.R. 1536) Adjacent to the planned access drive a hardware store is planned. (See enclosed approval by North Carolina Department of Transportation) Without this rear access, the cost of development will soar, while the finished center will be less valuable. Also, projectively, an unsafe traffic hazard will be created because the motoring public will try to use the inadequate adjacent private gravel drive to gain access to the center. Please also take into consideration that this type of shopping is unavailable to residents of this area; the closest shopping (other than highly priced convenience stores) being 4.5 to 5 miles distant. Dorney May I also point out that the wetland involved here is an artificially created lakebed which has been drained for at least eight to ten years. We expect approval to be conditioned upon an approved storm and ground water control system to ensure lower riparian users will not be adversely effected and in fact will have improved water quality. We also expect to make extensive use of vegetation and ground cover along railroad and highway corridors. We thus expect your approval will be conditioned on vegetative and groundwater controls. Your usual careful and courteous consideration of this request shall once again be greatly appreciated. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a section 401 water quality certification from the North Carolina Division of Environmental Management (NCDEM). This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. READER FILE The Division of Environmental Management, Water Quality Section has reviewed your plans for wetland fill for 0.9 acres of wetlands at SR 1536 across from Brick Works in Henderson County for commercial development. Based on this review, we have identified significant uses which would be removed by this project. These uses are pollutant removal and streambank stabilization. Furthermore, insufficient evidence is present in our files to conclude that your project must be built in wetlands. Therefore, we are moving toward denial of your 401 Certification. Until we receive additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your project on administrative hold. Please provide us with information supporting your position that your project must be constructed as planned. Specifically can you construct your commercial development without filling wetlands? Any documentation such as maps and narrative which you can supply to address upland alternatives may be helpful in our review of your 401 Certification.
