Dear Mr. Horton:
Reference your application of March 18, 1993, for Department of the Army
authorization to install a water line across Jones Cove Branch to serve the
Haywood County Materials Recovery Facility in Waynesville, Haywood County,
North Carolina. The project has been reviewed by the NC Wildlife Resources
Commission (WRC) for any potential adverse impacts to trout waters.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization, pursuant to Section 404 of the Clean Water Act, was provided
for the discharge of material for Backfill or bedding for utility lines,
including outfall and intake structures, provided there is no change in pre-
construction contours.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions. In addition,
no wet concrete should be allowed to contact the water in Jones Cove Branch.
This nationwide permit does not relieve you of the responsibility to obtain
any required State or local approval. Information regarding issuance of a
Section 401 Water Quality Certification may be obtained through John Dorney,
Division of Environmental Management, at [phone].
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain

authorized provided the activity is completed within 12 months of the date of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.

Certification to place fill material in 0.005 acres of wetlands
or waters which are tributary to Jones Cove Branch for water line
located at Jones Cove Road in Haywood County, we have determined
that the proposed fill can be covered by General Water Quality
Certification No. 2664 issued January 21, 1992. A copy of the
General Certification is attached. This Certification may be
used in qualifying for coverage under Corps of Engineers'
Nationwide Permit No. 12.

SUBJECT: A review of an application by Gary D. McKay for Haywood
County, to install a water line crossing of Jones Cove
Branch, Clyde, Haywood County.
Dear Mr. Johnson:
Mr. McKay is requesting a letter of concurrence from the
North Carolina Wildlife Resources Commission (NCWRC) to obtain a
404 permit from the U.S. Army Corps of Engineers. The NCWRC has
reviewed information provided by the applicant, and biologists on
our staff are familiar with habitat values of the project area.
An onsite investigation was conducted on March 23, 1993 to
further assesses potential construction impacts on wildlife and
fisheries resources. These comments are provided in accordance
with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et.
seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401,
as amended; 16 U.S.C. 661-667d).
Your office should be aware of the fact that other stream
disturbing activities have been done at this site without a
review by our agency. At least two culverts and several cross
drains have been installed for a new road to the construction
site. Erosion control measures do not appear adequate along this
road. The comments in this letter can be applied to this
activity if your office decides to handle this as an after-the-
fact permit.
Based on the information provided by the applicant, our site
visit, and our information on the range of trout in the project
area, we do not believe this project will cause significant
effects to waters supporting trout. Therefore, we do not object
to the project as proposed. However, we do request that the US

Army Corps of Engineers require that no wet concrete be allowed
to enter the stream and that erosion control measures be
installed and maintained until the site is stable.
