Reference is also made to my letter dated September 16, 1991, that confirmed the September 16, 1991, wetland survey verification of the aforementioned property. The review of the proposed development plans provided by Mr. James Covington of Alley, Williams, Carmen & Ring, Inc. (engineering consultant for the site) showed the proposed storm retention pond will impact 0.08 acres of waters and wetlands adjacent to, and above the headwaters of, an unnamed tributary to Lake Jeanette (Richland Creek). For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters provided: a. the discharge does not.cause the loss of more than 10 acres of waters of the United States; b. the permittee notifies the District Engineer if the discharge would cause the loss of waters of the United States greater than one acre in accordance with the "Notification" general condition. For discharges in special aquatic sites, including wetlands, the notification must also include a delineation of affected specific aquatic sites, including wetlands; and c. the discharge, including all attendant features, both temporary and permanent, is part of a single and complete project. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. This nationwide permit does not relieve you of the responsibility to obtain any required State or local approval. . -2- This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. If during the 2 years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit will remain authorized provided the activity is completed within 12 months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. As previously designed, pipe #7 as shown on the drawing was to be discharged directly into the spillway from Buffalo Lake. I have redesigned the storm sewer so that the runoff is discharged over the semi- wooded area adjacent to the creek that carries runoff from Buffalo Lake. This runoff will be allowed to disperse over this area and settle particles that may occur from storm water runoff leaving the parking lots of this office park. The three outlet pipes will only run a maximum of half full during the 10-year storm. The rip-rap pads will slow down this water so that settlement occurs over this semi-wooded area. As we discussed, you should route as much on-site stormwater as possible from the proposed medical park into a pond near the location of the temporary detention pond. I would encourage you to plan the pond with some shallow areas on the upper end which will then naturally vegetate and develop into wetlands. These wetlands will enhance the water quality and wildlife abilities of the pond. ..Once these plans have been developed and approved, I will be able to issue a-401 Water Quality Certification for the road (Nationwide Permit 14). The purpose of this meeting was to discuss proposed stream channel maintenance of the aforementioned tributary, and to-inspect the site for waters and wetlands subject to Department of the Army permitting authority. The meeting revealed that you propose to remove accumulated debris/ sediments from the aforementioned creek-at the end of the storm drainage pipe located under Baytree Drive to facilitate flows through the channel. No Department of the Army permits will be required to undertake the proposed work provided all spoil is placed and retained on high ground.
