Habitat Conservation Program DATE: April 1, 1993 SUBJECT: Division of Environmental Management 401 Water Quality Certification Review (193195) for the Town of Angier, Harnett County, North Carolina. Biologists on the North Carolina Wildlife Resources Commission (NCWRC) staff have completed a review of the proposed project and evaluated possible impacts on fisheries, wildlife, and wetland resources in the project area. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), Section 401-b of the Clean Water Act of 1977 (as amended) and North Carolina General Statutes (G.S. 113-131 et seq.). The applicant, the Town of Angier, is requesting 401 certification to excavate 6.3 ac of 404 wooded wetlands adjacent to West Buies Creek, Black River, and the Cape Fear River in Harnett County near Angier. The purpose of the project is installation of force mains and sanitary sewer line interceptors associated with construction of a new 0.5 MGD advanced secondary wastewater treatment facility. The NCWRC is concerned over impacts to fisheries, wildlife, and wetland resources within and adjacent to the proposed construction corridor. We are especially concerned about adverse impacts from sedimentation and turbidity on fisheries and wetland resources in and adjacent to all receiving waters. We have determined that the proposed work is inconsistent with our Policies and Guidelines for Conservation of Wetlands and Aquatic Habitat. As noted during previous correspondence (see EA attachment), we initially recommended a construction window of September 1 to January 1 to minimize potential negative impacts Af MEMO TO: John Dorney Page 2 April 1, 1993 of sedimentation and turbidity from construction on spawning activities of freshwater species (primarily sunfish and largemouth bass). These impacts are especially damaging during the spring and summer (during low water) and can also affect the production of aquatic food organisms and feeding of fish. Turbidity can be extremely stressful during summer periods of warm water temperatures and low water levels. Impacts would be greatest during low water and therefore all work should be suspended from March 1 to July 15, unless documentation can be provided indicating specific construction activities will not release appreciable amounts of sediment and turbidity. We would have no objections to the proposed project provided the contractor strictly adheres to Best Management Practices for construction activities on the project area and all proposed construction activities occur during the period of July 15 to March 1. We do not necessarily concur with that component of the proposed mitigation in the Environmental Assessment concerned with tree plantings. Our comments stated that a plant community successional stage should be reestablished on disturbed areas that would lead to habitat of equal or greater value over time than habitat prior to disturbance. Apparently, someone has determined that 22 mast producing trees per acre is adequate. However, we have not seen documentation regarding habitat quality, nor have we seen a mitigation plan providing the level of detail that would be required. Consequently, we can neither refute nor confirm the adequacy of the proposed mitigation. Since development of an acceptable mitigation plan can be done concurrently with construction and should not result in project delays, we believe that it is necessary to formalize such a plan. The force main from the proposed WWTF to the Cape Fear River is located in wetlands for approximately 1,000 FT to avoid a closed out landfill and then is located adjacent to roads for approximately 5.5 miles. The force main is located in wetlands for approximately 300 feet prior to the Cape Fear River as shown on Sheet C5. The wetlands shown on Sheet C5 appear to have been created by an access road crossing and could not be avoided due to the width of the wetlands. The gravity interceptor sewer is mainly located within the wetlands. The gravity sewer is required to be located near the low point in the watershed in order to serve the area by gravity. The wetlands are wide as shown on the enclosed plans and stated in the environmental assessment and the ground rises considerably outside the wetland area. Locating the gravity interceptor sewer outside the wetlands would have been cost prohibitive due to the increase in depth of the sewer. The interceptor sewer was determined to be the most cost effective means of serving the area in the future. Mitigation measures will be taken to minimize impacts to the wetlands during construction and in the future. The mitigation measures during construction will be the following: o Installation of sediment and erosion control measures; o Location of the interceptor sewer from the stream; o Minimum stream crossings; o Minimum clearing and grubbing; and o Compliance with conditions of the Nationwide Permit #12. The sediment and erosion control measures were located to minimize the amount of sediment which may enter the stream during construction. The interceptor sewer was located at least fifty (50) feet from the stream where possible. The interceptor sewer crosses the stream three (3) times. Two (2) of the crossings are due to a farm pond and adjacent farm land which prohibited the interceptor sewer from being located on the east side of West Buies Creek. The third crossing is required to move the interceptor sewer to the west side of the stream in order to connect with an existing road. The plans require the contractor to clear and grub only twenty (20) feet to install the interceptor sewer and up to forty (40) feet if needed. The Contractor is required to obtain approval from the Owner prior to clearing outside the initial twenty (20) feet. Additional mitigation measures are included in the Nationwide Permit #12, such as the placement of 6 to 12 inches of parent material at the top of the trench and to existing grades. The mitigation measures in the future include the planting of 17 trees per acre of swamp tupelo and 5 trees per acre of waste oak within the construction easement. The Town of Angier will also be including a "No Tap" policy in the sewer ordinance which will prohibit developments which construct within the floodplain to use the WWTF. In addition, the Town of Angier will maintain only ten (10) feet of the twenty (20) feet easement within the wetland areas for access. The meeting was very informative for me both in regards to the issues for the Town of Angier, but also as related to future processing preapplications for financial assistance and the State Review Process. I have attached herewith a copy of the engineer's response to the comments from the North Carolina Wildlife Resources Commission and the Division of Environmental Management who were respondents to the EA. All of the issues raised by the respondents with the exception of the alternative for treatment selected are addressed in the engineer's letter. The issue regarding the mitigation measures to be employed to restore disturbed wetlands, mast producing trees, does pose a difference in apparent views as to what is necessary and reasonable as related to restoration. Farmers Home Administration's view is that restoration of disturbed wetland areas should be in conformance with the Corps of Engineer's mitigation requirements under the GC 12, the EA mitigation measures for restoration as noted in REPORT TO N.C. DIVISION OF ENVIRONMENTAL MANAGEMENT (prepared as a part of the Harnett County Regional Wastewater Treatment Facility plan), dated April 9, 1991, prepared by Robert J. Goldstien & Associates, and a part of the FmHA EA, and the mitigation measures noted in the FmHA EA. The point of difference in the comments expressed by the Division of Environmental Management and the mitigation measures in the EA relate to number to tree plantings. The planting scale indicated in the FmHA EA appear in conformance with the COE mitigation of disturbed areas, and were apparently acceptable as included in the mitigation measures in the Goldstien EA. Agency - North Carolina Wildlife Resource Commission a. The sewer line has been located approximately 50-feet from the stream bank where possible and the number of stream crossings have been minimized. b. The plans require the Contractor to clear and grub only 20-feet for the construction of the sewer. However, if the sewer can not be built within- the 20-feet, the Contractor can clear- up to 40-feet. This policy is consistent with the COE General Permit No. 12. C. The chlorination and dechlorination will have a back up system. The Town of Angier is considering ultra violet light disinfection instead of chlorine. However, a decision has not been made at this time. d. Proposed construction will not be able to be limited between September 1 and January 1. The construction schedule currently anticipated is as follows: Gravity Sewer and Force Main: 7-25-93 to 7-25-94 Wastewater Treatment Plant: 7-25-93 to 7-25-94 The project will incorporate appropriate erosion sediment and erosion controls and is required to have a sediment and erosion control permit prior to construction. The sediment and erosion controls will minimize the amount of sediment into the receiving waters. 7. Agency - Division of Environmental Management, a. The Town of Angier has submitted an Amendment to the existing SOC to include the option of constructing a new Wastewater Treatment Facility. The Town of-Angier will adopt the-"no tap" policy. This is part of the Farmers Home Administration letter of conditions which has been agreed to by the Town of Angier. c. The 320 tree plantings per acre is the DEM Policy for creating new wetlands. The 22 tree plantings per acre in the FmHA EA were recommended to minimize impacts to existing wetlands, not create wetlands. The 22 tree plantings per acre along with the conditions set forth in the COE General Permit No. 12 should minimize the impacts to wetlands without creating unreasonable hardship to the project. The Town of Angier and Dewberry & Davis appreciate the opportunity to respond to the North Carolina State Clearinghouse comments. The comments from the various state agencies are generally reasonable and the current project incorporates most of the concerns raised. OWkER'S SIGNATURE DATE TOWN OFANGIER WASTEWATER TREATMENT FACILITY Joint Application for Nationwide Permit #12 Attachment A The force main from the existing wastewater treatment facility (WWTF) to the gravity interceptor sewer is located adjacent to an existing sewer line and roads. The force main from the proposed WWTF to the Cape Fear River is located in wetlands for approximately 1,000 FT to avoid a closed out landfill and then is located adjacent to roads for approximately 5.5 miles. The force main is located in wetlands for approximately 300 feet prior to the Cape Fear River as shown on Sheet C5. The wetlands shown on Sheet C5 appear to have been created by an access road crossing and could not be avoided due to the width of the wetlands. The gravity interceptor sewer is mainly located within the wetlands. The gravity sewer is required to be located near the low point in the watershed in order to serve the area by gravity. The wetlands are wide as shown on the enclosed plans and stated in the environmental assessment and the ground rises considerably outside the wetland area. Locating the gravity interceptor sewer outside the wetlands would have been cost prohibitive due to the increase in depth of the sewer. The interceptor sewer was determined to be the most cost effective means of serving the area in the future. Mitigation measures will be taken to minimize impacts to the wetlands during construction and in the future. The mitigation measures during construction will be the following: o Installation of sediment and erosion control measures; o Location of the interceptor sewer from the stream; o Minimum stream crossings; o Minimum clearing and grubbing; and o Compliance with conditions of the Nationwide Permit #12. The sediment and erosion control measures were located to minimize the amount of sediment which may enter the stream during construction. The interceptor sewer was located at least fifty (50) feet from the stream where possible. The interceptor sewer crosses the stream three (3) times. Two (2) of the crossings are due to a farm pond and adjacent farm land which prohibited the interceptor sewer from being located on the east side of West Buies Creek. The third crossing is required to move the interceptor sewer to the west side of the stream in order to connect with an existing road. The plans require the contractor to clear and grub only twenty (20) feet to install the interceptor sewer and up to forty (40) feet if needed. The Contractor is required to obtain approval from the Owner prior to clearing outside the initial twenty (20) feet. Additional mitigation measures are included in the Nationwide Permit # 12, such as the placement of 6 to 12 inches of parent material at the top of the trench and to existing grades. The mitigation measures in the future include the planting of 17 trees per acre of swamp tupelo and 5 trees per acre of waste oak within the construction easement. The Town of Angier will also be including a "No Tap" policy in the sewer ordinance which will prohibit developments which construct within the floodplain to use the WWTF. In addition, the Town of Angier will maintain only ten (10) feet of the twenty (20) feet easement within the wetland areas for access. KT:dh/a ngierwastewatertreatment.14
