Department of Transportation FerrV Division, 159 Lucinda Lane, Powells Point, NC 27966 Authorizing development in Brunswick/New Hanover County at C4pe Fear River at NCDOT FM Basin - , as requested in the permittee's application lettm dated 3/7/19 and 6/4/19, including the attached workplan drawing dated 5/20/19. This permit, issued on 7116/19 -, is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action, or may cause the permit to be null and void. 1) Unless specifically altered herein, this Minor Modification and Renewal authorizes the following activities: renew the active permit for 5 years, and place approximately 79 linear feet of additional riprap along the berm of the existing Southport Spoil Site, all as depicted on the attached workplan drawing. 2) In order to protect juvenile shrimp and finfish populations, no excavation or filling shall be allowed between April 1 and September 30 of any year. 3) No new vegetated wetlands shall be excavated or filled, without permit modification. NOTE: The new activities authorized by this Minor Modification will permanently impact approximately 0.03 acres of surface waters due to fill. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires fttrther Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Department of Transportation ADDITIONAL CONDITIONS Permit #561 Page 2 of 3 4) The placement of riprap shall be limited to the areas as indicated on the attached workplan drawings. The riprap material shall be clean and free from loose dirt or any pollutant except in trace quantities. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. The riprap material shall consist of clean rock or masonry materials such as but not limited to granite or broken concrete. 5) Filter fabric shall be in place prior to the placement of any riprap. 6) All materials resulting from regrading of the berm shall be confined above normal high water level and landward of regularly or irregularly flooded wetlands behind adequate dikes or other retaining structures to prevent spillover of solids into any wetlands or surrounding waters. Maintenance Clause 7) The Division of Coastal Management (DCM) shall be notified in writing at least two (2) weeks in advance of any maintenance work authorized by this permit, and again upon completion of the work, and such notification shall include: A. The number of the original dredge and fill pen -nit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. D. The date of plat revision and the permittee's signature shown anew on the original plan. NOTE: The location, design, and holding capacity of the spoil disposal site shall be approved by a representative of DCM prior to the initiation of any maintenance dredging activities. General 8) This project shall conform to all requirements of the NC Sedimentation Pollution Control Act and the N.C. Department of Transportation (NCDOT's) Memorandum of Agreement with the N.C. Division of Energy, Mineral, and Land Resources. 9) The permittee and/or its contractor shall contact the DCM Transportation Project Field Representative in Morehead City at (252) 808-2808 to request a preconstruction conference prior to project initiation. 10) If it is determined that additional permanent and/or temporary impacts are necessary that are not shown on the attached workplan drawings or described in the authorized permit application, a permit modification and/or additional authorization from DCM shall be required. In addition, any changes in the approved plan may also require a permit modification and/or additional authorization from DCM. The permittee shall contact a representative of DCM prior to commencement of any such activity for this determination and any permit modification. N.C. Department of Transportation ADDITIONAL CONDITIONS Permit #561 Page 3 of 3 11) The N.C. Division of Water Resources (DWR) authorized the proposed project on 6/27/19 (DWR Project No. 20190745) under General Water Quality Certification No. 4134. Any violation of the Certification approved by DWR shall be considered a violation of this CAMA permit. 12) This Minor Modification and Renewal does not eliminate the need to obtain any additional permits, approvals or authorizations that may be required. This includes approval, if required, from the U.S. Army Corps of Engineers. 13) This Minor Modification and Renewal shall be attached to the original of Permit No. 561, as well as all subsequent modifications and renewals, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. 14) All conditions and stipulations of the active permit remain in force under this Minor Modification and Renewal unless altered herein. NOTE: A minor modification and renewal application processing fee of $200 was received by DCM for this project.
