Roy for a permit to construct a private recreational fish pond within a wetland area adjacent to east fork Savannah Creek off SR 1313, Jackson County The North Carolina Wildlife Resources Commission (NCWRC) has reviewed the information provided by the U.S. Army Corps of Engineers, and biological field staff conducted a site visit on February 19, 1993. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d.). The applicant proposes to excavate a 60-foot by 90-foot pond at the northern end of an existing wetland. The pond will be fed by overflow from a spring house as well as by groundwater. An overflow pipe will return excess water to East Fork Savannah Creek. Excavation will be done to a depth of 6-7 feet and will be accomplished by trackhoe with the spoils being loaded into a dump truck and then placed on uplands between the pond and the Roy residence. The applicant proposes to enhance the remainder of the approximate 2.5-acre wetland for wildlife by planting a variety of native wetland species. The stated purpose of the project is to aesthetically improve the property and to provide habitat for fish and wildlife. East Fork Savannah Creek is a tributary to Savannah Creek, which is Designated Public Mountain Trout Water. East Fork Savannah Creek provides good habitat for populations of wild rainbow and brown trout. The existing wetland has been somewhat disturbed, but provides habitat for various species of mammals, birds, reptiles, amphibians, and invertebrates. The NCWRC does not object to the issuance of the permit, provided the applicant follows these conditions: 1) The pond outlet structure (standpipe) should be designed to release cool water drawn off the bottom of the pond. This will provide cooler water to East Fork Savannah Creek and prevent thermal pollution that can eliminate habitat for trout. 2) The NCWRC strongly recommends the maintenance of at least a 40-foot undisturbed vegetated buffer zone between pond excavation and East Fork Savannah Creek as shown on the figure included with the application. This will protect East Fork Savannah Creek from sedimentation. The NCWRC has the following additional recommendations: 1) While all of the wetland plant species proposed for planting in the wetland are native to North Carolina, the NCWRC would like to point out the some are not native to the mountains of the State. Examples are blue-hyssop, lizard's tail, blue. flag iris, and St. John's wort. The applicant may want to revise the plant list to include only those species native to western North Carolina. 2) The applicant states that the wetland will be planted to enhance wildlife habitat; however, some of the wetland plant species proposed for planting have little if any wildlife value. Examples are blue-hyssop and blue flag iris. The applicant may want to revise the plant list to focus on plant species that provide food and/or cover to wildlife, as this is a stated purpose of the project. ROY, RR 2, BOX 178, Sylva, NORTH CAROLINA 28779 has applied for a Department of the Army (DA) permit TO CONSTRUCT A PRIVATE RECREATIONAL FISH POND WITHIN A WETLAND AREA ADJACENT TO EAST FORK SAVANNAH CREEK OFF SR 1313, EAST FORK ROAD, Sylva, Jackson County, North Carolina. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the U.S. Army Corps of Engineers (USAGE). Plans submitted with the application show the excavation of a 60-foot x 90-foot pond at the northerly end of the wetland. The pond will be fed by overflow from a spring house as well as groundwater. An overflow pipe will return excess water to East Fork Savannah Creek. Excavation, to a depth of 6-7-feet, is to be accomplished by trackhoe with the spoils being loaded into a dumptruck and then dumped on upland property between the pond and the Roy residence. The applicant proposes to enhance the remainder of the approximate 2.5 acre wetland for wildlife by planting a variety of native wetland species (see list attached with project plans). The stated purpose of the work is to aesthetically improve the property and to provide habitat for fish and wildlife. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No DA permit will be issued until the coordinated State viewpoint-on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District 1 -2- Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity And Us ;nt nded use on the public interest Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be-expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern .r rri ?rri+z. - may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy•npeds, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies, 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials.; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the (USACE) to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether-to issue this DA permit will not be made until the North Carolina Division of Environmental Management (DEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the DA permit serves as application to the DEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental Management, Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such materials will be furnished to any person requesting copies upon payment of reproduction costs. The North Carolina Division of Environmental Management plans to take final action in the issuance of the Clean Water Act certification on or after March 15, 1993. On February 6, 1990, the DA and the U.S. Environmental Protection Agency (EPA) signed a memorandum of agreement (MOA) establishing procedures to determine the type and level of mitigation necessary to comply with the Clean Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding impacts to waters and wetlands through the selection of the least damaging, practical alternative; second, taking appropriate and practical steps to minimize impacts on waters and wetlands; and finally, compensating for any remaining unavoidable impacts to the extent appropriate and practical. To enable us to process your application in full compliance with this MOA, we request that you provide the following additional information: a. Permits for work within wetlands or other special aquatic sites are available only if the proposed work is the least environmentally damaging, practicable alternative. Please furnish information regarding any other alternatives, including upland alternatives, to the work for which you have applied and provide justification that your selected plan is the least damaging to water or wetland areas. b. It is necessary for you to have taken all appropriate and practical steps to minimize wetland losses. Please indicate all that you have done, especially regarding development and modification of plans and proposed construction techniques, to minimize adverse impacts. c. The MOA requires that appropriate and practical mitigation will be required for all unavoidable adverse impacts remaining after all appropriate and practical minimization has been employed. Army Corps of Engineers Public Notice Action I.D. #199301099 dated February 11, 1993 which describes a project proposal by Henry W. Roy of Sylva. The project, involving the construction of a recreational fish pond within a wetland area, is located adjacent East Fork Savannah Creek, in Sylva, in Jackson County. , During the course of the review, two key agencies submitted favorable comments. This office usually receives important comments from the Natural Heritage Program in projects of this type. To date, no comment has been received, therefore, we submit the following: Wildlife Resources Commission: - fol-md favorably and provided two recommendations that were made a part of the required permit. Two other recommendations were suggested in the Commission's memo- randum which is enclosed. Division of Environmental Management -issued the required Section 401 Water Quality Certification on March 18, 1993. Certification No. 2816 provides a turbidity standard to insure downstream water quality.
