Upon review of your request for 401 Water Quality Certification
to place fill material in 2.25 acres of wetlands or waters which are
tributary to Buck Branch for golf course residential development
located at,SR 1700 and N.C. 109 at the Meadow lands in Davidson County
as described in your submittal dated 30 August 1993, we have
determined that the proposed fill can be covered by General Water
Quality Certification No's. 2732 & 2671. Copies of the General
Certifications are attached. These Certifications may be used in
qualifying for coverage under Corps of Engineers' Nationwide Permit
No's. 14 & 26. An additional condition is that deed restrictions
shall be placed on all lots with wetlands (esp. 58,59 59,153,154,191
&
192) to prevent future fill, the restrictions shall run with the land
and state shall be listed as a beneficiary.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

Reference is made to field meetings of November 12, 1993, and December 3,
1992, with Mr. John Thomas of the Raleigh Regulatory Field Office and
Mr. Kevin Martin of Soil & Environmental Consultants, Inc. (consultant for
site) on site of your property know as the Meadowlands Project located off of
NC 109, adjacent to Brushy Creek, Wallburg, Davidson County, North Carolina.
The purpose of these meetings were to review field delineations of wetlands
subject to Department of the Army permitting authority. This letter also
confirms the August 24, 1993 wetlands survey verification.
Based upon previous on site inspections and review of the aforementioned
survey, we recognize this surveyed alignment to be the limits of our
regulatory jurisdiction on the property. Unless there is a change in the law
or our published regulations, this determination of the limits of wetlands may
be relied upon for a period not to exceed three (3) years.
Please be reminded that all discharges of dredged or fill materials in
water or wetlands of the United States must receive the prior approval of this
office in the form of a Department of the Army permit.

Reference is made to my letter of September 17, 1993. This letter
confirmed the August 24, 1993, wetlands survey verification of the proposed
Meadowlands Project located off NC 109, adjacent Brushy Creek, Wallburg,
Davidson County, North Carolina.
Reference is also made to the conceptual design and permit application
(PDN) for the aforementioned project received from Mr. Kevin C. Martin of Soil
and Environmental Consultants, Inc. (consultant for project) on September 29,
1993. This proposed project design showed jurisdictional impacts of
approximately 2.25 acres on Brush Creek and unnamed/above headwater
tributaries of Brush Creek.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits (NWP).
Authorization was provided, pursuant to Section 404 of the Clean Water Act,
for discharges of dredged or fill material into headwaters and isolated waters
provided:
a. The discharge does not cause the loss of more than 10 acres of waters
of the United States;
b. The permittee notifies the District Engineer if the discharge would
cause the loss of waters of the United States greater than one acre in
accordance with the "Notification" general condition. For discharges in
special aquatic sites, including wetlands, the notification must also include
a delineation of affected specific aquatic sites, including wetlands; and
c. The discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project.

Your proposed work, involving adverse modification to 2.25 acres of waters
of the United States located above the headwaters of the aforementioned
tributary, is authorized by NWP provided it is accomplished in strict
accordance with the enclosed conditions. Please be aware that this
authorization does not relieve you of the responsibility to obtain any other
required or local approval. You should contact Mr. John Dorney, North
Carolina Division of Environmental Management, [phone], to obtain the
necessary Section 401, Water Quality Certification prior to starting work.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the NWP authorization is reissued without modification or the activity
complies with any subsequent modification of the NWP authorization. If during
the 2 years, the NWP authorization expires or is suspended or revoked, or is
modified, such that the activity would no longer comply with the terms and
conditions of the NWP, activities which have commenced (i.e., are under
construction) or are under contract to commence in reliance upon the NWP will
remain authorized provided the activity is completed within 12 months of the
date of the NWP's expiration, modification or revocation, unless discretionary
authority has been exercised on a case-by-case base to modify, suspend or
revoke the authorization.

Dear Messers. Ferrel and Alsmeyer:
The purpose of this letter is correct some information given in
the application for Nationwide Permits 14, 26, and a Section 401
Water Quality Certification for the project known as the
Meadowlands, near Walburg, NC (Davidson County). The application
was dated August 30, 1993.
The total amount of wetlands to be impacted under Nationwide 26
was incorrectly reported as 1.98 acres. The correct amount is
2.17 acres instead (0.19 acres of wetland to be filled, area L1c,
were accidentally omitted when the total was calculated).
Please note that all other figures, including areas to be cleared
under NW 26 and impacts under Nationwide 14, were listed
correctly. The wetland area that was omitted was indicated
correctly on the plans which accompanied the permit application;
only the total impact was wrong.

We apologize for any confusion or inconvenience this may have
caused.
