I believe that would be considered permanent impacts converting a portion of the wetland to stream. Although this would not require mitigation I think it should be accurately accounted. Amanda, please confirm or correct me. I haven't been to the site and this might be obvious if I had, but please provide an analysis of whether you believe the hydrology of the remaining wetland will be modified/reduced by the relocation of the stream. If the slope is such that the lowest portion of the existing wetland would be downslope of the stream then it could be that the location of the stream would intercept the hydrology to a portion of the wetland in the future. In order for DWR to provide an exemption from Condition 11.9 in GC#4134 you must request to work in the wet and provide a detailed justification with supporting documentation such as calculations or construction sequences, explaining why it is not feasible to work in the dry. While it may be not be practical to provide full time pump around, you must explain why it is not feasible to temporarily pump around while equipment is in the channel/structures are being installed, and divert water back into the channel when equipment is not actively within the channel. You must also provide an explanation of how you intend to meet downstream water quality standards, such as turbidity standards, while working in the wet.
