Reference is also made to the site visit conducted on July 6, 1993, by Mr. John Thomas of my staff at the site of the proposed sanitary sewer project. The purpose of the site visit was to review plans for the aforementioned sewer outfall project, and to inspect the site for waters and wetlands subject to Department of the Army permitting authority. The site visit revealed and the plans / profiles for the aforementioned project provided with a notification application form showed that you propose construction for the Mill Creek sanitary sewer project below natural grade within a 40' construction easement adjacent to Mill Creek. Also your plans and profiles show other sections of proposed sewer outfall either located on high ground or elevated over waters of the United States without discharge of fill into regulated areas. For the purposes of the Corps of Engineers, Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to Section 404 of the Clean Water Act, was provided for the discharge of material for backfill or bedding for utility lines, including outfall and intake structures, provided there is no change in pre-construction contours. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. Please be aware that this authorization does not relieve you of the responsibility to obtain any other required or local approval. You should contact Mr. John Dorney, North Carolina Division of Environmental Management, (919) 733-1786, to obtain the necessary Section 401, Water Quality Certification prior to starting work. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, -2- this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. If during the 2 years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit will remain authorized provided the activity is completed within 12 months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. NARRATIVE The City of Winston-Salem proposes to install a sewer line in a newly annexed area north of the business district. The line will be approximately 8,720 in length, and will be installed below the grade of the adjacent stream. The line will remain 50+ feet from the stream to the maximum extent practicable, and will cross jurisdictional wetland areas at the following stations: 37+90 to 38+15 52+65 to 52+95 68+70 to 69+00 83+50 to 84+00 These wetland areas have been reviewed in the field by a representative of the COE (John Thomas) and location has been confirmed. The project will be installed, and construction restricted, to within a 40-foot wide corridor. Response from the USFWS indicated the potential presence of two protected I species: Cardamine micranthera and Clemmys muhlenbergii. A field review in May for these species revealed no individuals and no appropriate habitat for either. In addition, the NCWRC indicated the potential presence of Exoglossum maxillingua, a state "Endangered" species. Field review revealed no appropriate habitat for the species, nor would the species be expected in the project area (Dr. Edward Menhinick, UNCC, pers. comm.). Response from the Dept. of Cultural Resources indicated no known presence of archaeological or historical resources in the project area. Price, Jr., Director Thank you for your letter of January 26, 1993, concerning the above project. There are no known recorded archaeological sites within the project boundaries. However, the project area has never been systematically surveyed to determine the location of significance of archaeological resources. We recommend that a comprehensive survey be conducted by an experienced archaeologist to identify the presence and significance of archaeological remains that may be damaged or destroyed by the proposed project. Potential effects on unknown resources should be assessed prior to the initiation of construction activities. In particular, we recommend the archaeological investigation emphasize deep testing within the sewer corridor to determine the presence and significance of archaeological remains which might be buried under floodplain deposits. Enclosed is a list of archaeological consultants who have conducted or expressed an interest in conducting contract work in North Carolina. Individual files providing additional information on the consultants may be examined at the State Historic Preservation Office's Office of State Archaeology, 421 North Blount Street, Raleigh. If additional names are desired, you may consult the current listing of the members of the Society of Professional Archaeologists, or contact the society's current secretary/treasurer, J. Barto Arnold, III, P.O. Box 13265, Austin, Texas 78711-3265. Any of the above persons, or any other experienced archaeologist, may be contacted to conduct the recommended investigation. We have conducted a search of our files and are aware of no structures of historical or architectural importance located within the planning area. K. Mike Gantt, regarding the subject project. Your letter was forwarded to our office for a response since we handle all projects of this nature for the western portion of North Carolina, including Forsyth County. These comments are provided in accordance with the provisions of the Fish and Wildlife Coordination Act, as amended (16 U.S.C. 661-667e), and Section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543). According to your letter, this project will involve the construction of a sewer line that will parallel Mill Creek from NC 52 to approximately SR 2485, south of the Town of Stanleyville. The sewer line will be constructed adjacent to the north side of the creek with an approximate 50-foot buffer. The purpose of this project is to hook up with an existing sewer line to extend service within the Mill Creek basin. The U.S. Fish and Wildlife Service (Service) is particularly concerned about the potential impacts the proposed project may have on stream and wetland ecosystems within the project impact area and on the small-anthered bittercress (Cardamine micranthera), a federally endangered plant species, and the bog turtle (Clemmvs muhlenbergii), a Federal candidate species. Preference should be given to alternative alignments, stream-crossing structures, and construction techniques that avoid and/or minimize encroachment and impacts to these resources. The small-anthered bittercress is endemic to Stokes and Forsyth Counties. This plant species occurs along seepages and stream banks and in moist woods. It was known to occur along Belews Creek, southeast of the town of Belews Creek; however, this population is believed to be extirpated. The bog turtle occurs in several mountain and upper Piedmont counties in North Carolina. It inhabits damp grassy fields; sphagnum bogs; swamps; marshes; and clear, slow-moving streams with muddy bottoms. This species is known to occur in five sites in Forsyth County--three in the Winston-Salem area (South Fork Creek, Muddy Creek, Fiddler Creek) and two near the town of Belews Creek. In accordance with the Endangered Species Act of 1973, as amended (Act), it is the responsibility of the appropriate Federal regulatory agency to review its activities or programs and to identify any such activities or programs that may affect endangered or threatened species or their habitat. If it is determined that these proposed activities may adversely affect any species federally listed as endangered or threatened, formal consultation with this office must be initiated. Please note that candidate species are not legally protected under the Act and are not subject to any of its provisions, including Section 7, until they are formally proposed or listed as endangered or threatened. We are including these species in our response to give you advance notification and to request your assistance in protecting them. If you have any questions regarding the legal responsibilities of a Federal agency or their designated non-Federal representative under Section 7 of the Act, please contact Ms. Janice Nicholls of our staff at 704/665-1195, Ext. 227. Thus, the Service recommends that surveys be conducted for the above-mentioned species within the project area. Additionally, the Service's review of any environmental document would be greatly facilitated if the document contained the following information: (1) A complete analysis and comparison of all available alternatives, including the no-action alternative. (2) A description of the fishery and wildlife resources within existing and required additional rights-of-way and any areas that may be affected directly or indirectly by the proposed project. (3) Acreage and description of branches, creeks, streams, rivers, or wetlands that will be filled as a consequence of the proposed sewer line construction. Wetlands affected by the proposed project should be mapped in accordance with the Federal Manual for Identifying and Delineating Jurisdictional Wetlands. (4) Acreage of upland habitats, by cover type, that will be eliminated as a consequence of the project. (5) Mitigation measures that will be employed to avoid, eliminate, reduce, or compensate for habitat value losses associated with any portion of the project.
