Aqua North Carolina, Inc. (Aqua) offers the following response to the above -referenced Notice of Violation
and Intent to Assess Civil Penalty which was issued for exceeding the daily BOD maximum in the month
of February.
Agua's Response:
Effluent sampled on 2128 exceeded daily maximum BOD. Elevated river level due to rainfall trapped
air in the discharge line, resulting in a flow reversal into the pond from the discharge line, skewing the
sample result. A vent has been added to the discharge line in an effort to prevent future occurrence.
