On May 7, 2019, Duke Energy Progress, LLC (Duke Energy) received the subject Notice of
Violation & Intent to Assess Civil Penalty letter dated May 1, 2019. In accordance with the
letter, Duke Energy submits this response regarding Outfall 001 effluent zinc results for
February 2019.
A review of our records for the February 2019 Discharge Monitoring Report (DMR) reveal a data
entry error for Outfall 001. The zinc result for February 10, 2019 was entered as 10.1 mgll
whereas the result should have been entered as 0.010 mgll. The 10.1 mgA entry also
contributed to a miscalculation of the monthly average of 2.54 mgll. The correct monthly
average is 0.018 mgll. The permit outfall 001 effluent limitations for zinc are 1.0 mgll for the
daily maximum and monthly average, respectively. Neither the daily maximum limit nor the
monthly average limit for zinc in Outfall 001 was exceeded. The Notice of Violation & Intent to
Assess Civil Penalty was generated for the exceedances at Outfall 1; however, no actual
exceedances of the permit occurred.
A revised DMR has been prepared and resubmitted through the Division's eDMR system.
Based on the results of the corrected data, Duke Energy respectfully request the Notice of
Violation & Intent to Assess Civil Penalty be rescinded. Duke Energy has taken corrective
actions to address the data entry error leading to the issuance of the Notice of Violation & Intent
to Assess Civil Penalty
