Reference the application of Mr. Andrew Lundquist, Ms. Mary Ellen
Lundquist and Mr. Thomas Meninno for Department of the Army authorization to
construct a pier and place fill materials in wetlands adjacent to a canal off
Pamlico Sound, Brigands Bay, Frisco, Dare County,ANorth Carolina.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. All work authorized by this permit must be performed in strict
compliance with the permit plans.
b. The fill material will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials, or unsightly debris will
not be used.
C. The permittee will maintain the authorized work in good condition and
in conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transferred to a third party.
d. The authorized structure and associated activity will not cause an
unacceptable interference with navigation.
e. The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or
construction-related discharge. Increases such that the turbidity in the
waterbody is 25 NTU's or less are not considered significant.

THIS CERTIFICATION is issued in conformity with the
requirements of Section 401 Public Laws 92-500 and 95-217 of the
United States and subject to the North Carolina Division of
Environmental Management Regulations in 15 NCAC 2H, Section .0500
to Andrew, Mary Ellen Lundquist and Thomas Meninno pursuant to an
application filed on the 11th day of March 1993 to fill 1,294
square feet of wetlands for construction of a residence.
The Application provides adequate assurance that the
discharge of fill material into wetlands adjacent to the waters
of Pamlico Sound in conjunction with the proposed lot fill in
Dare County will not result in a violation of applicable Water
Quality Standards and discharge guidelines. Therefore, the State
of North Carolina certifies that this activity will not violate
Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if
conducted in accordance with the application and conditions
hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as
to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the stream is 25 NTU's or less are not
considered significant).
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the
above conditions are made conditions of the Federal Permit.

Site Description
The applicants currently own a 12,(XX) square foot tract of land (Lots 187 and 1/2 of Lot 188) off
Freebooter Court in Brigandl Bay Subdivision, Frisco, Dare County. The property sits on a man-made
canal system which connects with the SA waters of Pamlico Sound. This lot represents a typical scenario
within Brigands Bay. WheA the canal systern was dug the spoil material was placed often unequally on the
adjacent shorelines. The applicants property received very little fill material leaving it lower than other
lots.
Vegetation on the property is dominated by black needlerush (Juncus roemerianus) with scattered wax
myrtles (M ri eerie W and red cedars (Juniperu5 virginiana). Wax myrtles tend to form a line around
the sides of the property. The red cedars are more frequent near the coastal marsh. The black needlerush
forms a dense stand in the interior of the property and is continuous out to the coastal marsh along the
canal. The coastal marsh along the canal consists of a 4 foot wide fringe of salt marsh cordgrass S artina
Iterni , a 15 to 20 foot wide area of black needlerush, silverling (Baccharis halimifolia), and marsh
elder (Iva fr oon

graditt back into a scattered line of red cedars and wax myrtles. The U.S. Army
Corps of Engineers has delineated an irregular shaped area of black needlerush and red cedar in the center
of the property as Section 404 jurisdictional wetlands. The majority of the property is within the 75 foot
Estuarine Shoreline AEC.
It should also be noted that the entire property floods during storm tides and that the wetland area is
continuous with coastal marsh even though there is some separation of jurisdiction.
The applicant's propolt to fill approximately 1,294 square feet of the interior wetlands out to the red
cedars near the coastal marsh. The filling of these wetlands will allow enough separation to install a septic
system drainfield near the rtltltd and then construct a 35 ft. x 50 ft. four bedroom house near the coastal
wetlands. An asphalt driveway from Freebooter Court to the house is also proposed. A 30 ft. x 4 ft. wide
walkway and pier with a 4 lt. X 12 ft. platform end will extend from the house to the canal for water
access.
Anticipated Impacts
They will remove 1,294 square feet of functional black needlerush wetland from the Estuarine
System. Although the area to be filled was not claimed as coastal wetlands because of the infrequency of
flooding and shrubby buffeH, extreme storm tides will flush the area and provide some nutrient input into
the estuarine system. The filling, grading, and septic drainfield installation will disturb over 1/2 of the
property. The house and driveway cover approximately 30% of the property within the Estuarine Shoreline
AEC with impervious surfatks. The proposed walkway and pier will shade 150 square feet of coastal
wetlands and public trust waters.

Enclosed is the application of Mr. Andrew Lundquist, Ms. Mary Ellen
Lundquist and Mr. Thomas Meninno for Department of the Army authorization and
a State Water Quality Certification to place fill materials in wetlands
adjacent to a canal off Pamlico Sound, Brigands Bay, Frisco, Dare County,
North Carolina. Your receipt of this letter verifies your acceptance of a
valid request for certification in accordance with Section 325.2(b)(ii) of our
administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days
after receipt of a request for certification is a reasonable time for State
action. Therefore, if you have not acted on the request, or asked for an
extension of time, by May 10, 1993, the District Engineer will deem that
waiver has occurred.

(copy enclosed), which provides Federal authorization for construction
activities that receive authorization from the State of North Carolina.
A review of your application received March 3, 1993, for Department of the
Army authorization to place fill materials in wetlands adjacent to a canal off
Pamlico Sound, Brigands Bay, Frisco, Dare County, North Carolina, indicates it
to be a candidate for Federal authorization under this general permit.
