On February 6, 1990, the DA and the U.S. Environmental Protection Agency (EPA) signed a memorandum of agreement (MOA) establishing procedures to determine the type and level of mitigation necessary to comply with the Clean Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding impacts to waters and wetlands through the selection of the least damaging, practical alternative; second, taking appropriate and practical steps to minimize impacts on waters and wetlands; and finally, compensating for any remaining unavoidable impacts to the extent appropriate and practical. To enable us to process your application in full compliance with this MOA, we request that you provide the following additional information: a. Permits for work within wetlands or other special aquatic sites are available only if the proposed work is the least environmentally damaging, practicable alternative. Please furnish information regarding any other alternatives, including upland alternatives, to the work for which you have applied and provide justification that your selected plan is the least damaging to water or wetland areas. b. It is necessary for you to have taken all appropriate and practical steps to minimize wetland losses. Please indicate all that you have done, especially regarding development and modification of plans and proposed construction techniques, to minimize adverse impacts. C. The MOA requires that appropriate and practical mitigation will be required for all unavoidable adverse impacts remaining after all appropriate and practical minimization has been employed. Copies of these General Certifications are attached. These Certifications may be used in qualifying for coverage under Corps of Engineers' Nationwide Permits No. 13 and 16. Additional conditions are that the project must either a) have a spoil site with a capacity of 1100 cubic yards of spoil with a one foot freeboard or b) place only the amount of spoil to allow a 2:1 ratio with one foot of freeboard; settle/drain/decant; remove spoil and then repeat filling so a 2:1 volume ratio is maintained at all times. PROJECT SUMMARY: Applicant proposes to construct 340 linear feet of bulkhead, commercial docks totalling 280 feet in length, and 14 boat slips with pumpout facilities to accommodate boats 40'-55' long. Willie R. Etheridge Seafood Company Bio Report Page Two Site Description In the latter half of 1992, the Willie R. Etheridge Seafood Company purchased a wooded 8 acre parcel off S.R. 345 with approximately 500 feet of frontage along the Wanchese Harbor. Subsequently the applicant constructed approximately 265 linear feet of wooden bulkhead as authorized by CAMA General Permit #10131A issued August 18, 1992. Other Structures currently on this site are an old storage shed and dilapidated docks at the top of the "T" portions of the 500 ft. long canal on the southern portion of the property. A poorly maintained basin approximately 40' by 34' lies in the northern corner of the tract and is connected to the Wanchese Harbor by a 48' long access channel. The ground immediately surrounding the basin/access is approximately 3.5 feet to 5 feet above MSL and is vegetated primarily with 8'-12' tall wax myrtles (Myrica cerifeM and a few loblolly pines. A 10' wide ditch which is connected to the basin on its landward side has been filled in places with residential and industrial waste such as household appliances, gypsum board and old steel beams. Clumps of black needlerush ( n u roemerianus) exist at lower elevations in portions of the ditch not filled with debris. P=Qsed Improvements In order to protect the property from erosion and provide additional docking space for commercial fishing boats, the applicant proposes to do the following: * Remove the existing concrete riprap along 175 feet of Wanchese Harbor shoreline located between the canal and the southern property line. Replace the riprap with new wooden bulkhead and extend the bulkhead around the southern side of the canal north for a distance of 25 feet. * Dredge the 40' by 34' basin and 48' by 20' access channel to a maximum depth of -6' NWL by removing with dragline approximately 4' of bottom. Increase the width of the access channel by four feet. Construct approximately 140 linear feet of bulkhead around the basin. * Place the 450 cubic yards of spoil within a 160' by 40' diked disposal area located just landward of the existing bulkhead south of the basin. * Construct two 140' x 6' wide docks parallel to the two sections of bulkhead along the Wanchese Harbor. The proposed docks would extend seven feet waterward of the proposed bulkhead. * Construct eight 2' by 8' finger piers off the 6' wide docks and install 32 mooring pilings 26' waterward of the shore parallel dock to create 14 boat slips. * Remove the piles of debris lying within the 10' wide drainage ditch on the landward side of the basin. Etheridge Seafood Company Bio Report Page Three Anticipated Impacts The proposed excavation and bulkheading will destroy 2880 square feet of shallow water habitat (2300 dredged, 680 filled). The proposed docks and finger piers will obstruct and shade 2216 square feet of public trust *aters. Some short-term turbidity will result from the placement of the pilings for the bulkheads, docks, and finger piers. The proposed docks/slips will be constructed in water with a minimum depth of 14 feet NWL. These waters are classified SA (closed) by the Division of Environmental Management and no known shellfish resource exists. PROJECT SUMMARY: Applicant proposes to construct 340 linear feet of bulkhead, commercial docks totalling 280 feet in length, and 14 boat slips with pumpout facilities to accommodate boats 40'-55' long. Willie R. Etheridge Seafood Company Bio Report Page Two Site Description In the latter half of 1992, the Willie R. Etheridge Seafood Company purchased a wooded 8 acre parcel off S.R. 345 with approximately 500 feet of frontage along the Wanchese Harbor. Subsequently the applicant constructed approximately 265 linear feet of wooden bulkhead as authorized by CAMA General Permit #10131A issued August 18, 1992. Other Structures currently on this site are an old storage shed and dilapidated docks at the top of the "T" portions of the 500 ft. long canal on the southern portion of the property. A poorly maintained basin approximately 40' by 34' lies in the northern corner of the tract and is connected to the Wanchese Harbor by a 48' long access channel. The ground immediately surrounding the basin/access is approximately 3.5 feet to 5 feet above MSL and is vegetated primarily with 8'-12' tall wax myrtles (M,yrica cerifera) and a few loblolly pines. A 10' wide ditch which is connected to the basin on its landward side has been filled in places with residential and industrial waste such as household appliances, gypsum board and old steel beams. Clumps of black needlerush (Juncus roemerianus) exist at lower elevations in portions of the ditch not filled with debris. Proposed Improvements In order to protect the property from erosion and provide additional docking space for commercial fishing boats, the applicant proposes to do the following: * Remove the existing concrete riprap along 175 feet of Wanchese Harbor shoreline located between the canal and the southern property line. Replace the riprap with new wooden bulkhead and extend the bulkhead around the southern side of the canal north for a distance of 25 feet. * Dredge the 40' by 34' basin and 48' by 20' access channel to a maximum depth of -6' NWL by removing with dragline approximately 4' of bottom. Increase the width of the access channel by four feet. Construct approximately 140 linear feet of bulkhead around the basin. * Place the 450 cubic yards of spoil within a 160' by 40' diked disposal area located just landward of the existing bulkhead south of the basin. * Construct two 140' x 6' wide docks parallel to the two sections of bulkhead along the Wanchese Harbor. The proposed docks would extend seven feet waterward of the proposed bulkhead. * Construct eight 2' by 8' finger piers off the 6' wide docks and install 32 mooring pilings 26' waterward of the shore parallel dock to create 14 boat slips. * Remove the piles of debris lying within the 10' wide drainage ditch on the landward side of the basin. Etheridge Seafood Company Bio Report Page Three Anticipated Impacts The proposed excavation and bulkheading will destroy 2880 square feet of shallow water habitat (2300 dredged, 680 filled). The proposed docks and finger piers will obstruct and shade 2216 square feet of public trust waters. Some short-term turbidity will result frorn the placement of the pilings for the bulkheads, docks, and finger piers. The proposed docks/slips will be constructed in water with a minimum depth of 14 feet NWL. These waters are classified SA (closed) by the Division of Environmental Management and no known shellfish resource exists.
