It is important to understand that not all wetland encountered along this proposed force main were addressed on a rating sheet. The following are the stream identification and stream class information for the respective wetland rating sites. sitel-2 Little Lick Creek = river and basin # 03-04-01 stream index # 27-9 basin and class- Neuse River, C site 3 Chunky Pipe Creek= river and basin # 03-04-01 stream index # 27-9-1 basin and class- Neuse River, C site 4,5,6 Ellerbe Creek = river and basin # 03-04-01 stream index # 27-5 basin and class - Neuse River, C site 1) This site is a beaver swamp that is approximately 5 acres. The proposed force main will require a 30 foot wide by 600 foot long right-of-away through this wetland. The predominate vegetation: sycamore , sweetgum, cattails, poplar, and blackberry... I observed several snags and woodpecker cavity trees associated with this wetland. (The dead trees provides forage habitat for the woodpeckers.) The beaver swamp is a corridor utilized by both game and non-game wildlife species. I observed beaver, deer, and mink signs at this locality. site 5) - This sight is in a mixed hardwood bottom adjacent to an unnamed tributary of Ellerbe Creek. The wetland is ephemeral. The predominant overstory vegetation is sycamore, river birch, and sweetgum. This wetland is approximately 100 feet long and parallels a sewer line right-of-way. I observed marbled salamander larva at this site. There is potential for several common non-game species, which require fishless ephemeral habitats, to utilize this site. Glenn, P.E., R.L.S. 101 City Hall Plaza Durham, North Carolina 27701 Dear Mr. Glenn: Reference your application of December 23, 1992, for Department of the Army authorization to discharge fill material within waters of the United States, and wetlands adjacent to Little Lick Creek, Ellerbe Creek and tributaries, for backfill and bedding, and fill of 0.08 acre, related to construction of the proposed Little Lick Creek Pump Station and Force Main, in Durham, Durham County, North Carolina. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to Section 404 of the Clean Water Act, was provided for the discharge of material for backfill or bedding for utility lines, including outfall and intake structures, provided there is no change in pre-construction contours. Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was also provided for discharges of dredged or fill material into all waters of the United States provided: a. The discharge does not exceed 25 cubic yards; b. The discharge will not cause the loss of more than 1/10 acre of a special aquatic site, including wetlands. For the purposes of this nationwide permit, the acreage limitation includes the filled area plus special aquatic sites that are adversely affected by flooding and special aquatic sites that are drained so that they would no longer be a water of the United States as a result of the project; C. If the discharge exceeds 10 cubic yards or the discharge is in a special aquatic site, including wetlands, the permittee notifies the District Engineer in accordance with the "Notification" general condition. Also, this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. If during the 2 years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit will remain authorized provided the activity is completed within 12 months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. Raleigh, North Carolina 919/833-7152 F1 FORCE MAIN FROM LITTLE LICK CREEK WWTP TO NORTHSIDE WWTP ENVIRONMENTAL ASSESSMENT Proposed Facilities and Actions, Funding Sources Wastewater treatment for the northern section of the City of Durham is provided by three wastewater treatment plants within the Neuse River Basin: the Northside Wastewater Treatment Plant (WWTP), the Eno River WWTP, and the Little Lick Creek WWTP. The largest of these three facilities, the Northside WWTP, has an existing capacity of 9.5 mgd and discharges to Ellerbe Creek, a tributary of Falls Lake. The Eno River and Little Lick Creek plants are package-type treatment facilities which also discharge to tributaries of Falls Lake and have capacities of 2.5 and 1.5 mgd, respectively. The Eno River and Little Lick Creek plants were originally constructed in 1967-68 as temporary treatment facilities to serve newly annexed areas of the City. They have been expanded over the years, most recently in 1986-87, to provide for the increasing capacity needs of their respective service areas. A June 1987 201 Facilities Plan Amendment for the Northside and Little Lick Creek WWTPs evaluated alternatives for expansion of these two facilities. It recommended that the Little Lick Creek WWTP be abandoned and its wastewater transported to a regional treatment facility located at the Northside Plant, which would treat wastewater flow from both service areas. An environmental assessment was submitted in April 1989 with an NPDES Permit application to expand the Northside Plant to provide capacity to the year 2010 for projected flows from the Northside and Little Lick Creek service areas. This environment assessment has been approved and an NPDES permit issued for a flow capacity of 20 mgd. An environmental impact statement (EIS) has recently been completed by the U.S. Environmental Protection Agency (EPA) relating to evaluation of alternatives for expansion of the Eno River WWTP. Findings of the Eno EIS supported the recommendations of the 1987 201 Plan Amendment and recommended that the Eno River WWTP also be abandoned and its flow be transported to the Northside Plant for treatment. These recommendations for the Eno River and Little Lick Creek service areas have been accepted by the public and supported by the State and EPA through the EIS process. This environmental assessment was prepared to discuss the direct environmental impacts of the proposed force main from the Little Lick Creek WWTP site to the Northside WWTP. Indirect impacts have been previously addressed in the April 1989 Environmental Assessment for the Northside WWTP expansion and the 1990 Eno EIS. Proposed facilities for transportation of wastewater flows from the Little Lick Creek service area to the Northside WWTP include a pumping station to be located at the Little Lick Creek WWTP site and approximately 28,000 feet of 30-inch force main from the pumping station to the Northside Plant. The proposed force main route is shown on revised Figure 6-4 from the 1987 201 Amendment. The pumping station will have a peak flow capacity of 16 mgd. Projected capital cost for the pumping station and force main is estimated at $5,625,000. Funding for the project will be totally from local sources, although money from the State Water Pollution Control Revolving Fund is projected for the total Northside WWTP project, which also includes the Eno River pumping station and force main, the Northside Plant expansion facilities and interim sludge treatment and disposal facilities at the Northside Plant. B. Existing Environment 1. Topography and Soils About two-thirds of Durham County, including the route for the proposed force main, lies in a basin or lowland that is underlain by Triassic rocks of the Newark Group. This basin is characterized by mature, u-shaped valleys and fairly wide flood plains (Kirby, 1971). The soils along the force main route are comprised of three major soil associations: the White Store-Creedmoor, White Store-Pinkston, and Chewacla-Wehadkee-Congaree soil associations. Most of the route is in the White Store-Creedmoor association, which consists of gently sloping to moderately steep, moderately well drained soils that have a subsoil of dominantly firm and very firm clay, located on uplands. A small portion of the route is located within the White Store-Pinkston soil association, which contains soils similar to the White Store-Creedmoor soils 2 ' except for areas of excessively drained soils and a subsoil containing friable fine sandy loam. The White Store-Creedmoor and White Store-Pinkston soil ' associations consist of soils derived from shale and sandstone. Soils along Ellerbe Creek and Little Lick Creek are within the Chewacla-Wehadkee-Congaree ' soil association, which is characterized by somewhat poorly drained and poorly drained, nearly level soils subject to flooding and formed in alluvial ' material. This soil association has a subsoil of dominantly silty clay loam and well drained soils that are dominantly silt loam throughout. Only a small portion of the force main route near the Little Lick Creek Plant site is in the Chewacla-Wehadkee-Congaree soil association. ' The force main route is completely within the City of Durham Urban Growth Area and the areas along the route are developed at suburban densities, primarily typified by relatively small residential subdivisions. 2. Surface Water Other than approximately 3,000 feet along a tributary of Goose Creek near the Northside WWTP and 4,000 feet along a drainageway tributary to Little Lick Creek near the Little Lick Creek WWTP, the proposed force main route is ' mostly along existing roads and/or AT&T telephone cable easement and removed from surface water streams or creeks. The only significant stream crossing ' required for the proposed project is at Little Lick Creek. Two or three smaller creek or drainageway crossings are required near the Northside Plant. ' The project does not involve any discharges to surface waters. Discharge to Ellerbe Creek from the Northside WWTP has been addressed in the Northside WWTP Environmental Assessment and the Eno EIS. 3. Groundwater Water needs of most of the industry and population in Durham ' County are met from surface water impounded in Lake Michie and Little River Lake. Water needs outside of the City of Durham limits are predominantly ' supplied from groundwater obtained from individual wells. Need for Proposed Facilities and Actions ' The proposed project is required to implement the recommended alternative of both the 1987 Northside and Little Lick Creek WWTPs 201 ' Facilities Plan Amendment and the 1990 Eno EIS. A report by the North Carolina Division of Environmental Management (NCDEM) also recommends this ' alternative (NCDEM, 1989). The need for the project in terms of population and flow projections is addressed in the 201 Amendment and the EIS. Based on the 201 Amendment, the projected wastewater flow for the Little Lick Creek service area for the year 2010 is approximately 6 mgd. A pumping station and ' force main with a capacity of approximately 16 mgd is proposed to provide capacity for peak flows from the service area. Previous environmental assessments referenced above have adequately addressed the issues related to the need for this project. D. Alternative Analysis Alternatives to the proposed project consist of 1) the alternative of treating all flow from the Little Lick Creek service area at the existing Little Lick Creek Plant site, and 2) the "no action" alternative. Both of these alternatives were addressed in the environmental assessment for the proposed Northside WWTP expansion. The alternative of pumping Little Lick Creek service area wastewater flow to the Northside Plant was the recommended alternative in the 1987 201 Amendment. This alternative has been supported by the State and EPA and accepted by the public during the review process for the subsequent Northside WWTP environmental assessment and Eno EIS. Therefore, ' additional analysis of treatment location alternatives is not necessary. Alternative force main routes were evaluated during preliminary design of the proposed pumping station and force main. The proposed route was selected to parallel existing easements and rights-of-way, including right-of- way for streets and secondary roads, sanitary sewer line easements, drainage easements, and an AT&T telephone cable easement. The proposed route is the ' most direct route available and minimizes capital and pumping costs. E. Environmental Effects of the Proposed Project Indirect effects of the proposed force main construction are addressed in the 1989 Environmental Assessment for the Northside WWTP expansion and in the Eno EIS, and these reports are incorporated by reference. Direct effects are discussed in the following sections. 1. Changes in Land Use The proposed force main construction involves no changes in land use in the project area. A maximum easement of 30 feet will be acquired for areas of new easement. Where the force main parallels existing easements or rights-of- way, a lesser width will be required. 2. Wetlands Based on National Wetlands Inventory maps prepared by the U.S. Fish and Wildlife Service, the proposed force main crosses a wetlands area approximately 600 feet in length adjacent to Little Lick Creek near the treatment plant site. Construction of the proposed force main will disturb this area on a short-term basis. Disturbance will be minimized by carefully controlled construction techniques. The site will be restored to the existing grade after construction and should return to its natural state within a relatively short time period. The proposed construction is allowed under a nationwide 404 Permit for utility lines. A general 401 water quality certification also covers the proposed project. The force main does not cross any other wetlands along the proposed route. 3. Prime or Unique Agricultural Lands The proposed project will not significantly affect any prime or unique ' agricultural lands. A minimum easement width will be acquired for new easements and the force main will parallel existing easements and rights-of- way where possible. The entire route is located within the City of Durham Urban Growth Area, with planned future development for urban uses. 5 4. Public Lands, Scenic and Recreational Areas Based on information from the "Durham County Inventory of Critical Lands", no public lands or scenic and recreational areas are located in the vicinity of the proposed project (Triangle Land Conservancy, 1985). ' 5. Areas of Archaeological or Historic Value Based on the "Durham County Inventory of Critical Lands", there are no archaeological sites in the vicinity of the proposed force main. Four cemeteries are located near the proposed force main but none will be impacted by the proposed project. 6. Noise and Air Quality Noise and air quality impacts during construction would be related to noise and emissions from construction equipment and possible airborne dust from soil excavations. Such impacts will be short-term and minimized by limiting construction to normal daytime working hours, by proper maintenance of construction equipment, and by wetting of soil as necessary to control t dust. 1. Groundwater Quality The proposed force main would have no impact on groundwater quality. 8. Water Supplies and Surface Water Quality The proposed force main would quality except for minor short-term during construction. Shellfish, Fish and Wildlife and Their Habitats Impacts to shellfish, fish and wildlife would be short-term relative to clearing of right-of-way where required. A maximum width of 30 feet would be cleared for new right-of-way. Force main location along existing easements or rights-of-way will be used where possible to minimize new easement clearing. Short-term impacts would also occur related to stream crossings, including one crossing of Little Lick Creek and two or three crossings of other small creeks or drainageways. Erosion and sedimentation control measures will be applied to minimize adverse impacts. No threatened or endangered species are expected to be adversely affected by the proposed project. The "Inventory of the ' Natural Areas and Rare Species of Durham County" does not identify any significant natural areas along the proposed force main route (Sutter, 1987). 10. Introduction of Toxic Substances No toxic substances are expected to be introduced into the environment ' as a result of the proposed project. 11. Eutrophication of Receiving Waters The proposed project will not involve any discharge to surface waters; therefore, it will have no effect on eutrophication of receiving waters. F. Mitigative Measures 1 Mitigative measures to minimize adverse effects on the environment for the proposed project are summarized as follows: 1) During Construction Activity Removal of natural vegetation along easements will be ' minimized by using already cleared areas where possible and/or paralleling existing easements or rights-of-way. New easements will have a maximum cleared width of 30 feet. 1 7 i Soil erosion and sediment will be limited by design and enforcement of effective erosion and sediment control measures. Construction noise, vehicle emissions and dust will be minimized by limiting construction to normal daytime working hours, by proper maintenance of construction equipment, and by watering to control dust. Impacts on archaeological or historic sites will be limited by routing of the proposed force main away from existing cemeteries which are identified in the "Durham County Inventory of Critical Lands" (Triangle Land Conservancy, 1985). 2) Long-Term Effects No significant long-term adverse effects are expected for the proposed project. 8 ' References !?1 In 1. The project area is a corridor approximately 30,000 feet long by 30 to 40 feet wide and is identified as the Little Lick Creek Force Main corridor. The purpose of this field inspection was to determine the nature and extent of wetlands regulated by the U.S. Army Corps of Engineers, (COE) under Section 404 of the Clean Water Act. During on-site visits, wetland sites along the corridor were delineated using the COE's "routine on-site determination method" of wetland delineation (see enclosed data forms). This method evaluates three parameters: soils, vegetation, and hydrology. The presence or absence of hydric qualities associated with each parameter is used to make a decision. Generally, all parameters must exhibit hydric characteristics before an area is deemed wetland. Further information on the necessary requirements needed for wetland confirmation can be found in the Corps of Engineers Wetlands Delineation Manual. The soil survey for Durham County indicates that portions of the corridor pass through wetland (or hydric) soils. The only hydric soil series listed for the project area is Chewacla. Chewacla soils are typically found within alluvial floodplains of the Piedmont. Most Chewacla soils are poorly drained and frequently flooded for brief periods. There are thirty-three crossings of wetlands or waters of the United States in the corridor. Four of these crossings are only waters of the United States. Cordell, P.E. Page two 15 December 1992 for a wetland determination. Narrow streams with little or no floodplain comprise many of the crossings. Most of these crossings are wetland inclusions within soils mapped as non-hydric. There are also areas within broad, low elevation, Chewacla floodplains that lacked the hydric soil parameter and are included as upland. Many of the wetlands exhibit soil colors of low chromas with some mottling. Soils with low chromas and mottling are characteristic of seasonally or temporarily flooded wetlands. The wetland vegetation is characteristic of Piedmont alluvial forests. Dominant canopy species include red maple (Acer rubrum) and sweetgum (Liquidambar styraciflua). Lesser amounts of willow oak (Quercus p hellos), American elm (Ulmus americana), river birch (Betula nigra), and tulip popular (Liriodendron tulipifera) are found present. There are relatively few shrubs and herbs, except along the wetland edge and on high areas within the floodplain. Common shrubs include red maple, arrow-wood (Viburnum dentatum), and swamp rose (Rosa palustris) in open areas. Herbaceous species include Nepal microstegium (Eulalia viminea), woodland oats (Chasmanthium laxum), and witchgrass (Dichanthelium dichotomum). Greenbriers (Smilax spp.) occur in the floodplain and become more common along wetland edges. Disturbed areas within the floodplain contained cattails (Typha spp.), soft rush (Juncus effusus), and meadow-beauty (Rhexia sp.) in low, poorly drained depressions and brook-side alder (Alnus serrulata) along creek edges. Vegetation of the upland areas is dominated by northern red oak (Quercus rubra) and white oak (Q. alba) with lesser amounts of American beech (Fagus grandifolia). Herbaceous species more common in upland areas include Japanese honeysuckle (Lonicera japonica) and Virginia heartleaf (Asarum virginicum). Hydrological status is sometimes a difficult parameter to evaluate, especially from a single visit. Pooled water and signs of surface water were observed in most of the wetlands on 11 and 17 November 1992. The soil was saturated close to the surface for other wetlands. Shallow pools of standing water were located in many of the low depressions. The presence of surface sediment deposits and dark stained leaves indicate that other areas had been inundated in the recent past. Oxidized rhizospheres (discolorization in the root zone), which are an indicator of plants that have been exposed to prolonged anaerobic conditions, were also noted. A single ribbon of pink survey tape was hung at the beginning and end of each crossing of a wetland or water of the United States along the corridor. Ribbons were numbered 6 through 73. Crossings that denote only waters of the United States include the area between flags numbered 10-11, 12-13, 38-39, and 40-41. Mr. Donald L. Cordell, P.E. Page three 15 December 1992 I met on-site with Eric Alsmeyer of the Raleigh COE field office on 10 December 1992. We walked much of the corridor and things went smoothly, with no significant changes to flagged areas. Eric is concerned that wetlands adjacent to upland portions of the corridor may receive fill and not be returned to original predisturbed contours. He pointed out that all impacts/disturbances to wetlands adjacent to upland portions of the corridor should be minimized and returned to original predisturbed contours. A draft map of the corridor indicating the approximate locations and areas of wetland crossings was given to Eric Alsmeyer on 10 December 1992. He signed a "Notification of Jurisdictional Determination", which indicates he has verified the wetlands along the corridor and the determination may be relied upon for three years (see enclosed form). He requested that we send him revised drawings indicating the locations of the surveyed wetland crossings. Eric also looked at the area surrounding the Little Lick Creek Pump Station. He agreed with the upland/wetland boundary along the southern boundary (flags numbered 1 through 5), and indicated that a narrow band of wetlands extends north from the end of a 6-inch PVC drain along the edge of the chain link fence in the "yard" of the established pump station. The area south of this drain to the flagged line (flags 1 through 5) is upland from the pump station to the edge of the creek bank. Eric indicated that expansion of the pump station and any fill in this area would not be covered under the same Nationwide permit for activity in the sewer line corridor. He mentioned that activity in this area could potentially be covered under a Nationwide 18 permit. Eric also said that both activities (sewer line corridor and pump station expansion) should be submitted on different applications. The outlet from the affected area at the 18" RCP at about Sta. 37+50 on Drawing No. 7 must be protected with a suitable stone filter or check dam. 4. The stone from check dams must be used at any pipe inlets or outlets affected by construction in the vicinity upon dismantling at the end of construction. This particularly applies to the 24" RCP at about Sta. 60+20 on Drawing No. 9. 5. The notes on Drawings 10 and 11 must be changed to reflect that a revised plan must be provided for our prior approval in the affected areas if new or additional measures are required other than those proposed in this plan. 6. Diversions must be provided adjacent to proposed check dams and basins as necessary to direct runoff from the affected areas to these traps avoiding OF bypass and subsequent sediment loss. This particularly applies,to Drawing - No. 22 where runoff along Mist Lake Drive needs to be diverted to Basin F. 7. A stone check dam must be added in the roadside ditch north of Camden Avenue below the affected area at about Sta. 228+50 on Drawing No. 23. 8. A stone check dam must be added below the 15" RCP outlet at about Sta. 40+50 on Drawing No. 28. 9. It should be noted that since the fords are intended as, permanent features, all rip-rap must be undercut in accordance with the profile drawings rather than the detail on Drawing No. 31. All rip-rap must be flush with surrounding earth surfaces, particularly at channel inverts. PERFORMANCE RESERVATIONS In light of the limited information provided for culvert outlets, use of stone from check dams is accepted subject to satisfactory field performance. If problems develop, detailed designs will be required. General Recommendations and/or comments: Revised record drawings due by 8/20/92.
