On June 19, 1995, I sent you a letter stating that we have no record of a 401 Water
Quality Certification issued for this project. We were in error. A 401 certification was
issued to Davis Park Associates on January 28, 1993 with an additional condition that a
permanent stormwater pond is constructed and maintained following written DEM approval of
plan. The 401 Certification is valid for three (3) years provided that all conditions are met.
Therefore, you must complete your project by January 28, 1996 or else submit an application
requesting an extension. Since an application form was sent in our June 19th letter, we are
not sending another one.

headwaters of, an unnamed tributary to Kit Creek, to complete construction of
an industrial park, south of S.R. 1978, near Clegg, Durham County, North
Carolina.
For the purposes of the Corps of Engineers' Regulatory Program, Title
33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization was
provided, pursuant to Section 404 of the Clean Water Act, for discharges of
dredged or fill material into headwaters and isolated waters.
Your work, causing the loss of 2.34 acres of waters of the United
States, is authorized by this nationwide permit provided it is accomplished in
strict accordance with the enclosed conditions and provided you have a valid
Section 401 water quality certification from the North Carolina Division of
Environmental Management. You should contact Mr. John Dorney, telephone (919)
733-1786, regarding water quality certification. This nationwide permit does
not relieve you of the responsibility to obtain other required State or local
approvals.
This verification will be valid until the nationwide permit is modified,
reissued or revoked, which will occur prior to January 21, 1997. It is
incumbent upon you to remain informed of changes to the nationwide permits,
which will be announced by public notice when they occur. If you commence, or
are under contract to commence, this activity before the date the nationwide
permit is modified or revoked, you will have twelve months from the date of
the modification or revocation to complete the activity under the present
terms and conditions of this nationwide permit.

The purpose of this letter is to request a reauthorization of our client's 401 Water
Quality Certification for the project known as Davis Park Associates Industrial
Park, Durham County, North Carolina. The original letter ( see attached,DEM
Project # 92751) was originally issued on January 28, 1993. Since the verification
is only valid for three years and the client's project has commenced but will not
be completed by the end of January we request a reauthorization. All impacts
will be the same as described in the current permit (2.34 acres under Nationwide
26). Due to unforeseen delays the project is behind schedule. Market conditions
have been such that the applicant has not been able to complete the Davis Park
project within the original authorization period. Our client should be able to
complete the project within the time limit allowed under a new Certification.
Our client understands that the same conditions still apply.
Please give us a call if you require any additional information to reauthorize this
Certification: The Corps has already reauthorized this project (see attached). If
the 401 is not reauthorized it will cause the client to have to consider completing
impacts to wetland areas prior to January 1996 which seems to be
environmentally and economically unreasonable.
