Box 240635 Charlotte, N.C. 28224-0635 Dear Mr. Tate: Subject: Proposed fill in Wetlands or Waters Pit expansion, Kings Mountain quarry Cleveland County DEM Project # 93382 Upon review of your request for 401 Water Quality Certification to place fill material in 5.7 acres of wetlands or waters which are tributary to Kings Creek to expand the quarry into a partially drained pond and relocate a stream located at Highway 210 in Cleveland County as described in your submittal dated 10 May 1993 and 30 July 1993, we have determined that the proposed fill can be covered by General Water Quality Certification No. 2671 issued January 21, 1992. A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 26. Additional conditions are that the stream relocation shall be done as outlined in your 30 July 1993 letter and the old settling pond shall be left undisturbed. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150E of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Box 29535 Raleigh, NC 27626-0535 SUBJECT: Pit Expansion Kings Mountain Quarry Mining Permit #23-02 Dear Mr. Dorney: In accordance with our meeting in Mooresville on July 27, 1993, we would like to offer the following comments regarding the Kings Mountain project. Creek Diversion: • The proposed creek will not be constructed as a straight channel. The lay of the land will allow for a meandering channel in several areas. The bottom of the creek channel will be dug to provide riffle and pool areas. Boulders will also be added if needed to provide adequate habitat for fish and wildlife. Carole Cameron, Landscape Specialist for Martin Marietta, will oversee the planting of Willows and River Birch to provide shade over portions of the waterway. Old Settling Pond: • The old settling pond located adjacent to I-85 contains a large delta with wetland vegetation. The current size of this delta is roughly 8 acres. This creek presently runs through a man made pond on our property. This pond is our only economically feasible area for future pit expansion for the quarry. The existing pit is surrounded by a number of obstacles which makes it impossible to expand except through the pond area. On the west side of the pit there is 70' to 100' of overburden which would need to be removed. The cost of doing this would be extremely high. Also, the raw material or rock is not a good quality material. On the north side we are at our limit because the close proximity of the property line. The east side has fiscal restraint of deep overburden, Duke Power transmission lines, Kings Creek, and a pond. Therefore the south side where the pond is, is the only realistic option we have for expansion. The expansion would take place by first relocating the creek out of the pond. The pond would than be completely drained and the silt excavated and placed in an approved berm. All of this is shown on the plans provided. Mr. Steve Lund looked at this site and noted about six acres of wetlands in the pond area. This pond has been partially drained. To my knowledge there are no endangered or threatened species or critical habitat in the permit area. Also, to my knowledge there are no historic properties in the permit area. For discharges in special aquatic sites, including wetlands, the notification re,%ist also include a delineation of affected specific aquatic sites, including wetlands; and c. the discharge, including all attendant features, both temporary and permanent, is part of a single and complete project. Your work is authorized by this NWP provided it is accomplished in strict accordance with the enclosed conditions.
