Dear Mr. Koenig:
Reference your application of October 12, 1993, for Department of the
Army (DA) authorization to place fill material into 0.33 acre of wetland above
the headwaters of Carvers Falls Creek to allow for construction of two
buildings and two parking areas for residential development on your proerty
located on the northeast corner of the intersection of US Highway 401 and SR
1713 in Fayetteville, Cumberland County, North Carolina.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization was
provided, pursuant to Section 404 of the Clean Water Act, for discharges of
dredged or fill material into headwaters and isolated waters.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions and provided
you receive a Section 401 water quality certification from the North Carolina
Division of Environmental Management (NCDEM). You should contact Mr. John
Dorney, telephone (919) 733-1786, regarding this water quality certification.
This nationwide permit does not relieve you of the responsibility to obtain
other required State or local approval.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.

Upon review of your request for 401 Water Quality Certification
to place fill material in 0.33 acres of wetlands or waters which are
tributary to W. Prong CarveFalls for condominuim development located
at U.S. 401 and SR 1713 in Cumberland County as described in your
submittal dated 4 October 1993, we have determined that the proposed
fill can be covered by General Water Quality Certification No. 2671.
A copy of the General Certification is attached. This Certification
may be used in qualifying for coverage under Corps of Engineers'
Nationwide Permit No. 26.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding..

The purpose of this letter is to revise a previous request for
Nationwide Permit 26, and a Section 401 Water Quality
Certification for the project to be known as North Hills
Condominiums. The project is located near Fayetteville, NC
(Cumberland County) and is bordered by US 401 and SR 1713 as shown
on the enclosed plans and vicinity maps. All aspects of the
original application are unchanged with the exception of items
bold faced in this letter, revisions to the enclosed map and
permit application. The total impacts have changed; only .33
acres are to be authorized under Nationwide 26 for filling the old
farm pond indicated on the plan. The wetland delineation has been
revised to be consistent with current 1987 Manual criteria and the
parking lot has been adjusted so that no wetlands adjacent to the
main creek will be impacted (see enclosed letter from Moorman,
Kizer and Reitzel,.and blueprints).
The wetland delineation is shown on the attached map. These
delineations have been field reviewed by Mr. Scott McLendon of the
U.S. Army Corps of Engineers.
Fill in the wetlands will be required to construct apartment
buildings and parking areas.
To expedite the permitting process and to make "life easier" on
everyone involved, the following individuals/agencies have been
provided with a complete copy of this entire application package:
Ken Averette (DEM) and David Franklin (Wilmington Corps).
Please call if you have questions or require further information.
If you intend to perform a site visit, please call and we will
arrange for someone to accompany you. Other previously submitted
information in our 4/30/93 application is still appropriate for
review of this application. We realize that we are not required

on 30 April 1993, you requested a 401 Water Quality
Certification from the Division of Environmental Management for
your project (North Hills Condominiums) located at SR 1713 in
Cumberland County. We wrote to you on 10 June 1993 discussing
concerns that we have regarding the design of the project and
placing it on hold until those concerns are addressed. As of
today, we have not received a response to our earlier letter.
Unless we receive a written response from you by 29 October 1993,
we will consider that you have withdrawn this application and are
not interested in pursuing the project at this time.

Section has reviewed your p3.713 in rCuwetland mberlandfill
of wetlands at US 401 & SR
residential development. Based on this review, we have
identified significant uses which would be removed by this
project. These uses are water storage, streambank stabilization
and pollutant removal. Furthermore, insufficient evidence is
present in our files to conclude that your project must be built
in wetlands. Therefore, we are moving toward denial of your 401
Certification. Until we receive additional information, we are
requesting (by copy of this letter) that the U.S. Army Corps of
Engineers and/or the N.C. Division of Coastal Management place
your project on administrative hold.
Please provide us with information supporting your position
that your project must be constructed as planned. Specifically
can you construct your residential development on nearby uplands
or prior converted farmland? Any documentation such as maps and
narrative which you can supply to address upland alternatives may
be helpful in our review of your 401 Certification. Also please
confirm that wetland fill on this site is eligible for Nationwide
Permit 26. Please respond within two weeks of the date of this
letter.

The purpose of this letter is to request a Nationwide Permit 26,
and a Section 401 Water Quality Certificationfor the protect to
be known as North Hills Condominiums. The project is located near
Fayetteville, NC (Cumberland County) and is bordered by US 401 and
S.R. 1713 as shown on the enclosed plans and vicinity maps.
The Corps approved detailed wetland delineation is shown on the
attached map. These delineations have been approved by Mr. Scott
McLendon of the U .S. Army Corps of Engineers.
Fill in the wetlands will be required to construct two buildings
and two parking areas, as part of a residential development.
It will be necessary of jurisdictional
wetlands above headwaters for placement of the proposed facilities
utilizing Nationwide 26. A sanitary sewer outfall already exists
in the wetland. The proposed development hasbeen aligned to
minimize wetland impacts, especially to high quality wetland
areas, and the fill will be placed adjacent to the existing
sewer line. Please note that one area of fill is in an old farm
pond with no stream entering or leaving it with no adjacent
vegetated wetlands.- The other proposed impact area is within an
old abandoned farm field that meets the wetland criteria but is a
marginal/low quality wetland at best.
